FWIW, I don't believe one word from cops saying "accidental".
The French MSM newspaper "Le Canard Enchainé" published an article about cops used to lying to get away and be able to charge a citizen for a crime. Especially when said citizen is a young man of color from a poor suburb.

I refuse to shed a tear for charged cops, especially the one putting his expanding stick in the rectum.
The "exploding" is a mistranslation IMO. Because it's an expanding stick.

The IGPN, the police of polices, determined it was an accident from the video. IMO, hardly believable.
The cop was detained and interrogated within hours, he could not concoct the story.

What is clear is that Théo tried to intervene during a police control going badly.
Some people claimed that Theo was involved in drug trafficking, but there's no remote evidence to substantiate this allegation.
However, the far-right uses this "evidence" as a mean to justify police's violence against people of color.

At the moment, the cop is charged under rape. However, the prosecution is unsure about the charge's legal qualification between rape or act of torture.
In both rape and act of torture, the maximum sentence is 15 years. It is extended to 20 years if the act of torture is committed by a public officer, as a cop. The rape max sentence is 20 years when it is committed with a weapon and/or while abusing a professional authority (as the cop).
If the cop is sentenced beyond 10 years, he is not eligible for parole before 5 years. The sentence can increase (or reduce) the parole ineligibility period with motivation.
All this in the French Code Pénal.

The 27yo cop cried wolf in the French medias after being charged with rape, faking remorse. He can pretend being the victim, he doesn't deserve anything but scorn and contempt. His crocodile tears won't change neither his act, nor his dangerous criminal wicked character without the slightest possibility of rehabilitation.
I have zero sympathy for that monster under the police uniform. That monster deserves nothing but insalubrious jail 24/7, unsanitary food and water and cheap most basic medical care in situ only (excluding hospital transportation, expensive medicines, life-sustaining treatment and even minor surgery).
Heartless ? Unapologistically yes.
As heartless as that monster was with Theo.
