2/17/21: Murder & escape charges: “Closed Door” Hearing was added on 2/19/21 for murder & escape charges about her request for new attorneys before Judge Will Bain. Divorce: Status conferencing hearing on 3/29/21 & permanent orders hearing on 4/30/21.
2/19/21 Update: Murder & escape charges: Judge Bain asks the attorneys to all announce their presence. A mention that Stauch is appearing via WebEx, in her jumpsuit & a mask. Now going into a private session for the conflict hearing. Judge Bain was asked to address whether there is or is not a conflict in the case. He’s not going to make that decision, and will send the case back to Judge Werner. Judge Werner’s team will schedule another advisement, potentially next week. The next hearing for Stauch will be an Arguello advisement. They are to ensure the defendant understands their rights before proceeding without an attorney into trial. An Arguello advisement, meaning the court is considering taking away her court appointed attorneys if she keeps dragging her feet. Her other options would then be hire an attorney...or represent herself. Arguello advisement hearing on 2/24/21 @ 3pm. And preliminary hearings on 3/11 & 3/12.
2/24/21 Update: Hearing moved to 2/26/21. 2/26/21 Update: 2/26/21 Update: snips from hearing: Judge Gregory Werner asks Stauch the standard questions regarding representation. Stauch says she understands she could be convicted & serve a life sentence, then she says she does not have any legal experience. Judge now explaining the difference between wanting a DIFFERENT attorney, instead of just trying to represent herself. Stauch has been answering with short “yes sir.” Defense attorney says if they want an explanation, she would need to close the hearing to the public. Judge is mulling it over. Judge is making an argument that an attorney would have more experience than her & be able to help her. Stauch- “I’ve come to find that the word expert doesn’t hold much value, and I’m the expert here” “I think that I could do it on my own sir, it’s a constitutional right.” Judge is now asking her is she understands the very basic parts of being a lawyer. Stauch says she can learn by reading some books in the meantime. Judge says “so, as of right now you can’t do this?” “Sir I know it sounds audacious...but I was very good at poker. You gotta know when to hold them or when to fold them. I wouldn’t be this confident without an ace in the hole.” Words from Stauch, That’s a rough quote. Stauch's final answer is that she wants to represent herself. The Judge asks if she wants to make this decision today, or proceed to the preliminary hearings (March 11 & 12) & then make the decision. Stauch would like to know if the prosecution can "force having the hearing." Stauch wants to waive the preliminary hearings scheduled in March. The Judge says that's not a question he was prepared to answer. He does say that neither side is required to accept a stipulation from the other side, but it is possible that even if Stauch waives the hearings, the prosecution could still present their evidence. The Judge says if Stauch waives the hearings "it may be that you're stipulating to proof evident, presumption great, and you may be convicted at trial." But, he's not asking Stauch to make that decision right now. As the Judge sees it, at this point in time, Stauch knows all her obligations (the court can't say if that's a wise decision). The court finds that Stauch has waived her right to counsel, making a knowing, voluntary, & intelligent decision to do so. The Judge says he'll appoint advisory counsel for Stauch. Stauch wants to represent herself. The Judge will not grant the defense's motion to withdraw right now. He needs to figure out a way to get all of the electronic discovery to Stauch. An accommodation that could be made is computer access in the library. The Judge says they will have a status conference next Friday, on March 5 at 8:30am to find out what evidence has been given & reviewed, and then the Judge will make the call on whether they can proceed to the proof evident, presumption great hearings. The Judge now says he'll grant the defense's motion to withdraw. We'll see where we are at 8:30, on March 5. Allen asks if they'll be addressing the issue on if she can waive the hearings. They will. "She's representing herself at this point," said the Judge.
