The undocumented Mexican immigrant acquitted of murder and manslaughter in the controversial death of 32-year-old Kate Steinle is due back in San Francisco Superior Court this week for a sentencing hearing.

Judge Samuel K. Feng is scheduled to sentence 45-year-old Jose Ines Garcia Zarate on Friday for the only conviction jurors returned against the defendant for being a felon in possession of a firearm.

oh good grief.....if he'd been the driver for someone who murdered someone...in TX you can get the death penalty! But this scum could possible walk free in a few years? Makes zero sense.

Dismissal Upheld In Lawsuit By Kate Steinle Family Against Former San Francisco Sheriff

A federal appeals court upheld the dismissal of a negligence claim against the city of San Francisco and a former sheriff by the parents of a woman killed by a bullet from a gun held by an undocumented immigrant.

But the lawsuit still retains a claim against the U.S. Bureau of Land Management that the parents can seek to take to trial.

California appeals court overturns sole conviction in Kate Steinle death

A California state appeals court Friday overturned the lone conviction against an undocumented immigrant who shot and killed Kate Steinle on the San Francisco waterfront in 2015, a case which drew national attention and became a flashpoint in the debate over illegal immigration.

Jose Inez Garcia-Zarate, who was in the U.S. illegally had been deported to his native Mexico five times, was acquitted in November 2017 of first and second-degree murder, involuntary manslaughter, and assault with a semi-automatic weapon. He was convicted of one count of being a felon in possession of a firearm.

During jury deliberations, jury members asked the court for the definition of possession and if there was a time requirement for possession. The defense argued during the appeal that the trial court failed to instruct the jury that it could acquit Garcia-Zarate because he only possessed the gun for a moment.

On Friday, the First Appellate Court of Appeals in California, in a 3-0 decision, agreed with that defense.

Jose Inez Garcia-Zarate, 51, a Mexican national, pleaded guilty on Monday to being a felon in possession of a firearm and being in the United States illegally while in possession of a firearm. He faces up to 10 years in prison per count, plus three years of supervised release. He's currently detained in federal custody in California.

Garcia-Zarate's guilty plea comes seven years after he fatally shot Steinle in the back as she walked along Pier 40 with her father and a family friend in 2015. He had claimed the shooting was accidental and that he was handling a handgun he found wrapped in a T-shirt under a bench on the pier when it accidentally fired."

Sure, why should law enforcement officials cooperate? It is so much better to obfuscate the law.
