The battle over guardianship of the Millete children continues in San Diego probate court between Larry's parents & Maya's sister. Both sides are arguing over visitation during the summer months. At a hearing Monday, the judge said a final decision on custody of the children likely will not be made until after Larry's murder trial is concluded. Larry Millete’s parents & May Millete’s sister are both seeking guardianship of the children.

CHULA VISTA, Calif. (FOX 5/KUSI) — The trial for the Chula Vista man accused of murdering his wife, May “Maya” Millete, could be delayed again after multiple months-long delays last year over issues funding his defense.

The judge presiding over the case, Enrique Camarena Jr., appeared to be annoyed by the hold up before setting a final hearing on April 2 to schedule when the trial will begin.

“We have to pick a date, soon. We put it out eight months at the last continuance and so we need to know,” Camarena said. “If we don’t get a date that we can realistically try this case, I’m just going to pick one and then we’ll go from there.”

While Thursday’s hearing was intended to provide an update on trial readiness, prosecutors also used the time to ask the court to reaffirm the protective order placed on Millete that prevents him from making any calls from jail to people other than his attorney.

However, deputy district attorney Christy Bowles said that between Feb. 2 and Feb. 27 Millete had made 11 video calls through the San Diego County Sheriff’s video visit system to people other than his attorneys — something she said was a clear violation of the court order.

Millete’s defense attorney Colby Ryan pushed back, saying the violations were “not necessarily Mr. Millete’s fault” and had more to do with the sheriff department’s recent switch to a new communication system.

“I don’t believe he had any intent to violate this court’s order, because he actually asked us and it was our understanding that this is how the jail is going to do it,” Ryan said. “Moving forward, we will make sure that Mr. Millete only does social visits and that the jail is made aware that he cannot do these video visits.”

The judge ultimately confirmed the restraining order blocking Millete from making jail calls applied to the video visits, although he disagreed with his defense attorney’s argument.

“The one that makes the decision on who gets the phone call and accepts the phone call is you,” Camarena said. He added that Millete’s multiple requests to modify the protective order to allow for more outside contact “did not help.”

“Maybe someone made a mistake, but it’s on you to make a decision whether or not to make that phone call or make that video visit and frankly I think the DA’s office could charge you, if they wanted to,” he continued. “We’re not there … but violating a restraining order is a violation of a court order, which is a new crime.”
 
Thank you @Seattle1 ! I do have a trial date for the murder on 8/26/24. With a readiness hearing on 4/2 & a motions hearing on 8/5/24.

Sorry - I tried accessing the link at the time it was posted - but had no access (denied) over here - so I probably skimmed your posts. I have changed my notes to reflect this! Thanks!
 
I'm surprised there has been no MSM update on the Conservatorship after the Court granted permission to cover the 3/11/24 hearing re. allotment of estate funds [to LM].

Back in August 2023, we learned the Court ordered the family residence sold on the open market (and the grandparents and children expected to move into a home next door). I don't think we have confirmation if/when any of the above occurred!

Relative to a Guardianship trial, perhaps this is the only Trial that will happen this year (previously scheduled for January 2024 but currently scheduled for 8/11/24).

After so many delays in the criminal case, we know the Court changed their position here and no longer wanted to delay Guardianship until LM's fate decided.

However, in 2024, the children will be ages 14, 13, and 7, and given the time that's passed here (grandparents custody since 2021), I don't see things going well for Maricris. (MD most recently requested a continuance for the 3/11 status conference).

And so we wait on all matters re. Millete....

SAN DIEGO — A trial date has been set for January in San Diego court to decide who will get custody of Maya Millete's three children, even as the murder trial for her husband, Larry Millete, is scheduled to begin later the same month.

Larry Millete’s parents, Benito and Judith Millete, are battling Maya’s sister, Maricris Drouaillet, for custody of the children, now ages 13, 12 and 6. The guardianship case was filed nearly two years ago.

That’s when Drouaillet’s attorney, Scott Finkbeiner, suggested there would be no conflict between the two trials because Martinez would soon be stepping down from the criminal case.

Martinez then stood up and told the judge if she was "relieved from the case" it would be for financial reasons because Larry can't afford to pay her.

Earlier this month, Judge Alvarez ordered the Millete family house in Chula Vista to be sold on the open market. Some of that money could end up going to Larry's defense attorney.

Martinez said the paternal grandparents and the three children intend to live in a next-door neighbor’s house after the house on Paseo Los Gatos is sold.

*Further Readiness Conference Hearing (@ 1:30pm PT) - CA - *May “Maya” Millete (39) (last seen @ home on Jan. 7, 2021, near San Miguel Ranch area, Chula Vista & reported missing Jan. 9, 2021 by her sister; not found). *Larry Ibarreta Millete (40/now 42) charged (10/18/21), arrested (10/19/21) & arraigned (10/21/21) & re-arraigned (1/25/23) with felony murder & felony possession of an assault weapon (a search warrant was served at the residence on 1/23/21. Detectives located a .223/5.56 rifle. The firearm is non-California complaint configuration & is an unlawful assault rifle in violation of 30605 PC, which is a felony). Plead not guilty. Held without bond. Denied bail (11/4/21). Found mentally competent to stand trial (9/26/22).
The case has been reassigned to the South Bay courthouse from Judge Dwayne Moring, the jurisdiction where the crime is alleged to have occurred & Judge Enrique Camarena will preside over the trial in Chula Vista. Defense attorneys Liann Sabatini & Colby Ryan.

1/8/24 Update: San Diego County Judge Enrique Camarena denied efforts from Larry Millete’s new defense counsel that would have allowed him to make calls to family members. In October, 2021, Judge Dwayne Moring issued a criminal protection order which only allowed Millete to communicate with his children thru letters that were first reviewed by a guardian ad litem, which is a court-appointed rep for the children. During the hearing defense attorney Liann Sabatini asked the Judge to modify the order, saying it was a violation of his 1st amendment rights, equal protection rights & 8th amendment rights. Judge Enrique Camarena sided with Dep. DA Christy Bowles, ruling that no changes be made to the protective order. Camarena also cited an example of Larry’s alleged violation of the order. In that instance, prosecutors say Larry used another inmate’s PIN to make hours of phone calls to his children. The judge says Larry’s calls were also inappropriate, saying that he made references to a disturbing film about prison life, which he instructed his children to watch. The main purpose of the hearing was to check in on Sabatini to see if she was still on track for a trial that’s currently scheduled for August. Sabatini replaced Larry’s other defense attorney, Bonita Martinez, last October. At that time, the trial was pushed back nearly a year to allow the new team to absorb details about the complex case. Sabatini told the judge that she’d received a hard drive from the DA’s office just before Christmas, but said she was awaiting even more evidence. Bowles told the judge that she was having difficulty getting the rest of the evidence from Martinez, but vowed to produce new copies for Sabatini. Before the hearing was adjourned, the judge set a near status hearing date for 2/29/24. Hearing was changed to Trial Readiness conference.

For much of the hearing, Millete sat emotionless next to his attorney as the prosecutor raised concerns about Larry participating in 11 video phone calls while in custody, which she said violates a protective order that includes phone calls only with his legal team & no contact with his kids. County Deputy DA Christy Bowles said, “Those video visits are in the 8pm hour, in the defendant’s former residence where the children live. They are essentially Facetime visits. The children can be hearing & listening to their father’s voice. There’s no way to monitor those calls.” Millete’s lawyer, Colby Ryan, said this was a result of the sheriff department’s brand new communication system in the jail. The Judge responded with this reminder to Larry: "Even if they put it in front of you ... say no. That's what the court ordered." Millete's trial could be delayed again after multiple months-long delays last year over issues funding his defense. The judge presiding over the case, Enrique Camarena Jr., appeared to be annoyed by the hold up before setting a final hearing on 4/2/24 to schedule when the trial will begin. “We have to pick a date, soon. Judge pushes Millete husband trial to 2025

In court on Tuesday, the accused killer appeared alongside his attorney Colby Ryan when Judge Enrique Camarena granted the defense's request to further delay the start of the trial, which had been set Aug. 5 but is now slated to begin on Jan. 6, 2025, almost four years to the day that she was last seen alive.

A motions hearing, which is expected to last up to four days, is on the court's calendar for Dec. 2, with a status conference scheduled for Aug. 5.

Thanks all for the articles! Actually I had 8/26 as his trial date & a motions hearing on 8/5.

I am sure I will get a notice from the San Diego court site that I signed up for & will post when I do.
