GUILTY CA - Laci Peterson, 27, pregnant, Modesto, 24 Dec 2002 #2

Why would an illegitimate son affect his guilt or innocence?

I think the implication is that if Scott knew about this teenager , he was never involved, never paid child support, and the mother of the teen was dead. My sense was that the author was hinting people should look into it.

It seems strange to include in a vetted book. She would know the name of the letter writer, and I read the Kindle edition, which means it was never removed.

For me, it just points to consistency in his not wanting to be a father. It doesn't exonerate him.

I think the suggestion is not to exonerate him, but to point out that if the claim is true, Scott has another former partner who died and another child he didn’t want.
Except that it doesn't make him a serial killer. This woman lived to give birth. As far as we know, she wasn't murdered.

But on Wednesday, after two decades of efforts to overturn the verdict, a fresh group of defense lawyers from the Los Angeles Innocence Project will try to convince a judge that old DNA samples from a bloody mattress in Modesto, and other pieces of evidence that washed up along the San Francisco Bay, must be retested to support Peterson’s claim of “actual innocence.”

It could be his last chance at freedom.

In an extraordinary 337-page argument, however, prosecutors didn’t just lay out why they opposed handing over the evidence. In meticulous detail, they also reminded readers exactly why the handsome fertilizer salesman from Modesto was convicted in the first place. Page by page, they listed nearly every shred of evidence they presented at trial, including photographs and transcript excerpts.

“They want the public to know that, at least in their mind, they got it right,” said Steven Clark, a legal analyst who followed the trial in 2004.

The brief includes memorable highlights as well as deep details that prosecutors presented at trial to convince the jury that although their case was circumstantial, it was more than enough to prove Peterson killed his wife. They include:

  • Two weeks before Laci disappeared, Peterson told his secret mistress, Amber Frey, he had “lost” his wife and would be spending his first Christmas without her.
  • Days later, he bought an aluminum fishing boat but never told anyone, including his father-in-law who was an avid fisherman. During a family dinner party a week before Laci vanished, they all discussed fishing, but Peterson never mentioned the boat.
  • When Peterson returned from the Berkeley marina the afternoon of Christmas Eve, he told a neighbor he had spent the day golfing. He called his mother-in-law and told her “Laci is missing.”
  • The bodies washed up not far from where Peterson later told police he fished the day Laci disappeared. In one of his first conversations with a police officer, he hesitated when asked what he was fishing for and what lures he used.
  • Police found cement “rings” on the floor of the storage space where they believe he made anchors to sink Laci’s body. Only her torso was found.
  • A month after Laci disappeared – and three months before her body was discovered – Peterson traded in her Land Rover for a Dodge truck and called a realtor about selling their house that included the fully furnished nursery for the baby they planned to name Conner.

3/12/24 Update: [Case #SC055500A] Judge Hill set the following schedule for Peterson’s future hearings with the LA Innocence Project: Hearing on motion to seal court records on 4/16/24 @ 9am, hearing on DNA testing motion on 5/29/24 @ 9am & hearing on 1054.9 motion on 7/15/24 @ 9am & Peterson will appear via Zoom at all hearings from Mule Creek State Prison. The LA Innocence Project was given a 6-month deadline from the court to complete its Peterson investigation, Mitchell said.
4/16/24 Update: Tuesday's hearing in Redwood City was on the motion to seal proceedings in the case, which the judge dismissed. Peterson appeared at the brief hearing via Zoom from his location at Mule Creek State Prison in Amador County. The State expressed confusion as to why a motion to seal names was filed when no one knows the witnesses, who are listed as anonymous. The motion mentioned a single exhibit containing redacted information limited to names of witnesses obtained from police reports during the original investigation. Peterson's defense ultimately agreed to withdraw that exhibit. A second motion for post-conviction DNA testing is scheduled for 5/29/24 @ 9am & has to do with a van that was near the Peterson's home that was involved in a burglary at or near the time of Laci's disappearance. The third motion scheduled for 7/15/24 @ 9am seeks post-trial discovery from the case, including evidence of the December 2002 burglary across the street from the Petersons' Modesto home, a missing watch belonging to Laci Peterson & files & documents from witness interviews. Peterson was also expected to attend the other two motion hearings remotely.
4/22/24 Docket update: People's Opposition to Motion for DNA testing (Pen. Code S1405) filed by attorney Jeff Laugero, Stanislaus County DA, Birgit Fladager, Special Prosecutor & David P. Harris, Special Prosecutor.

Why would an illegitimate son affect his guilt or innocence?
It wouldn’t IMO - but it would just help reconfirm the opinion of many, and the Modesto jury that convicted him - that he was an adulterer and the murderer of his then wife LP and their unborn son CP.

I have not and won’t read this ‘innocence’ projects latest filings or pleadings - but perhaps that is all they are trying to reconfirm? Such a waste of resources IMO. And unfortunate that this airtime and press time is spent on this individual. MOO

On the one apparent piece of duct-tape to be tested - I wonder (like some similarities in the NY LISK / GILGO case) whether hair from a dog or animal, or perhaps relevant finger prints might have remained on that piece of tape? And also however wonder whether that amount of time immersed in an aqueous environment might have affected some of the remnants? MOO

It unfortunately says the same, that the judge allowed the duct tape to be tested. It's a waste of time, he's been proven guilty far beyond reasonable doubt. It's so dumb, as if only DNA can prove someone is guilty. It would be so perfect if they find his DNA on it.

The link is a good article, it ends with this:

Like he did in a 337-page brief, however, Harris again recounted what he called “overwhelming” evidence against Peterson, including that Peterson told his mistress he had “lost” his wife before she actually disappeared and he would be spending his first holidays without her.

Peterson’s defense team, Harris said, has never explained why Peterson was doing internet searches in early December studying the currents and depths of the bay, even before he bought the fishing boat he told no one about. The defense never explained, he said, what happened to all the extra cement he purchased, if it was not for making several anchors to weigh down his wife’s body. Harris also recalled a wiretapped phone call when Peterson’s mother encouraged him to fly to Washington where there had been a Laci sighting.

When he hung up, Harris said, “you can hear the defendant laughing at his mother who thinks he’s going to go to Washington and search for his missing wife.”

Per this article:

Another hearing is scheduled for July 1 to go over details about the duct tape to be retested, and the defense team is still hoping to gain access to evidence from eyewitnesses who said they saw Laci walking her dog the morning she disappeared.

and then there is the third motions hearing on 7/15/24 - which seeks post-trial discovery from the case, including evidence of the December 2002 burglary across the street from the Petersons' Modesto home, a missing watch belonging to Laci Peterson & files & documents from witness interviews.

per my notes^^
