CO - Adre ‘Psycho’ Baroz, 26, Wanted After Remains Of 3 Victims Found, Conejos Co, Nov 2020 *Arrest*

Jan. 28, 2023
ALAMOSA — After receiving the results of the court-ordered psychological evaluation of Adre Baroz conducted by the Colorado Mental Health Institute in Pueblo (CMHIP), defense attorney David Lipka has filed a motion to allow the defense to hire their own expert to conduct a separate, second psychological evaluation.
[.....]
On April 29, 2022, Baroz entered a plea of not guilty by reason of insanity, prompting District Judge Michael Gonzales to order a psychological evaluation be conducted by the Colorado Mental Health Institute in Pueblo (CMHIP).

After a delay, the report from CMHIP was submitted to the court. Issues related to confidentiality require the results to be sealed and unavailable to the public.

Lipka, who told the judge his team has already taken initial steps to hire the expert, informed the court that they expect the process to take four months.

Co-defendants in the case, Julius Baroz — Adre’s brother — and Franciso Ramirez, also appeared virtually from the facilities where they are being held. But due to a miscommunication, Adre Baroz did not appear online from the Arapaho County Jail where he is jailed.

Gonzales delayed the hearing but, upon learning that the Arapaho jail said they need a week’s notice to make an inmate available online, proceeded.

The next status conference in the case is scheduled for March 30 at 1:15 p.m.

Next hearing Adre is on 2/2/23 & the 3/30/23 one.

Thank you @Niner for this most informative update. :)

I'm having serious brain fade as I missed or don't recall the NGRI plea?? I recall reporting AB had been rotated out of county and being held in Pueblo but not that he'd been ordered to CMHIP for evaluation. Knowing AB is now up north, I'll do a check on where the co-defendants are currently housed.

ETA: No locations today... too much chatter?? Even while alleging insanity, AB still wields power. o_O

Affidavits say Adre Baroz sent a man identified as Dustin McDermott, 24, to get rid of Martinez's car after his murder & take his girlfriend, Hammel, to Lasauses. It's believed Hammel & Adre Baroz had a sexual relationship for two days. The SOI told investigators Adre Baroz said he was going to kill Hammel.

9/29/22 Update: Next status conference hearing on 12/15/22. 12/15/22 Update: Plead guilty to charges. 12/19/22 Update: A plea resolution was agreed to by special prosecutors for the state & defense counsel in the case of CJ Dominguez. Dominguez was charged with tampering with deceased human remains, a class three felony, accessory to murder in the first degree, a class four felony & second-degree kidnapping, also a class four felony. As was presented by counsel for the defense, Dominguez plead guilty to the charge of tampering with deceased human remains. As part of the resolution agreement, the remaining two charges will be dismissed. Also included in the resolution agreement, seven other cases pending against Dominguez will be dismissed. Six of those seven cases were filed in Alamosa with the seventh filed in Conejos County. Allegations in those dismissed pending cases include traffic violations, violation of bail bond conditions, the violation of a protection order & the burglary of a dwelling. By pleading guilty to the charge of tampering with deceased human remains, Dominguez will not be a co-defendant in the case that has been filed against Adre Baroz, Julius Baroz & Francisco Ramirez, generally referred to as “Los Sauces murders.” As Judge Gonzales then explained, a class three felony will subject Dominguez to a sentence ranging from 4-12 years in the Dept. of Corrections or placement in Community Corrections (instead of DOC) for the same period. Sentencing guidelines also allow Dominguez to be placed on probation with various terms & conditions, including 90 days in county jail, restitution to victims or a fine. The court is also free to determine if any other conditions will apply to probation, such as treatment for alcohol or drugs or any other conditions the court deems. There are no sentencing stipulations in the resolution, which leaves Dominguez’s sentencing up to the sole discretion of the court. A sentencing hearing is set on 2/28/23 @ 1:30pm.

Crazy how long this is being drawn out

The baroz brothers and Ramirez are never seeing the outside again and really need the death penalty after about 30 years of sitting around in there cell

@Seattle1 - I can not find anything on Dominguez' sentencing yesterday. Do you know how to find it in the Colorado court system? This was in Alamosa County.

TIA if you can! :)
I'll keep looking -- so far, all I come up with is CJD's voter registration. :)

No longer tied to co-defendants in the Los Sauces case

ALAMOSA — CJ Dominguez was sentenced in court this week to serve 12 years in the Department of Corrections (DOC) after pleading guilty to the charge of tampering with deceased human remains in connection to the dismemberment of the body of Myron Robert Martinez, 37, of Del Norte.

[..]

Dominguez was originally charged with tampering with deceased human remains, second degree kidnapping and accessory to murder in the first degree. The kidnapping and accessory charges, both class four felonies, were dismissed as part of the resolution of the case. The remaining charge of tampering with a deceased body to which Dominguez pled guilty is a class three felony, making it the most serious charge of all that were filed.

During the hearing, presiding Chief District Judge Michael Gonzales stated that the Pre-Sentencing Investigation had been completed. Mr. Dominguez had been evaluated for placement in Community Corrections — a program located in Alamosa that oversees offenders outside of jail or prison — but Dominguez was not accepted, removing that as an option in sentencing.

During the hearing, victims impacted by the crime were allowed to address the court in addition to five “victim letters” the court had received that were entered into evidence. Counsel for the defense also showed a videotape for the judge to consider in sentencing.

The sentencing range for a class 3 felony is four to 12 years in DOC with a mandatory 36-month period of parole. Defense counsel argued for Dominguez to be sentenced to eight years; prosecution argued that 12 years in DOC was more appropriate and fitting of the crime.

[..]

At the end of the hearing, Dominguez was remanded to Alamosa County Jail until such time as he can be transported to the Department of Corrections.

The next time co-defendants Adre Baroz, Julius Baroz and Francisco Ramirez are scheduled to be in court is March 30 for a status hearing.

Have there been any more updates on AB's insanity evaluation?

Last I read around the end of December-- the defense requested additional time to decide whether or not they were going to challenge the results of the evaluation at CMHP, and also if they were going to hire their own doctor for another evaluation.

I thought evaluating L Stauch was a challenge -- I can't imagine being tasked with evaluating this beast. Reading between the lines, it looks like CMHP found him sane.

I do believe they found him sane. Do not know whether his "plead not guilty by reason on insanity" has been changed to just not guilty.

And now that I can not access Colorado court site anymore -

Well - somehow I got in the court site!
