I dont think he could win on Ineffective Counsel...I have researched it for other cases...apparently, if counsel files motions and makes objections, cross examines, and is very engaged, then you cannot win on that...

Only if counsel didn't do bare minimum and didnt cross exam, didn't put up a case, didnt file motions, etc, can you win on that appeal

But Moran does all these things, just not very well

Attorney for Mark Redwine arrested, charged with domestic abuse | wkyc.com

"According to an arrest affidavit, Moran's ex-girlfriend told police she had gone to his home earlier that evening and he had assaulted her."

"The woman said she was sitting in a chair on Moran's back porch when the pair began arguing. At some point, the affidavit says Moran pushed her chair, knocking both it and the woman off the porch and onto the ground."

Hi all, Dylan was one of the first to originally bring me to WS years ago and now the trial has prompted me to log in once again after years away.

I marvel daily at (what I perceive to be) how feeble the defense presentation is. I have tried to sort out if it is strictly the weakness of the case or the defense's approach/ability. A bit of both. Hopefully that perception is not clouded by the years of awareness and biases that I've brought to watching, and hopefully the jury is also as underwhelmed and unconvinced as I am so that legal justice can finally happen, much overdue.

Conversely on the state's side, I am impressed by the thoroughness of their knowledge on all of the elements of the case (as it should be), how nimble they have been in dealing with anything thrown at them, and particularly Prosecutor Johnson's handling of all witnesses.

And gotta say, the Judge is a warrior with the patience of a saint.

Listing quantity of DNA material in each batch....yawn....does the jury have any freakin idea what they are speaking about?
autosomal anagrams per batch=3.841682

She is literally reading off this massive list of anagrams per batch of DNA sample for the jury===what is the point?

miller lite beer can analysis--the defense team requested it to be processed

Witness did DNA on Miller Lite can at request of Defense

Mr Bogan is now doing direct with this witness. 'Safe to say' I fear Mr Moran was somehow deflated, and is needing a break.

Beer can evidence......incoming

Well if you can’t dazzle them with brilliance…..

…and the beer can is back

Defense asked them to do dna analysis on beer can

This technical direct will be painful I’m afraid

oh jeeeze, now he wants to do an explanation of DNA analysis for the jury---why bother?

Just tell us what you found and what it means

@LotusPawprint, welcome back! Glad you have joined us here!

Thank you kindly, I thought it would be better to engage with other people as opposed to muttering (shouting) at the video feed (apparently they can't hear me!).

Spoiler alert: the beer can has DNA profile consistent with a snaggletoothed coyote / bear hybrid who we, the defense, now call to the stand, and who will confess to committing this crime.

Anyone else having a hard time paying attention to the witnesses today when questioned by the defense? For almost every witness he’s called, I’m not sure where he’s going with things at least 50% of the time - his questioning has no linear flow and too many pauses. That undermines his credibility in my opinion. In addition, none of the witnesses so far have given any compelling evidence to support the defense’s case, so I feel like each witness that comes up will not add any value and I start to zone out.

I have enjoyed watching the crosses though ;)
