CO - *Adre “Psycho” Jordan Baroz (26/now 27) was arrested & charged (2019) possession of controlled substance, 3rd degree assault, destroying evidence.
Colorado DOC records show Baroz was in prison from March 2016 until November 2018. He was on parole until June 23, 2019. Baroz was scheduled to appear in court Wednesday (11/18/20) on drug & weapons charges (#C22020M41), but he didn't show up, according to Alamosa County District Attorney Bob Willett.

It's been about 6 months since the defendant changed his plea so the FEDERAL sentencing hearing is right on schedule.

It's also possible they will only hear from witnesses on Friday, and where the Judge has not calculated the terms yet for 8 serious charges quoted below. Unless he's actually transported to federal court on 5/20, this may still not be over.

From Govt's response to the defendant's motion for a non-guideline sentence [65], the Govt responded as follows:

A district court “shall impose a sentence sufficient, but not greater than necessary, to comply with the purposes” of sentencing. 18 U.S.C. § 3553(a). The statute therefore “requires district courts to consider seven factors in sentencing: (1) the nature and circumstances of the offense and the history and characteristics of the defendant; (2) the need for a sentence to reflect the basic aims of sentencing, namely (a) just punishment (retribution), (b) deterrence, (c) incapacitation, and (d) rehabilitation, (3) the kinds of sentences available; (4) the Sentencing Commission Guidelines; (5) Sentencing Commission policy statements; (6) the need to avoid unwarranted sentencing disparities; and (7) the need for restitution.” United States v. Cookson, 922 F.3d 1079, 1092 (10th Cir. 2019) (internal quotation marks omitted).

A fulsome consideration of these factors favors the government’s recommendation of a guidelines sentence of 193 months imprisonment, not Ramirez’s recommendation of a non-guideline sentence.


Defendant's argument for a lesser sentence included the quality of the meth he was selling:

Ramirez argues that the methamphetamine purity guidelines create a “disparity without basis” and results in sentencing involving methamphetamine being much higher than sentences for some other controlled substances. [CM/ECF Doc. 65, 2].

First, the Court must impose a sentence of no less than 60 months imprisonment consecutive to 120 months imprisonment. In other words, the lower bound of Ramirez’s sentence is 180 months, which is one month below where the appropriately calculated guidelines range begins at 181 months. Therefore, this argument has little impact on the range in which the Court would otherwise be sentencing.


In recommending the court impose a longer sentence than the defendant requested in the paragraph above in his motion (i.e., CONCLUSION: the Court impose a guidelines sentence of 193 months of imprisonment, to be followed by five years of supervised release), the Govt provided the defendant's willingness to violate the law only 10 months after his release from prison:

B. The History and Characteristics of the Defendant

This case represents Ramirez’s second federal felony drug conviction, the first being 1:14-cr-00230-WJM. Ramirez was released from custody and supervision in that case on February 4, 2020. [CM/ECF Doc. 67, ¶ 43]. Within the same year, Ramirez committed the instant offense.

Despite numerous opportunities on supervised release, his release was ultimately revoked with 10 months imprisonment. Id. The most concerning of his release violations were noted in the March 26, 2019 Petition for Warrant on Person Under Supervision: (1) possession of ammunition and a firearm magazine, and (2) deception – leaving his residence under the false pretense of going to the hospital. Id.

Ramirez possessed a firearm as a prohibited person and was willing to deceive those trying to supervise his release. He simply has no respect for the law or the orders of the Court. As noted by his counselor, Ramirez’s biggest obstacle is himself and he needs to change his thoughts, attitudes, and beliefs. Id. at ¶ 85. Because Ramirez has demonstrated that he will not follow the orders of the court or comply with the law, his very serious drug addiction, ongoing gang affiliation, and tendency to revert to high-stakes drug dealing with a firearm, Ramirez presents an ongoing danger to the community and his sentence must reflect that reality.


Take note the Govt's recommendation for sentencing does not reflect any of the defendant's allegations/charges still pending in state court.

@Seattle1 - you sure find all kinds of stuff on him! And yes, he doesn't seem to comply with the courts - on his 1st violation... and the 190 months - or 15 years sounds good to me. Plus his State charges. I believe he will be in jail/prison for quite awhile.

I think he'll likely be sentenced to the Govt's recommendation of 193 months which is just over 16 years. He's going to rot with his ride or die buddy Psycho for sure. And I'm so disgusted that these gang dudes are being constantly rotated from jail to jail because they obviously have ties on the inside. JMO
 
Friday, May 20th:
*Sentencing Hearing (Federal) (@ 11am MT) - CO - *Francisco “Pancho” Ramirez (38/now 39) arrested & charged (12/16/20) & indicted (2/3/21) with 2 counts of possession of a firearm & ammunition by a prohibited person, 2 count of possession with intent to distribute methamphetamine, 2 counts of possession with intent to distribute heroin & 2 counts of possession of a firearm in furtherance of a drug trafficking crime. (Federal charges). Plead not guilty. Held without bond.
Trial was set to begin on 1/24/22 was vacated Ramirez will plead guilty on 1/27/22.

1/5/22: #60 Order: by Chief Judge Philip A. Brimmer on 1/5/22 as to Ramirez. The Change of Plea hearing set for 1/27/22 at 9:00am before Chief Judge Philip A. Brimmer will be conducted via video teleconference with defendant from jail facility: Clear Creek. 1/27/22 Update: Plead guilty to charges. The judge will order the pre-sentencing investigation report & there will be investigators collecting information for the judge for him to consider & assist with crafting the penalty he will impose.
1/27/22 Update: Sentencing on 5/20/22.

As expected, Psycho was not held in Alamosa Jail after his hearing -- they transported him back to Pueblo ASAP!
 
IMO many times nicknames can be the opposite of the person for example Tiny for a 6 foot 9" dude. However, how this fellow got to be "Psycho" seems a bit close to home. Hopefully, the non blending tattoos will help in arresting him. Looking at the pictures of the area, I would be nervous in the daylight with a gun and two trained guard dog Pitbulls. Hope more info comes out.

Held Alamosa County Jail on $250K bond.
Julius Baroz is the brother of Adre Baroz, who was arrested in November.
Trial set to begin (for tampering) on 7/5/22. (& 7/6).

@Niner -- it looks like the Court shaved off 12 months from the 193 months recommended by the prosecutor, resulting in a sentence of 181 months, and 5 years of supervised release.

Nonetheless, probably fair to consider Poncho as a lifer since this federal sentence is to run consecutive to any sentence that may be imposed in Alamosa County District Court, Case No. 2021CR49.
