1:02:13 January 26 2020 the defendant had a video recording of her and Gannon
talking about the fire you recall seeing that no I think that would be important to look
at what she's saying the night before the murder I would I would have to see it sir I can't I I need to look at it
and then I'll say yes I think it is important or whatever but I I don't recall it not a problem
um oh we don't have one we can't play it
did you not remember looking at that as part of your evaluation I I'm sorry I do not recall exactly that also some of my
some of what I saw was unclear and the sun was not good so that I can't be
certain of that well let me describe it to you and see what your thoughts are okay
so she's first of all video recording a conversation she's having with her stepson who's 11 years old
saying things like it's okay we can sell the pouch not a problem we can sell the
couch and fix it again it says I'm just worried about my
Burns and he's crying then she says it's okay tomorrow and
then she shuts the video off okay remember seeing anything like that I’m
sorry I don't recall it but again uh much of what I saw was not clear the
sound was not good and I am not aware of having seen that exactly I am aware of
having read that uh that Ganon that she
said he had little bubbles on his arm that uh so that that's the part of what
of that I'm assuming it's the same issue that's that is the part that stayed with
me what about the part of her having the ability to stop the video after Gannon says I had Birds
I'm not sure what that would mean what uh what would what would you have me agree to I think that would be evidence
that she didn't want anyone to know that Gannon had bursts
uh I can't say I'm not aware of that because she did say that he had little
bubbles on his arm if she didn't want anyone to know that I don't know why she would have said that okay
4 36 in the morning on the morning of January 27 2020 she sends a text to her
employer saying I can't come in my stepfather was just killed in an auto accident
um you remember that you talked about it yeah a little bit pretty significant to you and your opinions
yes we'll get there in a second do you remember the rest of the texture
the rest of the text if you remind me I can tell you if I remember it what I
don't know what you're referring to paraphrase yeah so the boss returned was you know later in the morning but she’s
not up at 4 30. she says just let us know what we can do for you let me know
when you can come in words for that effect yeah and then the defendant text back and says I can't believe you can be
so inconsiderate I had a family member just die of your gymnast eating the text I’m
paraphrased you ever seen anything like that I I
remember reading about what to me seemed
lacky if you want you can call it psychotic but uh that made no sense this
1:05:51 man was dead I think for eight years and to call in and say she clearly was not

1:09:37 and then the morning of the 27th at approximately 8 14 a.m and then again at 8 16 a.m she takes pictures of Gannon in
bed and sends them to her husband I'll stop do you remember seeing that I don't recall seeing no
not unusual behavior I think you're funny is that unusual behavior taking a picture of a child sleeping in
his bed uh it's Behavior I don't know what kind
of baby do you think she might have been taking pictures to show that Gannon was still
alive that morning she might have been
and then you talk about it with her in the interview and you know from reading the
police reports that they her and Gannon leave the house about 10 20 in the morning
they go to Petco remember that part yeah in parts and they take Al Stout’s
red Nissan truck remember that I don't recall it was a red Nissan truck but I I
recall it was a truck that uh actually I thought it was her truck could have been his
and you can actually see Gannon walking to the back left passenger side rear
rear left door of the truck and get in remember seeing that video I I don’t
recall seeing it but uh you know I may have read other people saw it I uh I just don't have a clear
memory of that particular film now in the video you can see the
clothing that Dan is wearing see uh sweats with a white stripe going down
you remember seeing that as I told you I I don't remember seeing that particular
thing but again the equipment I had was not clear and uh
there was no one there with me to say this is what we're seeing now so that uh
but I I don't question this that there was that that there's uh it's peculiar
that here he is walking around and if I understand correctly she had already
called the school and said that he could not come in and said yeah yeah absolutely he's home sick she's home
because she's telling people that her stepfather died and they decide to go shopping
playing hooky oh uh was that uh buying cat toys was I
forget something like that needless to say ganon's wearing the same clothes that he was found in under a
bridge on March 17th hey leave that morning

now at the time that she drives that truck around and goes to Petco does she have the capacity to know right
from wrong I don't know either that's that's a leap where you know if
you can't talk to the person and you don't see more I I don't know you talk to her did you ask her that
I don't recall asking specifically did you know right from wrong at the at this point I I don't know and I don't know
the answer to that would it be a stretch to say she did know right from wrong the fact that she was able to go to Petco
run errands and come back later that afternoon with no tickets no accidents
that she knew right from wrong then sure I don't know I would think having called
into school and having said uh that this child can't come in and then taking him
on a on a field trip to betco
that she really did not have a good idea of what she was doing or why she was
doing it of and I I'm not sure that the idea of
right from wrong is applicable to this just particular episode it's wacky but
it's she's legally insane at the time she's driving to Petco again I don't know I think you would have to
you know I would have to know a whole lot more if you don't know a lot more can you
come in here and say that she was legally insane based on her driving to Petco again

1:16:19 there was at least 18 cut wounds and stab wounds right and a
lot of those were defensive rooms on Gannon some you know some on his hands he was
fighting back right as far as we know yes
is there an indication that whoever did that had the capacity to form the intent to
kill
I I don't know I would think so I would think so just based on the sad ones alone right
well it certainly had that quality of you know as I thought about it
whether there was an automatic quality to it which is partly why I wanted certain neurologic
tests done because there was a repetition as I recall and but there was
there were signs on his hands of cut of cut Mars fighting back right
looks that way to me and the location the stab wounds
read a chest one in the head rolling the back and arms that we
already kind of talking about does that indicate to you that whoever did this had the capacity to form the
intent to kill that that's a stretch for me because uh
when individuals keep doing this kind of act over and
over and over again uh it it can be an attempt to kill but uh
it can also be a repetitious kind of automatic act and uh
not having been there and uh I I don't know what what the state of
mind was whether there was a kind of an automatic going about this or whether there was a
real Javan killed him now I'd like to kill him but I don't know let me have you take off your psychiatrist's hat for just a
second and just use Good Old Common Sense based on the stab wounds alone
whoever commit this crime had the capacity to form the intent to fill I I cannot answer that for this the
reason that I've just told you that I don't know whether the person was automatically doing something which with
certain types of complex partial seizures uh occur where
a person just keeps they may do something not at all violent they may button and unbutton their coat they may
turn a light on and off and just keep doing it and they may just keep doing that or they may say not dead yet I want
to kill them so that I don't know for sure what was going on in the uh head of
of the person doing this okay well let's say there are two possibilities there are at least two possibilities let’s
move on from the staff yeah the fact that there was blunt force trauma I.E some sort of object was used
as four head injuries one of which crushing Ganon skull causing skull
fractures right the fact that another instrument was retrieved and used
lead to the opinion that whoever did this had the capacity to form judgment and reflection
and also had the capacity to form the intent to kill I I think you could interpret it that
way or you could say the person felt threatened felt endangered by the way I
did not understand where that came from or how with all of those stab wounds
where this item came from perhaps I missed something in the report but uh
well let me stop you right there because in your report you said you thought it may have been a baseball I've been writing that airport
I I'm sorry I don't recall that uh but uh you know it could have been uh a fear
that the person himself or herself was being threatened and that uh the wish
was to get rid of this threatening murderous object I don't know what was
going through her head
what about the blunt force injuries to her ganon's head the four themselves I
don't I'm sorry I don't have a good understanding of the object or of that
particular aspect of the injury so I've why does the object matter
I don't know I would have to know the point is they decided to move from a
knife and go to another object continue on with the killing correct
I'm not correct I don't know what came first or what came second and I'm not
sure how how when you're stabbing someone you get around to hit them on the back of the
head uh it's uh it puzzled me and uh and I I still don't know what
what was going on at the time or in the person said for all you know the person could have
felt threatened and felt that something was uh of danger to her I don't know what
was going through her head at the time well there's an 11 year old boy who has 18 stab women's lying in his bed right
and then she takes an object and crushes his skull that indicate that he's fighting back at
that point I'm sorry I don't know enough about these if you look at the currency
pictures I looked at the I looked particularly at the autopsy I remember I'm not I'm not
as clear of of the fun scene pictures except for the spatters of blood and and
this sort of thing but uh I don't know what was going through
her mind when this was happening was she defending herself was she attempting to
kill him the puzzle is all other data say that she loved him and that he
apparently he loved her I loved him quite a bit the next thing she does is she gets
another object done the fact that she gets a gun does that
tell you she has the capacity to use it and reflection it's the capacity to form the intent to
kill I don't know sir I when I spoke with her she her memory was I could see a gun in
my hand and I I do not know what was going through her head or why there was
a gun or why she shot uh why she shot this uh it would be a
leap for me to to speculate on this uh I it is not clear that that she
simply wanted to kill this this is a child she loved as if we believe what
other people said she loved Ganon so that uh
it's and so I just want to make sure I'm understanding that you wish to kill him I don't know that it was even he that
she wished to kill clearly she did kill him but we don’t
know whether uh at the time she saw Gannon and she was trying to kill again
we don't know so her actions mean nothing to you her actions mean nothing to me no uh
well everything's a leap to you I I just want to know what that means to you the fact that she used three separate
instruments to kill Gannon did she have the ability to make decisions when she did that
and I'm what I'm saying is I can't be certain what was going on in her head
because I I pondered it and I thought what on Earth how did she get this whatever the blunt
instrument was uh when did it happen and then when I think more than one person
said that she loved this child so that uh it certainly made me wonder whether
she was misperceiving something there and uh well then let's let's go forward then because what does she do after she
does all that she drags his body to the storage room and stuffs it in a large green suitcase
he had the capacity to know right from wrong when she did that uh
it would certainly seem she knew that this was something that uh should not
have happened and does that cooperate the actual killing that she had the capacity to farm to kill the capacity to
use judgment and reflection the fact that she immediately stuffs his body in a suitcase
I again I don't know for sure what about cleaning up the crime scene
after he said she stuffs his body in a suitcase she goes back to the room and cleans all the blood off the wall
not all of it that had the she had the capacity note right for wrong when she's clean and
bedroom she certainly uh believes that other
people will believe that she had done something horrendous or something terrible had happened uh that's I guess
as far as I can go right right now now she then goes back to the storage room
and throws a bunch of boxes on the green suitcase in the storage room we’re
seeing pictures of that again I've seen a lot so that uh
I don't recall those particular pictures and then the police come about 1009 that
1:26:31 evening January 27th and they searched the entire house
and her demeanor calm cool and Collective
and went to some friends to ask them
makes those statements with her demeanor like that is that evidence that she had the capacity to know right from law
I don't think that I don't think that's evidence that she knew right from wrong uh we don't even
know whether she knew what she had done we uh I I again I don't think that that’s
evidence she knew right from wrong what about is it evidence of psychosis
it certainly sounds out of touch with reality
when someone's in a psychotic State it's pretty obvious right you know looking around wrong no no
sorry that's television so someone in a psychotic State can act
normal and have a normal conversation with a police officer when their stepson is in the storage room underneath a
bunch of boxes in a suitcase particularly if the person does not know that she has done that or that this is
what what the status is that you know we don't we don't know what but there’s
something really odd about being in that a very calm sort of State here she is
reportedly murdered a child she loved this makes no
say this this is psychotic uh did she killed that boy did she think
1:28:23 she'd killed him uh was it that boy did she remember what had happened uh well let's talk

1:28:31about the next day then if she remembered because the next day at 6 20 in the morning
she drives her Tiguan out of the garage and is gone for 10 minutes and it comes back remember that

Week 5 Day 20

NOW: I’m in #ColoradoSprings for what’s expected to be the final day of trial for the woman accused of killing her 11-year-old stepson, #GannonStauch. We just walked inside the courtroom. #LeteciaStauch is wearing a blue jacket today.

Judge Gregory Werner just walked in, right after defense attorneys Josh Tolini and Will Cook. The entire @4thJudicialDA team is here too. The jury is not in the courtroom. The judge says we need to discuss jury instruction after an email he got this morning.

"Because this is a request for an instruction on evidence that wasn't actually presented," the judge doesn't think he can give one. "I know what the issue is," he says. "I can't make a stipulation, and can't tell the jury what evidence hasn't been presented.”

It sounds as though that was in relation to a request from the defense, but I could not hear what Tolini was saying to the judge. Now, clarifying verdict forms with the Lead Prosecutor and District Attorney, Michael Allen.

Going through today, I feel it's important to remember: #GannonStauch was an 11-year-old boy who lived in Lorson Ranch (southern El Paso County). He loved his little sister, was a fan of Sonic the Hedgehog, and his favorite color was blue.

The judge says the plan, after finishing jury instructions, is to bring jurors in around 9 AM. Prosecutors and defense anticipate their closing arguments lasting an hour each. Those should start around 10. A lunch break will likely happen after closings, then rebuttal.

Sounds like there will be NO rebuttal after closings. #LeteciaStauch, who I am sitting behind, is looking closely at documents on a computer screen. Court is in recess until around 9.

A clarification on this - NO rebuttal evidence is what I should have said. DA Michael Allen says they will have a rebuttal. My apologies.

Judge Werner is back in the courtroom. Jury is in the room too. It's a packed house today - with lots of members of the public in here. The defense rests their case. We move on to jury instructions, then closing arguments.

While jurors are being read the detailed instructions - Lorson Ranch neighbors show their support for #GannonStauch. I remember when this corner of grass was flooded with blue lights and such - in the days & weeks following his disappearance on Jan. 27, 2020.

The judge referenced the instruction added this morning. It's about a WebEx meeting an attorney had with #LeteciaStauch at the start of the pandemic, while she was in jail - later that day, she had a conversation with Dr. Mohr about #GannonStauch's body being found in Florida.

Court is in recess for around 15 minutes. Jury has been read all their instructions. Closing arguments are next.


Jury is in the courtroom. We're starting with Prosecutor Dave Young for closing arguments. "It's been a long trial, you guys have sat through a lot of evidence," he begins. "We spend a lot of time talking about the defendant."

Young wants to talk about #GannonStauch. "Gannon's been in a box, back here, the whole trial," he says gesturing toward the front of the courtroom. He shows the jury a framed picture of Gannon. Gannon's father, Al, is tearing up.

What Gannon had to tell the jurors through his autopsy is all they need to know, according to Young. On March 17, 2020, Gannon's body was found inside of a suitcase under a bridge in the panhandle of Florida.

oung uses a diagram to go over the injuries #GannonStauch sustained, because "the injuries are relevant." He claims they're also relevant to #LeteciaStauch's state of mind. The first diagram depicts the stab wounds (18) and gunshot wound to his left chin area.

"Gannon was defending himself, he was fighting... despite having hydrocodone in his system," says Young. "18 times, 18 times, she took a knife and stabbed him. The locations, what does that tell you?... It's not psychotic, it's strategic."

"The stab wounds are to the chest, as Gannon's fighting the stab wounds are to his back," Young continued. The diagram "doesn't do justice" to the skull fracture Gannon sustained. "She (#LeteciaStauch) completely obliterated his skull.”

She goes and gets a handgun, and she fired that gun three times," says Young. Two bullets went into his pillow - this all happened in his bed. "The only bullet that matters" is the one that hit #GannonStauch.

Now, talking about "getting rid of Gannon's body in Florida." Young says we know that sometime between 4 and 5 in the morning, #LeteciaStauch was out on the bridge in Florida. "Why does she park there? Because she can. 4 in the morning - there's no traffic out there.”

"She probably had to wait until there was no traffic, and she gets rid of the body. Did she ever think the body would be found again?" We're looking at a picture showing the suitcase found under the bridge - the suitcase #GannonStauch's body was inside.

"Let's talk about the law," Young says, transitioning from the bridge to a slide showing elements that constitute first-degree murder. After deliberation and with intent are highlighted because those are the mental states in question with the NGRI plea.

"To go from grabbing a knife, a blunt-force object, a gun... is she making a decision?" asks Young. "Did she intend to kill Gannon?... I would suggest that that's not disputed.”

Young says it can't be disputed that #GannonStauch was in a position of trust - since #LeteciaStauch was his stepmother. We're now moving to insanity - and the legal definition. "This is not a mental illness, this is a legal definition," Young says.

"The law presumes everyone to be sane. There's a presumption of sanity," Young says. The defendant was insane if they were incapable of distinguishing right and wrong, or they suffered from a condition of mind caused by a mental disease or defect.

"If you lose your temper, you don't get to claim insanity," Young says. "We're humans. We have emotions." Mental disease or defect means "severely abnormal mental conditions that grossly and demonstrably impair a person's perception or understanding of reality..." (cont.).

"... and that are not attributable to the voluntary ingestion of alcohol or any other psychoactive substance. Mental disease or defect does not include an abnormality manifested only by repeated criminal or otherwise antisocial conduct." ^This is all the legal definition.

Now, talking about the doctors who testified. Young begins by referencing Dr. Ronda Niederhauser, who treated #LeteciaStauchfor general anxiety. "That's not a severe and abnormal mental condition," says Young, pointing at the legal definition being shown to the jury.

Dr. Niederhauser also said #LeteciaStauch had no history of inpatient treatment and no evidence of psychosis. Young says if she was experiencing psychosis, the doctor would have been required to commit her to a mental health hospital. The timing of that visit - December 2019.

"What else happened right before Gannon was murdered? She goes on a cruise in January. You think that had something to do with her not wanting to go to work?" Now - on to Dr. Christine Mohr - who does psychological evaluations for inmates in jail.

Young says that in March 2020, Dr. Mohr went to #LeteciaStauch and said "Gannon's body was found." Apparently, Letecia's response was "I was never in Florida." June 2020 in the jail - Dr. Mohr reviews Stauch's notes from deputies that say "I'm going to start acting crazy.”

First competency evaluation was done at the state mental health hospital in #Pueblo. What's relevant about that first evaluation (July 2020) - they have a two-week observation period where nurses and employees are watching #LeteciaStauch. (cont.

Apparently, #LeteciaStauch goes to one of the nurses and asks if they can tell when someone is "faking it." No evidence of psychosis during the August 2020 evaluation, or history of inpatient treatment.

Young asks again - "do you think she might be faking it?" Second competency evaluation - December 2020. Now, #LeteciaStauchstarts talking about dissociative personality disorder, saying she has four distinct personalities. (cont.).

During the evaluation, Young says Letecia cited characters from the Twilight movies as her other personalities. Feb. 2022 - counsel had a conversation with Dr. Dorothy Lewis who recommended #LeteciaStauch change her plea to not guilty by reason of insanity.

#LeteciaStauch is sitting hunched over during this closing argument from the prosecution. Young says one of the questions a doctor asked is if they could talk to "Maria Sanchez" - another personality Letecia claims comes out when there's a "trigger" of some sort.

Allegedly, #LeteciaStauch told that doctor she couldn't just summon Maria Sanchez. Dr. Torres and Dr. Gray determined she was not legally insane at the time of #GannonStauch's murder.

Young says publicity is a motive for Dr. Lewis. He also tells the jury to consider her demeanor while testifying (she was late multiple times). "Dr. Lewis, she didn't know the legal definition of insanity in the State of Colorado... the whole reason she came in to testify.”

"A few days before trial, she hands over a report saying 'I find her legally insane,'" Young says about Dr. Lewis (a defense witness). Young says #LeteciaStauch's "exaggerated" answers to questions "didn't seem to matter" to Dr. Lewis.

Now, a video from 1/26/2020. Letecia: "Gannon, I promise this is the last time I'm going to ask you... are you sure you didn't do it on purpose?" Gannon cries, "I promise." Letecia says they have to "sell stuff" to fix it. Gannon cries more. "I'm just worried about my burns.”

We saw that video on the first day of trial during opening statements, too. The next morning (early on 1/27/2020), #LeteciaStauch made the decision to text her work, saying her stepfather had just been killed in an accident, and she couldn't come to work.

Shortly after that, Young says #LeteciaStauch made the decision that #GannonStauch wasn't going to go to school either. She apparently told Gannon's father it was because of "stomach issues." Gannon's father was out of town - Letecia sent him a picture of Gannon in bed.

"Do you think she wants to prove that he's still alive?" asks Young. 1/27/2020: 9:54 AM #LeteciaStauch texts Gannon's dad "I left my phone at home" before she left the house. 10:12 AM Letecia and #GannonStauch leave the home. "What the heck is she doing taking a sick kid out?”

#LeteciaStauch and #GannonStauch get home at 2:20 PM. At 2:26 PM, Young says Letecia backed the Tiguan into the garage. "This is when the murder happened," Young says, attempting to show the jury she was planning the murder with the way she placed the car in the garage.

Laina Stauch (Gannon's little sister) gets home a bit after 3 PM. Letecia allegedly doesn't let her in the house. Young says that's because she had to clean. 3:35 PM - Al texts Gannon "hey buddy" No one read that text until 7:40 PM. Young says it was the defendant who read it.

"You heard evidence that she never backed that Tiguan into the garage until that day," says Young. When picking up Al from the airport, Young says #LeteciaStauch had already made the decision to rent a car. Young says Letecia left Gannon's body in the Tiguan at the airport.

Young says there's evidence #LeteciaStauch manipulated her daughter, Harley. He asks the jury if they think that means Letecia was manipulating Gannon and Laina, too. 1/29/2020 - Letecia heads to an interview with investigators. Her car was washed on the way there.

Jan. 31, 2020 - the interview with @Spencer_WNews, when he worked at KKTV is played. "I'm not allowed to talk about anything with the case... I would never, ever, ever hurt this child," #LeteciaStauch tells Spencer. Prosecutors allege she shows manipulation in the interview.

"Wait until the end, and see what happens, because Gannon's going to come home," #LeteciaStauch tells Spencer. She says she wants a "sincere apology" from everyone who questioned her during that time.

"You know the rest of the story," Young says, talking about #LeteciaStauch driving to Florida. Young talks about several different stories Letecia told investigators following #GannonStauch's disappearance, even telling Al that Gannon wasn't in the car when she left a store.

If someone is insane and doesn’t know right from wrong, Young says they wouldn’t hide the body and they wouldn’t lie. “There’s only one right verdict in this case, and that’s guilty, to each and every charge,” says Young. With that, he’s done.



Defense attorney Josh Tolini steps up for his closing argument. He shows the same picture we saw on day 1 during openings - a selfie of #LeteciaStauch, #GannonStauch, and Laina during a hike at Garden of the Gods. He says the one question prosecutors can’t answer - motive.

Tolini says none of what prosecutors have done “in the biggest investigation in the history of El Paso County” shows a motive. “The only thing that possibly makes sense is a psychotic break,” says Tolini.

“Mental illness from her past got triggered during a temporary period of psychosis,” Tolini says. Tolini gets out an easel and puts a poster board with a timeframe on it, facing the jury. DA Michael Allen is taking notes, prepping for his rebuttal.

Tolini claims that the fire that burned #GannonStauch is what sparked a trigger for her psychosis. Tolini says #LeteciaStauch grew up with “horrible trauma.”

Tolini says while prosecutors insinuate #GannonStauch’s murder was planned by #LeteciaStauch - “Why is she taking him in the car and going to Petco to buy Valentine’s Day outfits for the dogs? Why would she push back the timeline to right before Laina got home?”

“The brutality of the attack, ladies and gentlemen, I would say is the strongest evidence of a psychotic break,” says Tolini. Tolini says when Laina came home, she was allowed inside for around 10-15 minutes. He directly disputes what prosecutors said - Laina wasn’t let inside.

“I would put before you the strongest evidence of dissociative going on here - look at the body worn camera of the deputies that night,” says Tolini. He says #LeteciaStauch was laughing, joking, and completely dissociating from what had just happened.

Tolini says #LeteciaStauch’s different stories are not the actions of a sane, rational person. “She keeps changing her stories, she keeps giving different accounts, Gannon is placed in the suitcase, driven to Florida,” Tolini continues.

Tolini says one of #LeteciaStauch’s Google searches while in South Carolina included - face transplant near me. “Those are not the actions of a sane and rational person. Those are the actions of someone who is delusional.” “What then we’re brought back to, is why?”

Tolini is now defending their witness, Dr. Lewis. He says she’s 85, is peer-reviewed, and has an HBO documentary “because she is groundbreaking in her field.” “What she has is the decades and decades of experience with this,” says Tolini.

He says Dr. Lewis had 14 hours of interviews with #LeteciaStauch. Of all the hundreds of “mentally ill people” Dr. Lewis has dealt with, Letecia is one of the “most mentally ill.” Tolini is not disputing Letecia killed #GannonStauch, but she was “not in her right mind.”

Tolini claims all the doctors who evaluated #LeteciaStauch believe she has some kind of mental illness - but what that is, is where they disagree. “For whatever reason, her stress in life was becoming overwhelming,” says Tolini.

He says it’s not important to call it borderline personality disorder or dissociative identity disorder - what’s important, is to realize #LeteciaStauch experienced a psychotic break.

“The covering up of the murder does not preclude insanity,” Tolini says. He’s thanking the jury for their time and sacrifice for sitting through this “long trial.” “We are asking you to find her not guilty by reason of insanity.”

Tolini says finding #LeteciaStauch not guilty by reason of insanity would mean the jury is still holding her accountable. She would be sent to the state mental health hospital in #Pueblo. He concludes.

Prosecution will have a rebuttal in around 10 minutes. Jury is getting the chance to get up and stretch.


I’ll thread that rebuttal here.

DA Michael Allen is starting his rebuttal
with “the only fantasy in this courtroom is that this defendant, this stepmom, who killed Gannon, is psychotic.”
“They want to talk to you about motive,” Allen says - but continues saying that’s not something prosecutors have to prove.

Still, Allen says they proved motive. He says one of #LeteciaStauch’s Google searches was “I hate my stepson.” He says Letecia wanted to hurt Gannon, Al, and Gannon’s mom, Landen. Allen says ultimately, she did.

Allen says it doesn’t make sense for Al to leave town if he thought there were signs of psychosis in #LeteciaStauch. “He never saw a single sign from her,” says Allen. But, Allen says Al couldn’t see the hatred in her heart.

Allen says any of #LeteciaStauch’s “freaking out” that she’s supposedly doing is just acting. Allen says “she knew Gannon was done that day.” He says she was calculated, manipulative, and lying to everyone “because it’s about her,” and was not making anything about Gannon.

“She wanted to kill him,” Allen says. Tolini said the brutality of the murder proves psychosis. “Is that true?” Allen asks. “The defendant’s own actions have the answers for you.” He says the brutality shows how much #LeteciaStauch hated #GannonStauch.

Allen says the video they’ve shown of #GannonStauch crying about his burns was the start of #LeteciaStauch’s attack. He says the hydrocodone in Gannon’s system was the continuation of that attack.

Allen addresses the picture Tolini has shown on both the first and last day of the trial. “They’re proof of life pictures,” Allen says - a very different take than Tolini’s argument. “A way to cover her tracks,” Allen says about the pictures.

“People who live by stories, by telling tall tales, don’t stop. Why would she stop doing that when this case started?” “Everything this woman did in her life was manipulation,” Allen says - insinuating her insanity plea is more of that.

Allen says it was not psychosis - “it’s who she is,” as he points at #LeteciaStauch, who’s looking down. Allen continues: Dr. Lewis might be a world-renowned expert, but she’s the only one the defense could find to testify that Letecia has dissociative identity disorder.

“Any time she was pressed to justify her opinion, she couldn’t do it,” Allen says about Dr. Lewis. Allen continues by saying to the jurors “if the crimes fit, you should convict.” “Deliberations are up to you,” Allen says.

“Can this defendant distinguish right from wrong?” The evidence and her actions say she did, according to Allen.

“You don’t stab an 11-year-old 18 times… unless you intend to kill him.” “You don’t hit him over the head 4 separate times… and then you don’t retrieve a handgun… and squeeze the trigger three intentional times, unless you intend to kill him, Allen says.

Allen also says the knife, and whatever blunt-force object that was used, have never been found. Points about dissociative identity disorder are being shown: extremely rare, prevalence in society is ~1.4%.

“She knew she could never replace the love that Gannon had for Landen (his mom),” Allen says. #LeteciaStauch is still hunched over, not looking up at prosecutors.

Allen is going through the stories #LeteciaStauch made up about what could have happened to #GannonStauch. “Pointing any way except for her,” Allen says. “Figuring out a way to cast blame elsewhere and situate herself as the victim.”

Perhaps the cruelest stories of them all, Allen says, is when #LeteciaStauch said it was Landen or Al’s fault - Gannon’s mom and dad. “It shows you the hatred that she had for these people,” Allen says.

“When she realizes those external sources aren’t working, Dr. Dorothy Lewis comes into play,” Allen says, referencing the other personalities #LeteciaStauch said she had. One of those was Maria Sanchez, the “Spanish-speaking Russian sniper.”

“Sometime, prior to Gannon’s death, she searches: I hate my stepson,” Allen says. He says #LeteciaStauch burned Gannon, and made it look like he was experimenting with drugs (hydrocodone was found in his system). Allen says these are all signs of premeditated murder.

Allen says she “manipulated the heck” out of this investigation, which is why it’s the biggest one in El Paso County history. There’s a picture of her face projected to the courtroom, with words like hid, burned, and attacked around it.

Suddenly, the 911 call from 1/27/2020 is being played. Letecia tells dispatch Gannon was supposed to be at a friend’s house, but he hasn’t come home. “He’s only 11,” she says. As Letecia spells his name, the prosecution plays the individual letters of it on the screen.

Clearly, the spelling of #GannonStauch’s name being highlighted is a nod to remembering the boy at the center of this case. It was spelled out alongside a school picture of Gannon.

“Who’s the last person to see him?” Letecia: “I guess me?” The jury heard that call on day 1 of the trial. “He (Gannon) deserves all of the justice that you can give him,” Allen says to finish his rebuttal. Now, it’s in the hands of the jury.

Gannon’s father, Al, is leaning forward and listening intently as Judge Werner reminds the jury of their instructions for deliberations. The judge reminds jurors that “getting stuck” is often part of the process. “It is best to be patient with one another.”

12 jurors leave to eat lunch and start deliberating. There are 5 alternates the judge is now speaking with - saying it is possible they could replace any of the 1-12 jurors. They will be released, but are not excused from jury service.

Court is in recess. Defense attorney Will Cook pats #LeteciaStauch’s shoulder and says “you just never know.” Once a verdict is reached, everyone will have around 30 minutes to get back to the courtroom.

Back in court for what could be the final day of Letecia Stauch's trial, were we should have closing statements coming sometime soon. I'll be tweeting updates throughout the day here for the @csgazette, as well as covering the verdict whenever that comes.

Attorneys are reviewing some jury instruction stuff with Judge Werner, already a very crowded courtroom this morning.

Jury will be called in at 9, closings are going to start at "10ish" after jury instructions, with an expectation that prosecution's rebuttal may happen after lunch.

As the court takes a short break before jury instructions and closings, Letecia Stauch is the quietest person in a packed courtroom. She has been reserved, scrolling through a laptop and looking around briefly.

Jury is back in court, defense has just rested its case.

Judge is now reviewing jury instructions, Stauch is still reading something on a laptop as Werner goes through the instructions.

Jury instructions complete, quick break and then we are moving on to closing arguments.



Prosecution closing argument underway, Dave Young will be presenting.

In a homicide case, "you spend a lot of time talking about the defendant… I want to come back to Gannon," Young states to start closings.

“We know his body was found in Florida, if it wasn’t found in Florida do you think we would be talking about insanity," Young said. "Think about the divine intervention of Gannon's body even being found.”

Young now showing the jury Gannon's autopsy diagram to the jury "because his injuries are relevant,” not just for charges but for her “state of mind" at the time she allegedly killed Gannon.

“It’s not psychotic, it’s strategic," Young said about the 18 stab wounds Gannon suffered at the hands of Stauch, allegedly.

“If you lose your temper, you don’t get to claim insanity,” Young said. “We’re humans, we have emotions.”

Young is now refrencing how none of Stauch's family, Harley Hunt, Al Stauch and Dakota Lowery, all testified that Stauch did not suffer from a severe mental illness "You think (they) wouldn't have noticed something," Young said.

Referencing**.

Young now referencing how the defense’s own witness, Dr. Ronda Niederhauser, testified that she didn’t think Stauch was suffering from any severe psychosis when they met in December 2019.

"What’s relevant about the first competency evaluation… is that they have a two week observation period,” Young said. “And she actually goes to (someone) and asks, can you tell when someone is faking it?”

Young also points to how despite claims that Stauch had had dissociative identity disorder "since a young age," she didn't bring it up when she was first arrested, nor during her competency evaluation in June, 2020.

Young also pointing out how in Stauch's second competency evaluation, when she first brought up having DID, that there were only four personalities, none of them were Maria Sanchez, which is the personality Stauch claims killed Gannon.

Young continues to point out how Stauch's story regarding her claim of having DID changed from evaluation to evaluation. "Is it just a coincidence she spoke with Dr. Lewis before all of this," Young asked, referencing Stauch's plea of NGBRI in Feb. 2022.

“Money is a strong motivator, having shows on HBO is a strong motivator, having your son film the interview… possibly for another documentary, that’s a strong motivator,” Young said referencing Dr. Lewis and her credibility.

Young while complaining about Lewis and how she answered questions and was late for court several times: "Talk about narcistic tendencies," Young said.

“She didn’t know the legal definition of insanity in Colorado ladies and gentlemen, I’m not even sure what her opinion is anymore,” Young said.

The prosecution just played the video from Jan. 26, 2020 where Gannon can be heard crying worrying about his burns. As the video played the word "Manipulation!!!" came on the screen in large white text.

Young is now walking through the actions of Stauch leading up to when the prosecution alleges she killed Gannon, asking the jury if they think she took those actions because she "knew what she was about to do.”

"It may not sound like rational thinking, but it's thinking, she's making decisions," Young said.

"How can she do that, how can she talk to Gannon’s father like nothing happened," Young said. "Is that a trait of antisocial personality disorder that she could be so cold, so callous.”

“Is that someone who doesn’t know right from wrong? Or someone who is trying to get away with something,” Young said referencing how Stauch allegedly went back to her car to check to make sure Gannon’s body was still there the day after she killed him.

The prosecution is playing Stauch's interview with KKTV from Jan. 31, 2020. While it's being played the prosecution is showing evidence over the video like the blood shown in Gannon's room and the suitcase found under the bridge in Florida.

Young said that there is a dramatic difference between people who are actually legally insane and Stauch:
“They aren’t going to hide the body.. Because they won’t know they did anything wrong,” Young said. “They also don’t lie, because they don’t realize they did anything wrong

“There's only one right verdict to this case, and that’s guilty to each and every charge she faces,” Young said to conclude the prosecution’s closing arguments.



Josh Tolini will be presenting closing arguments for the defense.



"The one thing they can not answer is motive," Tolini said to begin the defense's closing arguments. "This was a psychotic rage.”

“That is the only thing that makes sense,” Tolini said.

“Somehow that fire set up some type of trigger,” Tolini said, referencing the fire from Jan. 26, 2020. “When something seems irrational… you have to consider mental illness, you have to consider psychosis.”

“The brutality of the attack is the strongest evidence in this entire case of a psychotic break,” Tolini said.

“Here’s what Mr. Young is trying to do, he is trying to introduce antisocial personality disorder into this,” Tolini said, stating that there are only two possibilities to this case dissociative identity disorder or antisocial personality disorder.

Tolini added that Torres, the state hospital's psychologist, stated during her testimony determined Stauch does not have antisocial personality disorder.

Tolini also claims that Stauch not sleeping, which her phone shows evidence of due to the significant late night activity, points to Stauch being "manic" at this time period.

Currently, Tolini is arguing that Stauch's actions after killing Gannon actually point to her being irrational. "These are not the actions of a sane, rational person," Tolini said. "She is freaking out, and she is delusional.”

Tolini is currently attempting to build back up the credibility of his witness, Dr. Lewis, saying she is one of the most well-respected people in this field and her research has been “groundbreaking.”

Tolini says the things that Lewis didn’t remember or couldn’t recall on the stand were “minute” and just a result of her age. “Ms. Stauch in her (Lewis') opinion has dissociated the memory of the homicide, because she couldn’t deal with it.”

“None of the experts you have heard from think that there is no mental illness going on here,” Tolini said. Tolini is pointing out how Torres and others who testified diagnosed Stauch with borderline personality disorder and narcistic personality disorder.

“All of that (Stauch’s actions) points to mental illness, and in no way, shape or form have they (the prosecution) proved that,” Tolini said to end the defense’s closing arguments.

Taking a quick break before prosecution's rebuttal.



Michael Allen is handling rebuttal for the prosecution. He is opening by pointing out that rebuttal isn't required to convict under Colorado law.

Allen added that there is motive "She hated Gannon," Allen said.

“She doesn’t have psychosis,” Allen said. “He (Al Stauch) couldn't’ see into her heart, the hatred she had for Gannon… He didn’t know.”

“Does the brutality itself prove psychosis from the defendant," Allen asked the jury., referencing the claim from Tolini. “The brutality speaks to the abject hatred she had for Gannon, and the pure determination she had to kill Gannon.”

"Everything this woman did in her life was manipulation, to cause chaos, and make her the victim," Allen said. “That’s who she is, she’s a story teller. Telling stories is not a sign of psychosis, it’s who she is.”

“Every person who knew her (Stauch) knew she knew right from wrong,” Allen said.

"These people would have noticed it if something was wrong with her," Allen added.

Allen just alleged that maybe the reason Stauch hated Gannon so much was because of how much he loved his mother: “She knew she could never replace the love Gannon had for Landen (Gannon’s mother),” Allen said.

Allen outlining how all of Stauch's lies about what happened to Gannon is "everyone else's fault, and makes her the victim."
Some of the people the prosecution claims Stauch blamed include: Gannon Quincy Brown "The pregnant lady with a cash baby" "Uncle Matt" Landen Al Stauch

During most of the closings Stauch has been looking straight down at the defense's table, as she has for many points of this trial.

“Her (Stauch) manipulations caused this to be the biggest investigation in El Paso County history,” Allen said.

“This little boy deserved so much more out of this defendant,” Allen said. “He deserved protection… he deserved to grow up one day and become a man and have a family of his own. She took that away from him.”

The prosecution is ending its rebuttal by playing the audio from Stauch's 911 call to report Gannon missing on Jan. 27.
"Who was the last person to see him (Gannon)," the operator asks. "Uhh. I guess me?" Stauch can he heard responding.

"Gannon deserves it, he deserves all of the justice you can give him," Allen said to end the prosecution's rebuttal.

12 jurors have been sent back to begin deliberation.

Judge is in the courtroom. #LeteciaStauch is too.

Jury not in the courtroom yet. Attorneys and judge going through some logistics with jury instructions.

Jury will be brought in around 9 am. Judge guessing closing arguments will start at 10ish. Closings and possibly rebuttal after lunch. Prosecution hopes to get through rebuttal before lunch. No time limit on closings. Judge guesses jury instructions will take 40 minutes.

Dave Young is presenting prosecution's closing argument.

Young: "I want to come back to Gannon. Gannon's been in a box back here for the whole trial. This is what the trial should be about.”

Young: "What #GannonStauch had to tell you through his autopsy in the trial is all you need to know.”

Young: "If his body wasn't found in Florida do you think we'd be talking about insanity in this trial?”

Young calls the bridge inspector finding the suitcase with Gannon's body "divine intervention" leading to the point where we are at today.

We're seeing a diagram of injuries on Gannon's body, not the photos from the autopsy. "Just by looking at these injuries, what does your common sense tell you...Gannon was defending himself, he was fighting off despite having hydrocodone that made him lethargic...she didn't stop”.

"...18 times, 18 times she took a knife, stabbed him. It's not psychotic it is strategic. The stab wounds are to his chest, as Gannon's fighting the stab wounds are to his back. But it's not just the stab wounds...4 separate strikes to his head, wasn't good enough for her.”

Talks about the bullets found in Gannon and pillow and now is showing map of the area of the bridge Gannon's body was found under in Pensacola, FL.

The body had been out there since Feb 4th and found on March 17th in Florida heat. They didn't smell anything until the suitcase was open. Harley said she didn't smell anything and Young is arguing this should give her credibility.

Young: "Did she intent to kill Gannon when she did what she did to him? I would suggest that's not disputable."

Young says the burden is on the state to prove sanity, and they "gladly accept it."

"If you loose your temper you don't get to claim insanity," Young says while reviewing the law and elements with the jury.

Mental disease or defect defined on screen: a severely abnormal mental condition that grossly and demonstrably impairs a person's perception or understanding or reality and it can't be not attributable to the voluntary ingestion of alcohol or any other psychoactive substance.

Young states that Letecia's daughter Harley and husband at the time Al would have noticed/known if she had a "grossly impaired perception of reality.”

Young: "If she was experiencing psychosis of December of 2019, the doctor would have had an obligation to admit her...it's not there.”

When psychologist talks with Letecia after Gannon's body was found, Young points out that Letecia says she wasn't in Florida, not that "Maria did it" or anything about having multiple personality disorder.

There was a two week observation period for first competency evaluation.
Young: "She actually goes to a nurse and says 'can you tell when someone's faking it.'"

Young bringing up that Dr. Torres testified in her evaluation of Letecia on August 4, 2020, she asked her if she has multiple personality disorder and she said no.

Young says Letecia exaggerates in evaluations to the point where even people who are hospitalized for psychiatric illnesses don't respond that way. "Do you think she might be faking it?”

Now talking about 2022, Young says Dr. Lewis told Letecia she recommends she change her plea to not guilty by reason of insanity.

Young says for insanity, the law says that you have to go back to the time of the crime, what was her mental state then.

Young asks the jury if it is just a coincidence that Letecia consulted with Dr. Lewis before and then Maria Sanchez comes into play during this last evaluation.

Young points out that during her evaluation with Dr. Lewis, Stauch says that she can't just summon "Maria," she has to come out with a stressor event. Young says that coincidently is what's written in the DSM-5.

Young talking about credibility of Defenses' witness Dr. Lewis: "Money is a strong motivator, having shows on HBO is a strong motivator, having your son in the room filming is a motivator.”

Young: "Dr. Lewis, she didn't know the legal definition of insanity in the state of Colorado ladies and gentleman, the whole reason she came in to testify.”

Watching videos now as Young says he wasn't to show Letecia's demeanor "before, during and after"

We are watching the video where Gannon is heard crying about dropping the candle and burning carpet. The word "Manipulation" is displayed on the screen and Gannon's words "I'm just worried about my burns.”

Young points out Letecia stops recording after Gannon says "I'm just worried about my burns." He asks the jury if stopping the recording then shows "judgement and reflection.”

On morning of alleged murder, Young says she takes picture of Gannon in bed and sends it to Al. Young: "Do you think she wants to prove he's still alive because of how much hydrocodone she gave him?”

Leaving her phone at home, before she and Gannon left the house Young: "Do you think that's an indication she knew what she was doing?"

Young asks what Letecia was doing taking a "sick kid" out to go shopping for dog clothes on day of alleged murder, calling it "narcissistic tendencies”

Young says right before the alleged murder, Letecia moved her car.

Young: "It may not sound like rational thinking, but it's certainly thinking, it's making decisions.”

Young says when Gannon's little sister gets home from school she doesn't let her in the house. "She needs to hide evidence.”

Young: "How can she do this, how can she talk to Gannon's father like nothing happened. Is that traits of an antisocial personality disorder that you can have no sympathy?”

Young says Letecia and Gannon's body leave for the airport. "She's made the decision to rent a car before even leaving the house. Is that evidence of psychosis or that she's thinking things through?”

Young brings up critical point in this case when Al realizes Letecia's car is not where she said it was. That's when he realizes his wife may have done something to his son and tells police that.

Young says texts from Letecia to her daughter Harley, telling her not to talk to police, etc. show she's manipulating.

Young: “She plants seeds, the suitcase is critical." Young says Letecia stated that a man named “Eduardo” took a suitcase when he took Gannon. Young says that's because she knows Gannon is in a suitcase at Palmer Lake, so if police find it, they will think it's this Eduardo.

Letecia's head is down in court right now during these closing arguments.

Young says trackers show she went back to the place she originally dumped Gannon and gets his body. Her brother testified seeing the green suitcase when they had to move suitcases into rental van.

Young calls it "another divine intervention" is when the rental van powers up and gets her location near the bridge where Gannon's body is found. It was set to check location every certain amount of hours.

Young: "There are people who are truly legally insane ladies and gentleman, they don't act like that. If they don't have the capacity to know right for wrong, they won't hide the body. They act like nothing had happened...they also don't lie."

Young: "There's only one right verdict in this case and that's guilty for each and every charge she's charged with."


Now defense is up. Josh Tolini is presenting closing arguments for defense.


Tolini: "There is no answer of motive"...how we can go from a hike on Garden of the Gods, loving kind to rage." Tonlini calls the killing "psychotic rage" brought up by what's happened in her past.

"This is not premeditated murder, this is a psychotic break. That is the only thing that makes sense”.

Tolini says based upon Al's relationship with Letecia and how she treated Gannon, he felt comfortable enough to leave his kids with her when he left for military training in Oklahoma.

Tolini repeats that mental illness from her past got triggered and there was temporary period of psychosis. "There's no rational basis for the murder besides psychosis.'

Tolini: "Somehow that fire set off some type of trigger, maybe some type of trigger that had been disassociated long ago but we have her melt down right after the fire.”

Tolini talks about how in the video with the candle incident, Letecia says she's freaked out and she says they'll have to sell the sofa. "That makes no sense whatsoever."

Brings up at 4:36 am on the morning of alleged murder, how Letecia calls out from work by saying her step father dies. Tolini said the step father is who traumatized her. He points to her texts that she's manic because she's up the entire night not sleeping.

Tolini: "Something is going on in her mind, something is there loosing it and something horrible goes on in the basement where there is a brutal, brutal attack.”

Tolini says how brutal the attack on Gannon is shows that there's a mental break.

Tolini: "What is going on her head, we don't know”.

"I would put before you the strongest evidence of dissociation going on here, look at the body language when the sheriff's come in the house looking for Gannon."

Tolini says she is laughing with sheriff's deputies after killing Gannon and that's pointing to dissociation, "She is in a manic situation and her mind is not working.”

Tolini says to go into police two days after reporting a kid missing, with a completely different story shows she wasn't calculated. "That is completely irrational to think that that kind of thing could possibly be believed.”

Tolini: "All of these phone calls with Al are the actions of someone who is delusional...she is freaking out and is delusional in that thought that anyone would believe all of the variations of what she is trying to sell them, none of that makes sense.”

Tolini says Dr. Lewis has decades of experience dealing with people with severe mental illness who committed heinous acts. He says she may have gotten forgetful on the stand, referring to her age. "Do not discount her decades of experience, do not discount her expertise.”

Tolini: "We're not disputing that it was her, but she was not in her right mind when she did it and you heard Dr. Lewis state that.”

Speaking about other doctors prosecution called up, Tolini says none of them deny mental illness.

Tolini: "Whether you call it borderline, DID, that is not the important thing...it's that there must have been psychotic actions going on.”

Tolini: "All of the antisocial personality disorder talk is a smoke screen." Tolini says when the screen is off what's left is disassociation.

Tolini says covering up of the murder does not preclude insanity. "They are not mutually exclusive.”

Tolini: "We're not saying to set her free, to let her go, we're not saying don't hold her responsible. We're saying to consider the mental illness she suffers and send her to CHMIP." He talks about that the conditions are shackles and not great.

Tolini tells jury if they believe this occurred in any state of psychosis, it is their legal duty to find Letecia insane.


They are going to take a 10 minute recess then rebuttal.


Jury is back. Michael Allen will present rebuttal now.

Allen: "The only fantasy in this courtroom is that this defendant, this step mother who killed Gannon has psychosis”.

Allen says they don't have to prove motive and yet they did anyway. "This defendant hated Gannon, we know that because she searched him 'I hate my stepson' she has one stepson.”

Allen says Letecia wanted to hurt Al and Landen and with Gannon's death, she "did to the core.”

Allen says Al would not have gone on his training if he had seen some problem with the defendant. "He went because she doesn't have psychosis, what he didn't know, he couldn't see into her heart, the hatred she had for Gannon."

Allen says "it's not psychosis it's all about Leteica." Allen calls it acting when she appears to be "freaked out”.

Allen: "She needed an unassailable excuse to not go to work because she knew what was going to happen that day, she knew Gannon was done that day.”

Allen says searches show you everything you need to know. "She was calculating, manipulating...why? Because it was always about her.”

Allen: "None of us in this court room has killed a child, that doesn't make it a psychotic act, that doesn't mean it's insane.”

Allen: "She wanted to kill him.”

Allen: "The brutality of it speaks to the hatred she has for Gannon and the pure determination she had to kill for Gannon.”

Allen: "This didn't start over one quick moment. This started Sunday night with a candle incident that makes no sense, according to the way she describes it to people, because she wants to make it his fault.”

Allen says Harley and Al testified that Gannon never played with candles. That it doesn't make sense.

The pictures she took of Gannon before his death. Allen: "They are proof of life pictures to show she has nothing to do before what she's about to do...a way to cover her tracks and it starts early.”

Allen: "Temporary insanity is not in our insanity statute in Colorado, that does not apply here."

"Everything this woman did in her life was to cause chaos...she's a story teller. Telling stories is not psychosis, it's who she is.”

Allen said Dr. Lewis is well known, but she's the only person they could get to say Letecia has signs of DID. "Not a single other doctor saw a shred of DID”.

Allen says anytime Dr. Lewis was pressed to justify her opinion, she couldn't do it.

Allen: "You don't have to prove cases beyond all doubt, you have to prove beyond a reasonable doubt.”

Allen: ""If the crimes fit, you should convict.”

Allen: "Why do all the things she did if she didn't know what she was doing was wrong?”

Allen: "You don't stab an 11-year-old 18 times, 11 of which are on his arms and hands as he's defending himself, unless you intend to kill him."

Allen: "you don't ten retrieve a hand gun...squeeze that trigger unless you intend to kill him."

Allen: "Every single person that knew her knew she knew the difference between right and wrong.”

Allen: "She knew she could never replace the love Gannon had for Landen”.

Allen: "In every single one of these stories, she's figuring out a way to cast blame elsewhere and she's the victim, it's a very calculated move.”

Allen says what Letecia did "Shows the hatred she has for these people, the hatred she has for Gannon.”

Allen said Dr. Lewis didn't know a single thing about the case and Letecia in Feb. 2022, when she suggested Letecia change her plea to not guilty by reason of insanity.

Allen says Letecia hated Al and Landen "Why take away their little boy in the way she did and concoct the stories she did." Allen says way she killed Gannon shows hatred for him and the burning the day before shows "premeditation." Allen believes she burned him.

Allen: "Her stories and manipulations of this investigation caused it to be the biggest investigation in El Paso County history."

"Jan 27th, 2020, she murdered Gannon. This little boy deserved so much more from this defendant. He deserved protection, he deserved to live, he deserved to grow up and one day have a family of his own, she took this all away.”

Gannon's biological family is crying in the court room. Letecia has her head down.

Allen: "Gannon deserves justice...Gannon Jacob Stauch 11-years-old.”

Many who came to hear closing arguments are crying in the courtroom. Allen has now finished.

You can see the pain on Gannon's biological parents' faces as the judge now speaks to the jury before sending them to deliberate. You could hear the crying as this rebuttal wrapped up.

There are five alternates. Jurors 1-12 will go to the deliberation room. Jurors 13-17 will not be deliberating.

When judge hears there is a verdict, he will reach out to public information officers to let us know. 30 minutes later, we will hear the verdict.

Judge: "This was a long trial, it involved difficult facts. I know it was hard on the jury, I know it was hard on the families, I know it was hard on the lawyers.”

Judge says there is so much evidence it takes 20 minutes to bring it out of the court room every day.

Judge said this case could have been made so much worse by bad lawyer behavior. He appreciates the professionalism.

Week 5 Day 20

The murder trial for #LeteciaStauch continues this morning. The defense is expected to rest their case, and closing arguments are expected as well. I’ll be in the courtroom bringing you the latest information throughout the day.

We've been let into the courtroom. So far it's a full gallery. Gannon's family is not here yet. Letecia Stauch's attorneys just walked into the courtroom and patted her on the shoulder.

JURY INSTRUCTIONS

The council is reviewing jury instructions right now. There’s been discussion about a request for instruction on evidence that wasn’t actually presented. From what I’m understanding, I believe this is about the discussed jail visit for Stauch during the beginning of the pandemic.

Judge Gregory Werner will give jury instructions soon. The judge expects closing arguments to begin around 10 a.m., and take up to an hour for each side, and then a rebuttal close from prosecution.

Gannon Stauch's family has arrived. His father Al Stauch, and mother Landen Hiott, are among those in the courtroom.

Right now, Stauch is talking to her attorneys. She's wearing a teal color today.

Jurors are now in the courtroom.

The defense has rested their case, which means they have presented all the evidence in their case. Prosecutors do not have any rebuttal evidence.

Jury instructions are being handed out to the jurors. The judge is explaining how closing arguments will go. Jurors have also been told they will not be able to leave the building today.

All the jurors are looking down at their instructions right now, and listening intently to Judge Werner.

Among the charges Letecia Stauch is facing are murder in the first degree, child abuse resulting in death, tampering with a deceased human body, and tampering with physical evidence for the death of Gannon Stauch that occurred on or about January 27, 2020.

I am sitting directly behind Letecia Stauch and the defense table. I can see Stauch looking at the jury instructions on a laptop that is sitting in front of her.

Among the charges #LeteciaStauch is facing: - Murder in the first degree after deliberation - Murder in the first degree of a child under 12, position of trust - Tampering with a deceased human body - Tampering with physical evidence


Stauch is pleading not guilty by reason of insanity. Judge Werner is going over the instructions of how jurors will also be answering the question of Stauch being sane or not insane as the crimes were committed.

Judge Werner said if Stauch is found not guilty by reason of insanity, Stauch will go to the Department of Human Services, until she no longer requires hospitalization or suffers from a mental disease or defect.

Jury instructions also state that if Stauch is found not guilty by reason of insanity, she will not be tried on these charges again.

The court is in recess until 10:05 a.m.


PROSECUTION CLOSING ARGUMENTS

Closing arguments in the murder trial for #LeteciaStauch are underway.

Prosecutor Dave Young said it’s been a long trial and jurors have sat through a lot of evidence. “I want to say thank you for that. You guys have been very attentive. You’ve asked some very good questions that I’m going to use in my closing argument,” said Young.

"Gannon’s been in a box for the whole trial. This is what the trial should be about. I’m not doing this to get sympathy from you. I’m doing this to tell you what Gannon had to tell you through this trial through the autopsy is all you need to know," said Young.

Young asked, "If his body wasn’t found in Florida, do you think we’d be talking about insanity in this trial?"

Jurors are now looking at the autopsy report of Gannon Stauch.

“Just by looking at these injuries what does that tell you? Gannon was defending himself, he was fighting off. Despite having hydrocodone in his system, despite being lethargic. He was able to fight her off… 18 times she took a knife and stabbed him," said Young.

"As Gannon is fighting, the stab wounds are to his back. But it’s not just the stab wounds. She has to use judgment and reflection to get another weapon. What that weapon was, who knows. But she got another weapon and hit him in the skull several times," said Young.

“Why do they drive all the way from Decatur in one night and drive to Florida? Why did she want to get to Florida? The Gulf of Mexico,” said Young.

Young asked, “Does she think there’s water underneath the bridge? Is that logical thinking when you cross the bridge and can’t see anything… She gets rid of the body. Does she ever think the body is going to be found again?”

Young talked about Macon Ponder, the bridge inspector who found the suitcase in Florida. “They dump it out and see the most horrific thing they’ve probably seen in their lives, Gannon’s body in a fetal position… Wearing the same clothes he’s wearing when she killed him.”

“Did she intend to kill Gannon when she did what she did with Gannon? I would suggest that’s not disputed," said Young.

When talking about the definition of insanity, Young said, “These words mean a lot. This is not something you’re going to find in the DSM5… This is a legal definition of insanity… The law presumes everybody to be sane.”

Young asked, so what does insanity mean? She was so diseased or defective in mind, she couldn’t distinguish right from wrong. But “If you lost your temper, you don’t get to claim insanity.”

Young goes over the legal definition of insanity: “Mental disease or defect means only those “severely abnormal mental conditions that grossly and demonstrably impair a persons perception or understanding of reality.”

“Do you think Harley might notice she might have a grossly and demonstrably mental condition?... Do you think Al stauch might have noticed for it to be grossly and demonstrably… What about her brother? Dakota Lowery? You think he might have noticed it," said Young.

Young talked about Dr. Niederhauser and Dr. Mohr, who worked with Stauch. Dr. Niederhauser worked with Stauch in December 2019. Stauch told her she has general anxiety. Dr. Mohr worked with Stauch after she was arrested. Stauch also told her that she only had general anxiety.

Young said it wasn't until June 2020, where Stauch brought up questions about her competency.

Young said, Stauch said, ‘I’ve got bipolar disorder. I’m a manic depressant. I ramble. I’m a manic depression, that’s my mental illness.’ Nothing about dissociative identity disorder, which according to Dr. Lewis she’s had since a very young age. Nothing about Maria Sanchez.”

Young asked, “Do you think she might be faking it? During that evaluation No history of inpatient treatment of psychosis either during that evaluation.”

Young said during the second competency evaluation with Dr. Grimmett in December 2020, “Now she starts talking about dissociative identity disorder and bipolar disorder… She says she has four distinct personalities. None of those four were Maria Sanchez.”

Young said Stauch pleaded not guilty by reason insanity in February 2022. He said Dr. Lewis recommended that Stauch change her plea to not guilty by reason of insanity. Then Stauch went back to the state hospital for a sanity evaluation.

Young said, “What is the defendant saying now? She’s not bipolar. Now she’s created more personalities as part of dissociative identity disorder. Is it a coincident that she’s consulted with Dr. Lewis prior to this? And now Maria Sanchez comes into play during this evaluation.

Dr. Torres and Dr. Grey asked if they could talk to Maria. “We saw how that happened on Wednesday. It was magic according to Dr. Lewis,” said Dr. Young. Dr. Torres and Dr. Grey said Stauch has a personality with borderline and narcissistic features.

Young talked about how Dr. Lewis testified, “She’s acting… You have to look at her demeanor and manor while testifying. She wouldn’t answer any of my questions because she didn’t want you to know the answers… She shows up to court late. Talk about narcissistic tendencies.”

Young continued to talk about Dr. Lewis and asked, “Are they going to do a documentary if she says she’s sane? I think it speaks for itself how she testified.”

Young said, “Dr Lewis, she didn’t know the legal definition of insanity in the state of Colorado ladies and gentleman. The whole reason she came into testify.”

The video that’s been played for jurors several times as Gannon is asking about his burns, is played again for the jurors. Young asked, “Why did she videotape this? Do you think it was about Gannon’s burns?”

Young said, the next morning, Stauch texted her assistant principal saying her step father was killed. “Could it possibly mean she knew what she was going to do? Because shortly after that, she calls Gannon’s school and says he’s not coming in. And then texts Al.”

Young said then she takes a picture of Gannon in bed. “Why did she take a picture of Gannon in his bed in his bedroom and then text it to Al?… 'Look Gannon’s alive. He’s here, he’s sick, he’s in bed.’”

Young asked, “You think he might be lethargic from the hydrocodone? You think she wants to prove he’s still alive because she knew how much hydrocodone she gave him?”

Young asked, “Do you think it’s that far fetched she knows Gannon had been poisoned and she knows something might happen to Gannon?”

Young asked, “How could she do this? How could she talk to Gannon’s father like nothing happened? Is that traits of an antisocial personality order? The fact you can be so cold and callous and act like nothing happened. And she does it through the whole day. You guys know that.”

Young is talking about how Letecia put Gannon’s body in the back of her Tiguan, then dropped it off at the airport, and rented another vehicle. Then Letecia picked Al up. Young said Letecia returned to the airport, presumably to check on the Tiguan with Gannon’s body in it.

Young said Al then went to French Elementary School that day. “When he sees the Tiguan is not there, he now knows that his wife had something to do with the disappearance of Gannon… and the investigation now looks at her.”

Young said Letecia then drove the S curve in Palmer Lake. “Why is she going out to hide the body there? Probably because it’s a good location. She can’t keep it in the Tiguan. Did she know right from wrong?”

Again, I am sitting directly behind the defense’s table and Letecia Stauch. Her head has been down during most of the closing arguments by prosecution.

Prosecutors then played the KKTV interview that Letecia did after Gannon’s disappearance. Words like "was" and "manipulation" kept showing up on the screen.

During the video, photos were shown of Gannon in bed, the blood evidence in his room, the GPS data from her phone and car, the area where the blood-stained piece of wood was found, a map of of her drive to Florida, and where the suitcase with Gannon’s body was found.

Young went over several of Letecia’s stories about what happened to Gannon. “Eduardo, immunity, Quincy Brown, several different versions of that, bike accident, uncle Matt. The one that is really significant is, 'When she says I’m so sorry Al, I wasn’t telling you the truth.’”

Young said, “What people who are truly legally insane do under these circumstances… They don’t act like that,” as he points to Letecia Stauch.

Young said, “There is only one right verdict in this case and that’s guilty to every charge that she’s charged with.” That ended closing arguments by prosecutors.


DEFENSE CLOSING ARGUMENTS


Closing arguments in the murder trial for #LeteciaStauch from defense are underway.

Josh Tolini began with, “the one thing they cannot answer is motive. Motive of how we can go from this picture on the hike at Garden of the Gods, loving and kind, to less than 24 hours, 18 stab wounds, four blunt force trauma injuries, and shot.”

“This wasn’t a preplanned, calculated killing for some game. This was a psychotic break fueled by rage, attacking a demon from the past,” said Tolini. “This was not pre-mediated murder. This was a psychotic break. That is the only thing that makes sense.”

Tolini said this was the biggest investigation in the history ever of El Paso County, and no family members ever said anything bad about Letecia and Gannon’s relationship.

Tolini said the fire from the candle incident set off some trigger, and Stauch had a meltdown after the fire. He said she wasn’t sleeping, and was manic at the time. She was texting throughout the night and early in the morning.

Tolini said, “Something is going on in her mind. Something in there is losing it. Something occurs in the basement, a brutal attack with rage… The brutal attack is the strongest evidence in this case.”

Tolini said there are only two things that account for her actions at this point in time. It’s either dissociation or she puts what happened to Gannon, that brutal attack, into a place in her mind that she doesn’t remember.

Tolini said, “The strongest evidence of dissociation of what’s going on here, look at the body worn camera when they come in that night looking for Gannon.”

Tolini said, “A horrible attack has just happened, and she’s acting and presents herself to these police laughing, joking, being incredibly friendly just after this has happened.”

Tolini said, “Because at that time she has dissociated this horrible act that she has committed. There is no other logical explanation of how she is doing that.”

Tolini reiterated that Stauch was not sleeping at all, and she was in a manic situation and her mind was not working. He added, what she did and all the stories she told, was irrational.

Tolini said, “It makes no sense for somebody who has pre-planned to brutally kill Gannon, then to report him missing right away, and then a matter of three days later to go police with a completely illogical story… None of that is rational. None of that makes sense.”

Tolini is now talking about Dr. Lewis, the defense’s psychiatrist who conducted a sanity evaluation on Stauch. Tolini said she’s 85 years old, and has been researching people with mental illnesses for decades. “She was groundbreaking in her field,” said Tolini.

Tolini said Dr. Lewis has more expertise on this subject that anyone else in the country. He admitted that Dr. Lewis confused some things with her memory during her testimony. “I’m not disputing that… Do not discount her decades of her experience. To not discount her expertise.”

Tolini said that Dr. Lewis said, “Mrs Stauch is one of the most mentally ill people she’s ever dealt with.” Tolini said, she didn’t endorse that it was Maria who did this. What she said was that Stauch dissociated the memory of the homicide because she can’t bear to deal with it.

Tolini said Stauch cannot accept the idea that she committed this brutal, horrible homicide. “To accept the fact in her mind would crush her, would crush her soul, would crush her identity. So she’s trying to come up with another fantasy of what happened.”

Tolini said all the doctors agreed Stauch has some kind of mental illness, but they didn’t agree with which one she had.

As jurors heard during testimony, with borderline personality disorder, people can suffer from psychosis, become irrational and dissociate with things they cannot deal with.

Tolini talked about Dakota Lowery’s testimony, who is Letecia’s half brother. He said Lowery testified that Letecia would leave knives with him so he could protect himself from something or someone. “You have the connection of Gannon being stabbed with a knife 18 times.”

Tolini said, “We are asking you to find her not guilty by reason of insanity… We’re saying for you to take into account the mental illness that she suffered.”

The defense is finished with their closing arguments.


Court is in recess for about 10 minutes. Prosecutors will have a rebuttal when we return.


After closing arguments, Letecia Stauch's lawyers once again, patted her on the back.


PROSECUTION REBUTTAL

District Attorney Michael Allen is beginning prosecutor’s rebuttal. “The only fantasy in this courtroom that this defendant, this stepmother who killed Gannon had a psychotic break.”

Allen: “This defendant hated Gannon. You know that because she searched it. ‘I hate my stepson’… She wanted to hurt Al. She wanted to hurt Landon for that matter. She did to the core. They will never recover from what she did to them.”

Allen said she wanted to leave Al and their marriage before Gannon was killed. “In fact it does prove motive.” Allen talked about Al saying, “He never saw a single sign from her. What he didn’t know, he couldn’t see into her heart, or the hatred she had for Gannon.”

Allen said, “That freaking out that she’s doing is acting… She knew Gannon was done that day. That’s why she calls Gannon out of school later.”

Allen said based on her internet searches, Stauch was calculated, manipulating, and lying to everyone. “She deflects the blame and makes herself the victim.”

Allen said the candle incident makes no sense. “Because she wants to make it Gannon’s fault. Mr. Stauch told you the answer to that question. Harley told you the answer to that question. He didn’t play with fire. He didn’t light candles randomly.”

Allen asked, “Does it make more sense that this defendant burnt him?”

Allen talked about the hydrocodone. “That’s why he’s lethargic, he can’t get out of bed early, like he normally would. Walking slowly to the pickup truck in the morning, because he’s under the influence of hydrocodone.”

Allen talked about the picture from the hike at Garden of the Gods. These were, “Proof of life pictures pictures she is sending out to prove to the world she has nothing to do with what she was about to do… It was a way to cover her tracks and it starts early.”

Allen said everything Stauch has done in her life was manipulated and calculated.

Allen said, “The biggest investigation that El Paso county has ever seen, that involves the FBI. That’s who she is, she is a storyteller. Telling fantastic stories is not psychosis. It’s who she is,” as he points to Letecia Stauch.

Allen said Dr. Lewis didn’t even know what the definition of insanity is in Colorado.

During rebuttal from prosecutors, #LeteciaStauch is still seen with her head down most of the time, and looking forward at other times.

Allen said, “There’s plenty of evidence to find this defendant guilty… Why do all the things she did if she didn’t know right from wrong?”

“This woman doesn’t have a diseased mind. She has no psychosis… Family members gave the answers to you. Harley said it. Dakota Lowery said it. Al Stauch said it.”

After a quick glance at Al Stauch, he has a tissue in his hand, and is wiping away tears. You can hear sniffles and emotion coming from the side of the courtroom where Gannon's family is.

A photo of Gannon is now being shown, and jurors are hearing the 911 call from Letecia Stauch on the day Gannon was killed, as she’s reporting that Gannon is missing.

Al Stauch, Gannon's father, now has his head in his hands, and is weeping, as he’s being comforted by family members around him.

Many in the courtroom are sniffling and wiping away tears, as Gannon’s photo of him smiling, is still being shown on the screen.

The judge is thanking the jurors for being here and being attentive throughout.


#BREAKING: Jury deliberations are underway in the murder trial for #LeteciaStauch.


The judge said once he is advised that a verdict has been reached, he will let the right people know. We’ve also learned that the District Attorney’s Office for the 4th Judicial District will update the public on social media once a verdict is reached.

The judge then addressed the attorneys. “I want to thank the attorneys for their presentation in this case. More importantly, I want to thank the lawyers for the professionalism they have conducted throughout the trial.”

The judge said he knows this has been a long trial, with difficult facts, that it was hard on the jury, on families, on Letecia Stauch, and on the lawyers.

Judge Gregory Werner said, “In a case that could have been made so much worse by bad lawyer behavior, all of you rose above that. I appreciate that, from a judge perspective, I think you have put on a clinic for how cases should be tried.”

EL PASO COUNTY, CO — The presentation of evidence in the murder trial of Letecia Stauch has wrapped up. Jurors are expected to hear closing arguments before noon.

Stauch did not testify in her own defense in the case. She's accused of killing her 11-year-old stepson Gannon inside the family home in early 2020 and dumping his body inside a suitcase along the side of a road in Florida.

Among the charges Letecia Stauch is facing are murder in the first degree, child abuse resulting in death, tampering with a deceased human body, and tampering with physical evidence for the death of Gannon Stauch.

murder in the first degree child Under 12 by a person in a position of trust one for charge of tampering with a
deceased human body and one for tampering with physical evidence
in a moment I'm going to send almost all of you back to the deliberation room and members of the jury I want to thank you
for listening so closely to the evidence in this case um because
most or all of you have not served as jurors before I would like to give you a
few pointers regarding the process of deliberation however unlike the instructions that I gave you these are
only suggestions and you are free to proceed in any way you wish first You may wish to choose your four
person who will preside over your deliberations you may already have a good idea of someone that you think
would be fair a good listener and a good discussion manager pick someone who is willing and able to
help the discussion remain organized and respectful remember however that the four persons
opinion has no greater value than that of any other juror second you should reach some agreements
about how you will conduct yourselves the four person shall enforce or encourage compliance with these
agreements if he or she is unable to do so or engages in this conduct him or
herself the jurors have the right to select a new presiding juror
jurors are often tempted to hold a preliminary or straw vote at the
beginning of deliberations in order to determine whether they already agree or how divided the group may be
I recommend against this procedure because it may cause some jurors to lock themselves into a position which they
will then feel reluctant to change experience has also shown that such early votes frequently lead to
disruptive unnecessarily lengthy and inefficient debate and to ineffective
decision making if you reach a particularly controversial or difficult point in the
discussion you may want to move to a less controversial or simpler area for discussion and return later to the more
difficult issue You may wish to consider secret ballots if the jury would feel more comfortable
with this procedure you each have the right to your
individual opinion but you should be open to persuasion
it helps if you are open to the possibility that you might be wrong or at least that you might change your mind
about some issues after listening to other views misunderstanding can undermine your
efforts seek clarification if you do not understand or if you think others are not talking about the same thing
the four person or some other juror is agreed to by the jury may wish to take notes of agreements and disagreements
and from time to time set out the items on which you agree in those on which you have not yet reached
agreement you must deliberate as a group while you are all together
in spite of your best efforts it is indeed possible that serious
disagreements may arise in that event recognize and accept
that getting stuck is often part of the decision-making process
it is easy to fall into the Trap of believing that there is something wrong with someone who is not ready to move toward what may be an emerging decision
such a belief however is not helpful it can lead to a conflict of personalities rather than a conflict of issues
it is best to be patient with one another taking a break can often be helpful and lead to a satisfactory
conclusion the bailiff is available whenever you need to stretch to calm down to clear your minds take a walk
around the building something of that nature as I indicated however these are only suggestions
and you are free to proceed in any way you wish when we began this process I told you
that we were going to be selecting 12 jurors plus six alternates the reason why we do that is because in
any case that lasts for longer than a day if something were to happen to a
juror during the process we would have I would have to declare a mistrial start all over on another date
at another time from the beginning with a whole new different crew
um this was the first trial of any length that we've had since covid
um I have had long trials before um and I I understand that uh things
happen uh during trial sometimes people have family emergencies during trial sometimes people get sick sometimes as
in this case we had a juror who didn't know that they knew a witness until that witness got here
um so we always try to plan for that because we don't want to have to put everybody
through another trial at a different time and start all over without any
potential of resolution and without any potential of getting through all of the evidence however the law only permits 12 people
to deliberate in this case uh the alternates in this case are chosen at
random I'm still going to refer to you as number to protect your privacy so we
have nine people in the back number 10 number 11 number 12.

um and Mr Combs will take you back to the deliberation room um and there should be do we have food
there should be food or food is on the way we are uh working on that so please be patient with us uh but we're going to

have left the courtroom um we get to this point in every case almost any case it lasts
longer than a day and I always feel terrible for the people that are the alternates because
you have put in just as much time effort and energy as everyone else you have
dedicated a lot of time to this case over the last
seven weeks eight weeks wherever we are um but you don't get to deliberate
yet which is why um it is possible and we just had it
happen last week in a different case where one of the jurors had to be replaced by an alternate
um so this is going to sound a little strange I'm going to release you but uh
you're not excused from jury service what that means is that you're not going to be deliberating back with a 12 but
you still cannot discuss this case among yourselves cannot discuss the case with anyone else cannot do your own
independent research about any aspect of the case the reason for that is it is possible that I would still need your
services if something were to happen to one of the jurors that is deliberating
um what I'm going to do is I'm going to have uh Mr Sproul take you back to an
um an alternate alternate Jury Room uh because you guys have two of them back there but I want to have a conversation
with you about um some security things and some uh publicity things and also some services
that we offer so I want to have that conversation with you um uh before we discuss anything further
um and you're welcome to stay in that jury room for the rest of the day you're down here I don't know what you want to
do we can talk about that but we'll talk about all that back there I do have certificates of service for you and I
also have a questionnaire which I'm going to ask you to fill out it's something that the state of Colorado
sends out to jurors so if you would take the time to fill it out and I'll be back
to talk with you in about 10 minutes or so I'd greatly appreciate it all rise

Court is going on the record now for Jury questions in the

First Question: Can we have an index list of all exhibits

Second question: Can we have both a preliminary and final report from Dr. Lewis. Judge's proposed response is expert reports are not introduce as evidence in a trial. Allen said they were not admitted as evidence.

They are sending back the exhibit list and answer to second question. Judge says that takes care of everything at this point and time. Judge says he is still going to give 30 minutes post verdict "with some grace" if family needs more time to get into the court room.
Court is now in recess until verdict or further jury questions.

Many tears on the faces of #GannonStauch biological family members. You can hear the tears as they now learn a jury found #LeteciaStauch guilty on all charges before them.

Judge needs a half hour with jury then sentencing. Both prosecution and defense are ready. Allen: "The family has been thinking about this day for three years. They are ready for sentencing."

STAUCH SENTENCING : Jury found #leteciastauch guilty on all charges presented to them (see previous thread). Sentencing will start here in a few minutes. We could hear impact statements from loved ones.

Letecia Stauch is now being hand cuffed in the courtroom.

Allen says family members would like to speak at sentencing.

First statement is Stauch's former neighbor Nicole Mobley. She testified in the trial. "It's been heartbreaking and to finally see some justice for his family is incredible.”

Second statement Mrs. Cadenas. She's sat with the Gannon's family for the last three years as a community member in Lorson Ranch. She's thanking the judge for the fairness. "We were scared to let our kids outside, we were scared they would be kidnapped."

Third statement is Jeff Davenport, Al Stauch's uncle. "This now convicted murderer did not just murder Gannon, she murdered all of the love, joy and security he would have brought to all those he would have brought to in his life.”

Jeff Davenport, Al Stauch's uncle: "Because of her crime, all of our fragile trust in one another has been eroded."

Veronica Birkenstock, Gannon's Great Aunt is speaking now. "Nothing in life prepares you for a murder of a child, no one thinks this could happen to your family."

Veronica: "We want the court to know we have forgiven Letecia. I pray today you judge will give her what she deserves on this earth and god will give her what she deserves for eternity."

Veronica held Gannon when he was a premature baby. "He is our hero and he will always be my hero. Letecia has tried to steal many things from my niece."

Veronica: "I pray that you will give her the sentence she deserves, but I also pray God will repent her.”

Bob Rogers is Al's father-in-law. He became Gannon's grandfather after he was murdered and didn't get the chance to meet him. "We never want the spirit of Gannon and memory of Gannon to be lost. I am at a loss for words.”

Debra Pearce is Gannon's grandmother. "I feel if Gannon were here today he would say please, please protect my family and be concerned for the loss they have had.”

Landen Bullard is Gannon's biological mom. "I miss you Gannon and I love you to the moon and back and back again. I know every day you are with me in your sisters.”

Our biggest blessing came into the world weighing only 1 pound, 8 oz. "You forever changed my heart and my life and that would never change that is something that could never be taken away from me. He came into this world fighting and unfortunately he left this world fighting.”

Landen: "For three years I have tried to forgive you but I can't, I want to but no parent should have to bury your child. She has taken away the most precious gift in this world. She's destroyed dozens of lives of people who never wanted to believe she could have done this.”

Landen: "Mother to mother I trusted her with my children.”

Landen: "Even when I was fighting for my kids and you wrote a false smear campaign against me and my children, and also Al, for me I was still appreciative you still loved us, so I thought. She fooled us all.”

Landen: "I can't say she ruined my life because that would be some form of sick victory for her, because even through this process it's been a game for her.”

Landen: "How truly sick and cruel is she. You stole so much from this world.”

Landen: "Laina is missing her brother. Your honor, I've never seen a bond so close.”

Landen: "When she was attacking and killing her he fought for his life still loving her....the lack of remorse the lack of respect for Gannon in this trial...she manipulated all of us and never loved Gannon, Laina or Harley.”

"I've had to watch images no one wants left on their mind. You wanted to torture us but no one underestimates me...I will continue to hold on to my faith, I have to have trust in that...Tecia you underestimated this community.”

Landen: "Your honor I just pray you give the longest sentencing you can this will not bring my son back, but I can sleep soundly for the first time in three years knowing she can never harm again."

Al Stauch, Gannon's father is now talking. He proudly spells out father through tears.

Al Stauch: "Gannon barely filled my two hands the first time I held him, but at the end of his life, after his body was cremated to ashes he was ultimately the same size.”

Al Stauch: "It was only by the grace of god that Gannon's precious body was found.”

Al Stauch: "I am not seeking any restitution your honor.”

Al Stauch: "Speaking of Harley, I feel like I have lost two children in this tragedy.”

Al Stauch: "Laina's loss is like none I can imagine. She lost her big brother”.

Al is reading Laina's words to Tecia "You do not do that to people, especially your step kids and that it is never alright to do these things”.

Al: "Gannon I never would have in a million years thought you would be in danger bud..(he is very emotional you can feel the pain in the courtroom)..I am so sorry.”

Al and Landen just said they are sorry to each other in front of the judge.

Al is asking the judge for Letecia to be stripped of the Stauch last name immediately.

Al emotionally described the dreams he wishes Letecia experiences every night. He hopes she relieves the final moments of Gannon's final words and last breath. He wishes that Letecia would tell him Gannon's last words. You can hear the whole courtroom crying, feel the pain.

DA Allen is now addressing the judge.

Allen: "The defendant through her own actions, tore Gannon's family apart, tore this community apart, and at the same time i've never seen a community come together in the way that they did over an 11-year-old boy that most of them never knew.”

Allen says he has been a prosecutor for a long time, has never seen such horror as with this defendant.

Letecia is not going to make a statement, on the advice of counsel, according to Tolini.
Judge: "I have heard a lot, I want to take about 10 minutes to put my thoughts in order. I will come back with my sentencing at 3:25 pm.”

In the interest in getting Letecia into DOC custody as soon as possible, Allen is asking for max sentence on everything today and says the court can drop the additional case from when Letecia is accused of trying to escape from El Paso County Jail.

Al just gave me Laina’s, Gannon’s little sister’s statement to



Judge Werner: "A parent's worst nightmare is getting a phone call letting them know something has happen to their child.”

Judge Werner: "I cannot fathom the pain Mr. Stauch and Ms. Bullard have experienced as a result of the defendant's actions."

Judge to Letecia: "You took away every day that Mr. Stauch or Ms. Bullard could have had with their son. When you take a life, regardless of the way you do that, you forever alter the future.”

Judge Werner: "You betrayed your daughter Harley Hunt. I cannot imagine the emotional impact you have had on her due to your selfish and calculated actions.”

Judge Werner: "There is no evidence that she (Harley) had anything to do with the murder or your cover-up of it but some people still think she was involved, she wasn't.”

Judge Werner: "While thankfully she didn't testify, let's not forget about Laina. You betrayed her too, you took her brother from her.”

Judge Werner: "You betrayed your stepson and you took his life, you took away everything he was and everything he could ever become. I can't imagine the terror and confusion he must have felt in the last moments in his life…”.

Judge Werner: "Your claim that a mental health issue caused the murder in this case is a disservice to people who face mental health issues every day.”

Judge: "You knew what you we're doing and made a number of conscious decisions"

Judge: "It is not hard to imagine Gannon saying something 'your not my mom' 'I want my mom, I want my dad' and that would be enough to make you really angry, but anger is not an excuse.”

Judge to Letecia: "It is clear that you hated or we're jealous of Landon Bullard."

Judge: "It's clear you felt trapped, you wanted out. You were searching for a new job and career in Florida.”

Judge: "I'm also reminded of the look you had on your face when you slipped your handcuffs on the way back to the springs...I shudder to think that's the last face Gannon saw before he died."

Judge: "You have shown no remorse."

Judge: "You lied because you didn't want to face the consequences...you slipped up at various points and let kernels of truth escape.”

Judge tells Letecia, in all of her stories "you were always the victim”.

Judge: "...then you saw the mountain of evidence against you and this is a mountain the size of Everest...you carefully crafted your new story to avoid responsibility.”
Judge: "We all have free will and we all make choices based on that free will, the people that suffer from the mental disorder you claim are terrified because their free will has been taken from them...you didn't behave anything like that.”
"I have had a number of cases which have demonstrated one person's capacity of cruelty towards a human being, I can say without hesitation that facts of this case are horrific beyond what I've ever seen. “

Allen: “There’s without a doubt that Devine intervention played a role in this case.”

“God’s fingerprints are on this case” - Allen talking about Devine intervention with bridge inspectors finding Gannon’s body in Florida and blood-stained board being found in Colorado.

Allen says Letecia will never breathe a free breath again. He apologizes to Al and Landen saying the DAs office will always be there for him.

Landen says three years ago they were setting up to share the worst news that their son had died in this same room. Today, she’s here to share the best news that Letecia can not ever harm another child.

Landen is speaking about how grateful she is for the community that never game up on Gannon.

Landen: “I stand here today when I encouraged you last time to do good deeds, tell your loved ones you loved them…we are not promised tomorrow.”

Landen: “I am blessed to be Gannon’s mom, he’s done more in 11-years that many could do in a life time.”

Al: “Gannon is always with us”.

Al: “Al we saw in the courtroom today is a true win…but for me it only solidified the loss that I’ll never get to see my boy again. As we learn to move forward in our lives we will never let him go”.

Al: “The only crime Gannon committed was being a mama’s boy.”

Al says he wants to leave everyone with the word Joy. Landen and Al have found new family in those that supported the investigation and search for Gannon.

Al: “Through tragedy we will triumph…I refuse to let pain and seeking vengeance overcome me.”

Allen: “Gannon deserved every hour we spent on this case.”

Landen says she could breathe for the first time when she heard the guilty verdict. “It was the best feeling.”

The jurors in the murder trial for Letecia Stauch have asked for a list of exhibits admitted as evidence in the trial, to which the council said they will be able to get.

The jurors also asked for a preliminary report and final report from Dr. Dorothy Lewis, to which the council said jurors will not be able to get. The council said they will not be able to give that report because expert reports are not introduced as evidence.

I'm outside of the courtroom. Currently, a few dozen community members are lined up outside of the courtroom waiting to be let in. Extra security has also arrived.

My photographer who is outside the entrance of the courthouse told me the District Attorney and the Stauch family just walked in.

Prosecutors and Gannon Stauch's mother, Landon, have just walked up to the courtroom.

Al Stauch and his family have just walked into the courtroom.

Letecia Stauch is wearing pink today. Currently she is talking to her lawyers.

District Attorney Michael Allen is addressing the community members who are in the courtroom: “This family, this community and this office very much has appreciated the support this community has given.”

It's a full gallery in the courtroom for the murder trial for Letecia Stauch. Every row and seat is filled. Gannon's family is here, lawyers are here, and now we're waiting on the judge.

The Stauch family has been waiting more than three years for an answer and for justice for their little boy. Soon, the verdict will be read in the murder trial for #LeteciaStauch.

#LeteciaStauch has pleaded not guilty by reason of insanity. The jurors had to answer the question, was she sane or insane when she murdered her 11-year-old stepson Gannon?

As we're waiting for the judge to arrive, I've looked over several times to the Stauch family. Al Stauch, Gannon's father hasn't moved much. He's been looking forward the entire time.

Much of the Stauch family is currently embracing one another, patiently waiting for answers.

I'm hearing a lot of community members whispering in the courtroom. Dozens of people have showed up to show their support for Gannon Stauch and his family. Meanwhile, many in the Stauch family have remained silent this entire time.

Judge Gregory Werner has entered the courtroom.

“I know this is an emotional case, I get that, I understand that… This jury has worked hard. Regardless of if you agree with or don’t agree with their verdict, you need to exercise appropriate decorum," said Judge Werner.

The jurors have just entered the courtroom.

Al Stauch is crying, and wiping away tears. Landon Hiott is also crying and wiping away tears. Everyone in the Stauch family is embracing one another, as they’ve been waiting more than three years for justice for their little boy.

I have not seen any movement or emotion from Letecia Stauch. She's remained still the entire time.

Many gasps, emotions, and people saying the word "yes," are coming from community members in the courtroom.

There also has not been much emotion or movement from the lawyers on both sides of this case.

The jurors in this trial have just been dismissed.

The judge will be talking to jurors for about 30 minutes before going into sentencing.

Landon is giving District Attorney Michael Allen a very long, emotional hug right now. More of the family is hugging one another and embracing one another.

At least of the jurors was also wearing blue today, which is Gannon's favorite color. Blue ribbons are also tied to the outside of the courtroom doors.

Letecia Stauch is talking to her lawyer Josh Tolini right now. I still have not seen much, if any emotion from her. As the verdict was being read, she did not respond or react. She looked forward the entire time.

When discussing the sentencing and when that would happen, District Attorney Michael Allen told Judge Gregory Werner, “the family has been thinking about this day for over three years. They’re ready to go to sentencing as well.”

Judge Gregory Werner has returned to the courtroom for sentencing. Members of the family will be speaking as well.

Nicole Mobley: “I just want to initially thank you for everything you’ve done throughout all of this… This has been well over three years... To finally see some kind of justice for his family is incredible. I just want to thank you for everything that you have done.”

Jamie Cadenas: “I wanted to thank you for making this such a fair and neutral trial. I am here today as I have sit here with the family for three years… Three years ago, we heard as a neighborhood what happened and a little boy went missing.”

Cadenas: "We rallied together in a way most communities would never experience… This is the worst tragedy that anyone could go through. I have watched and held Landon as she falls apart, time after time. We are here today and Justice has been served for Gannon.”

Jack, Gannon’s great uncle: “This now convicted murder did not just murder Gannon. She murdered all of the love, joy, encouragement and security he would’ve brought to all those he would have encountered throughout this life. She murdered his children and his grandchildren.”

Veronica Berkenstock, Landon’s aunt: “Nothing in life prepares you for the murder of a child… A little over three and a half years ago, I got a call that I needed to be with Landon… We showed up for Gannon.”

Berkenstock: "I’m going to talk about forgiveness today because as a Christian, we have to talk about forgiveness… We want this court to know we have forgiven Letecia for what she did. God is the ultimate judger.”

Berkenstock: "I pray today that you will give her what she deserves on this earth. I would like to leave this bible, as she serves her life sentence… For the rest of her natural life, I hope she will read the word of God... Gannon, he is our hero and will always be our hero.”

Bob Rogers, Gannon’s grandfather: “What she (Laina) doesn’t have is an older brother to stand beside her. She still mentions Gannon quite often, her brother. We never want the spirit of Gannon or the memory of Gannon to be lost. I’m at a loss for words.”

Deborah Pearce, Gannon’s grandmother: “I just wanted to thank you, for everything that’s been done…I feel that if Gannon were here today, he would say please protect my family and make sure they’re protected as time goes on, as life goes on.”

During part of the impact statement from Al Stauch, Judge Werner put his head down, and looked as if he was becoming emotional listening to Al. District Attorney Michael Allen also wiped tears away.

After Al’s impact statement, a photo up of Gannon was left on the screen for about a minute, to which everyone looked at.
