Should a person in this situation be convicted of neglect just for not having physical control of their child at all times?
For example, if the child was standing right next to her and she was holding his hand, then her phone rings so for literally one second she lets go of her childs hand and he bolts and ends up getting through the fence - is that neglect?

Letting go of child's hand for one second is not what happened in Cinn, OH. zoo situation. This Mom did not have child's hand (for how long? ten secs? ten mins? IDK) and nobody else had his hand, or used other restrictive device.

More than one witness stated the boy said multiple times he wanted to go in the water/to see gorilla up close (paraphrasing, no link, sorry) and he made it thru the fence (admittedly not much of a barrier) and thru the 3-4? feet of dense shrubs, then jumped into moat.

In a busy, crowded public place jam-packed w unknown ppl, was Mom oblivious to harm that could visit her 3 y/o in mere seconds, that is harm from injuries to himself from lack of self-awareness as well as other possibilities like kidnapping, abduction, etc.
