6/26/19 Day 28: Defense witness: Micah Allison continues testifying. Oakland firefighter Daniel Keenan. Thomas Cappel, musician. After the jury was dismissed, Serra told Judge Trina Thompson that one of their witnesses, unlicensed contractor Troy Altieri had failed to return to court to finish his testimony. Rather than have an arrest warrant issued, Serra asked that Altieri's previous testimony be stricken from the record. The trial is in recess until Monday, 7/8.
7/8/19 Day 29: Defense witnesses: Darold Leite, a contractor who lived at the Ghost Ship. Derick Almena (testimony will continue tomorrow). Trial continues on 7/9.

After two days of emotional testimony, Ghost Ship warehouse master tenant Derick Almena became combative with prosecutors during their cross examination Wednesday morning.

Almena had testified that he never allowed debauchery or rave parties at the warehouse when he was questioned by his attorney Tony Serra. Those statements led to a contentious exchange been Almena and Alameda County prosecutor Autrey James during cross examination.

James said a Jan. 3, 2015 police report indicated that Almena had told officers that there had been a wild New Year’s Eve party, which Almena didn’t organize, at the warehouse a few days earlier in which condoms were left on the floor and his son put one of the condoms in his mouth.

Confronted by that report and a video of his statement to police, Almena said, “Did it happen? I hope not, it’s horrible.”

GHOST SHIP TRIAL: Almena Becomes Combative During Cross Examination
The prosecutor brought up the New Year's party to point out Almena's claims about not allowing "debauchery or raves" - IOW, it goes to Almena's credibility, or lack of. “It goes to his credibility,” the prosecutor said. “If he says something that goes against the evidence, he should be confronted.”
Almena and a friend got into a verbal fight at the warehouse days later over the party, and in particular over condoms from various people found on the floor, according to a police body camera footage. Almena called the cops, who took a statement from him about the fight.

When James asked Almena to confirm that he told police on Jan. 3, 2015 that his young son had found a used condom left by partygoers and put it in his mouth, Almena at first denied it.

He instead said it was someone else’s dog who ate a condom. But in attempts to catch Almena in a lie, James showed the jury a video in which the conversation occurred between Almena and the police officer.

The founder of a California communal living warehouse where a fire killed 36 people more than two years ago says testified Thursday he's not blaming anyone else for the deadly fire.

"I'm not blaming anyone," Derick Almena said during his cross-examination.

His comment was met with scoffs from some of the victims' relatives, the East Bay Times reported.

Almena's defense has made it known they are shifting blame to city officials, such as police, fire and building inspectors who they say should have known about the dangers of the Ghost Ship warehouse.

7/15/19 Day 33: Prosecution rebuttal witnesses: Oakland police Officer Michael Ericksen. ATF agent Whitney Hameth. DA's Inspector Paul Balzouman (a former Oakland police officer). The trial ended early for the day, at about 11:30 a.m. The case resumes Tuesday (7/16) morning with two final DA witnesses. Closing arguments will begin 7/29.

Final item today was a rebuttal by Harris' attorney, calling Oakland police Officer Hector Chavez as their last witness. The officer appeared to contradict his prior testimony that Harris had pushed him out the door on a prior rave in 2015. It may have been a case of mistaken identity because the name "Max" could be heard in the video but it did not resemble Harris.

As Niner posted, closing arguments begin July 26.

Heartbreaking article by Chelsea Faith Dolan's mother, Colleen:

For the last 2½ years, I’d pictured my daughter and her dear friends perishing together in the flames and smoke. My one consolation was that Chelsea was with people she loved when she died.

This is what I learned by listening carefully to each witness and taking notes on exactly what was said: Chelsea was standing outside in front of the entrance to the two-story warehouse when the fire broke out. She saw mostly residents from the first floor filing out of the building talking about a fire. None of her friends were coming out and the music from upstairs was still playing loudly. Chelsea told a woman to call 911 and ran inside to warn her friends.

What Chelsea didn’t know was that master tenant Derrick Almena built that tinderbox inside the warehouse with no safety precautions. The fire spread intensely because it was all fuel. There was no drywall. No sprinklers to slow the fire or alarms to warn the victims. A few people escaped after she reached the second floor, but Chelsea didn’t make it back through the flames.

Three witnesses who survived the fire described Chelsea running into the burning warehouse and up the stairs. The news that my daughter had been safe outside the warehouse when the fire broke out crushed me.

Tony Serra tried to blame Chelsea for the deaths, claiming she was that imaginary "mystery woman" who was sitting in the imaginary wicker chair by the stairs saying "“It was the will of the Spirit of the Forest” and telling people to stay upstairs.

A new low even for Serra. Colleen continues to say according to testimony, Max Harris, instead of warning people to get out instead went and grabbed his cell phone and computer. He stood outside videoing the fire and posting it on Instagram. Note that witnesses said Harris did go out but they said he was holding his phone to help light the way out. Draw your own conclusions I guess.

Jury excused until closing arguments, which will begin 7/29, which are expected to last all week. Deliberations by the jury could begin as soon as Aug. 2.

7/29/19 Day 35: Closing arguments begin 7/29, which are expected to last all week. The judge in the trial of Ghost Ship warehouse fire has limited the jury instructions about the possibility that the fire at the warehouse in 2016 that killed 36 people was caused by someone else. Alameda County Superior Court Judge Trina Thompson said jury deliberations are expected to begin on Aug. 5. Prosecutors finish closing arguments.

7/31/19 Day 37: Jury instructions given. Jury to deliberations. began deliberating at 2 p.m. on Wednesday. Jury has 2 questions: one question was whether the words leaseholder, occupant, property manager and tenant were interchangeable. The parties in the case all agreed that the answer to that question is “no” and Thompson told that to jurors just before they adjourned for the day at 4 p.m. The other question was the legal definition of the term “authorized person.” Thompson told the nine-woman, three-man jury that she will give a precise answer to that question when they return to court on Thursday morning but said that in the meantime her legal instructions to the panel contain specific definitions to some terms that may be different than the everyday understanding of those terms.

8/7/19 Day 40/Day 4-Deliberations: Earlier in the day, the panel asked Judge Trina Thompson if they could have access to an iPad so they could review evidence in the case. Prosecutors indicated they didnt' have a "clean" device for the jury to use, so the jury might not get access until some time later. No verdict as of today. Deliberations continue on 8/8.
