GUILTY Canada - Ibrahim Ali, accused of killing girl, 13, Burnaby, BC, 18 July 2017

  • #61
For Wednesday.

May 17, 2023
The trial of Ibrahim Ali, who is accused of murdering a 13-year-old girl found dead in a Burnaby park in 2017, will not conclude on June 30 as scheduled and could last until "much later" than September, according to B.C. Supreme Court Justice Lance Bernard.
[.....]
The jury in the case had originally been told the trial would run until June 30, but Justice Lance Bernard told jurors Wednesday it could now go past September.

Bernard said June 30 had been a "best estimate" and "a generous one" of when the trial would wrap up.
[.....]
Bernard asked jurors to go home and think about the new information and what it means to them, and notify him if it will create a significant problem for their ability to serve till the end of the trial.

He thanked the jurors for their dedication to the trial so far.

The findings of a forensic pathologist who concluded strangulation had led to the death of a 13-year-old girl found dead in a Burnaby park six year ago were challenged under cross examination Wednesday.

Dr. Jason Morin, a forensic pathologist who autopsied the girl’s body, has been on the witness stand at the trial of Ibrahim Ali in B.C. Supreme Court in Vancouver all week.
[.....]
The pathologist's cross examination is expected to last through most of Thursday.

do not know if this is a duplicate article - for Wednesday.

May 18, 2023
Defence lawyers at the murder trial of Ibrahim Ali questioned a doctor's findings that a 13-year-old girl found dead in a Burnaby Park nearly six years ago was strangled, scrutinizing language in his report while pointing to the absence of injuries on the teen's neck.

The victim's name is protected by a publication ban.

Under cross-examination, Dr. Jason Morin, a forensic pathologist, told the jury he was certain of his conclusion the girl had died of strangulation.
[.....]
In his autopsy report, the forensic pathologist concluded that the teen died "secondary to strangulation," meaning strangulation was the primary cause and other causes were secondary to that.

In support of his conclusion, he referenced the presence of facial petechial hemorrhages or minor, burst blood vessels beneath the victim's chin and eyes, consistent with strangulation injuries.

During the trial, he also referred to the findings of a neuropathologist who found the victim suffered fatal brain injuries likely caused by an interruption of blood and oxygen to the brain for up to 10 minutes.
[.....]
The trial, initially set to end before July, is now expected to last until the fall due to a series of delays.

Unfortunately the article doesn't mention if the Dr. will be back tomorrow...

May 18, 2023
A Burnaby murder trial was expected to continue Thursday with the cross-examination of the forensic pathologist who autopsied the 13-year-old victim, but her accused killer, Ibrahim Ali, was 'not well,' so the jury was sent home.

One day after a judge told the jury in the Ibrahim Ali murder trial that delays could extend the trial past September, jurors were sent home because Ali was “not well.”
[.....]
The jury was ready to hear the continuation of forensic pathologist Dr. Jason Morin’s cross examination Thursday, but they were sent home before that could go ahead.

“Once again I begin my remarks to you by apologizing for keeping you waiting,” B.C. Supreme Court Justice Lance Bernard said. “Mr. Ali is not well today. There was some expectation that he might feel better, which is why you/we waited, to see whether that would occur, but apparently it hasn’t. We can’t proceed in his absence.”
[.....]
The trial is expected to continue Friday.

WARNING: This story contains graphic content and may affect those who have experienced sexual violence or know someone affected by it.

The doctor who studied the body of a B.C. teen said she had injuries that could have been caused by being dragged before she was killed.

On Tuesday, forensic pathologist Dr. Jason Morin further detailed injuries found on the 13-year-old victim's body, including small scrapes on the back of her head that weren't likely to be caused by a blunt strike to the head.
[.....]
In his autopsy report, the forensic pathologist concluded that the teen died "secondary to strangulation," meaning strangulation was the primary cause and other causes were secondary to that.

He's since told the jury he's certain in his conclusion, noting that other injuries discovered were relatively minor.

His report references the presence of facial petechial hemorrhages or minor, burst blood vessels beneath the victim's chin and eyes, consistent with strangulation injuries.
[.....]
The Crown is expected to later call a witness who is an expert in sexual assault injury.
[.....]
One juror was excused from their trial duty after Justice Lance Bernard announced the previous end date was no longer feasible. The trial was scheduled to wrap up by June 30. But various delays have resulted in the date being extended, possibly into September.

He also addressed the jury on Tuesday, acknowledging that several of them had availability concerns over the summer and in the fall.

He suggested that, given the new length of the trial, that certain accommodations will be made for those who are unavailable and that all jury members would be excused over those dates.

"Everyone will get time off," he said.

WARNING: This story contains graphic details that may disturb readers. Discretion is advised.

A pathologist who performed an autopsy on the body of a young teen girl found dead in a Burnaby park defended his impartiality as an expert during cross-examination Wednesday in the murder trial of Ibrahim Ali.

Dr. Jason Morin’s assertion came after Ali’s defence lawyer suggested he was not an independent witness, has worked closely with police and he was being “directed by the Crown.”

Morin denied that suggestion, telling the B.C. Supreme Court jury that his involvement with the Crown relates solely to his job and that all compensation he receives is for his time.
[.....]
The defence has not yet told the jury its theory of events.
