Judge Stays Lieutenant's Suit Alleging Bosses Ignored Malibu Shooting Warnings - MyNewsLA.com

A judge put on hold a sheriff’s lieutenant’s suit against Los Angeles County in which he alleges his supervisors retaliated against him for trying to inform the public about shootings in and around Malibu Creek State Park...

After Beaudette was killed, Royal was instructed by his supervisors to state at a town hall meeting that the official position of the sheriff’s department was that the prior shootings were unrelated to his death, the suit states.

In retaliation for speaking out, Royal was transferred from the Malibu/Lost Hills Sheriff’s Station to the Santa Clarita station, a less prestigious assignment, and stripped of his detective status, the suit states. He also was subjected to an Internal Affairs investigation under false circumstances, damaging his reputation, the suit alleges.

Thanks for the trial date @jash !
Nothing update in the court site yet this morning...

Had to look up 1368 PC:

This is called “declaring a doubt” as to defendant's mental competence under Penal Code § 1368. ... The judge must then suspend the criminal proceedings and order an expert's evaluation of defendant to determine if defendant is, in fact, mentally incompetent.

Accused Malibu Creek Park shooter could be deemed unfit for trial | Thousand Oaks Acorn

Dec. 17, 2020

Anthony Rauda, the man accused in the death of camper Tristan Beaudette at Malibu Creek State Park in 2018 as well as a string of other shootings and burglaries in the rural Santa Monica Mountains area, was deemed to be mentally unbalanced by local residents in the months after his arrest over two years ago.

Now the question of Rauda’s mental state is a matter for the courts. At an appearance earlier this fall, officials made a preliminary finding that Rauda’s mental competency is in doubt, in which case he would not be fit to stand trial.
[.....]
The matter will be settled at a Jan. 6 hearing when the court will receive the results of a medical analysis regarding Rauda’s ability to stand trial.

If he’s deemed mentally competent, Rauda will face a charge of murder, 10 counts of attempted murder and five counts of burglary. If he’s found guilty and receives the maximum sentence, he could be imprisoned for the rest of his life.

If the courts determine his mental health is impaired, the criminal charges will be suspended until he regains competency to stand trial, if that ever happens. In that case, Rauda will be kept under guard at a mental health facility.

The widow and two daughters of a man who was fatally shot while camping at Malibu Creek State Park in 2018 will have to shore up their negligence claims in their lawsuit alleging the state and Los Angeles County failed to warn the public about earlier shootings in the same general area, a judge ruled.

The judge gave Wu and her children 30 days to file an amended complaint to show why the negligence claims should remain in the suit.
