UPDATE: The audio is working again... Judge Gregory Werner is back in the courtroom. A deputy testified that he had learned #LeteciaStauch due to not receiving medication. "Your honor, I've refused... It's not safe for me to be in courtroom when I'm not on my medication."

Court is now addressing the mental health issue involving #LeteciaStauch. Judge says his understanding is that it is a dissociative disorder issue.

Stauch’s defense attorney says based on the information at this time, it appears that this mental issue was “brought on by acute stress” during the time *after Gannon Stauch’s murder.
Lol. Well trying to get away with murder is certainly stressful, especially when everyone knows you did it.

Stauch is now speaking. She tells Judge Werner that she has not received her medication in several days and it is “not safe for her to be in the courtroom” when she “cannot control” herself.

Judge Werner is now explaining the importance of #LeteciaStauch appearing in person moving forward. “Going forward if you decide that you don’t want to be here, I will need you to file a motion no later than 7 days before your appearance.”

Judge Werner states that if #LeteciaStauch does not cooperate moving forward he will give an order that deputies can use any and all force to get her here.

Now they are discussing #LeteciaStauch mental state. The defense is claiming she suffers from Disassociative Identity Disorder. The judge is talking about the state hospital having a 352+ waitlist as of 2 weeks ago & there is a slim chance she would get that done soon.

Prosecution now arguing there is no longer impaired mental condition, saying there needs to be an evaluation at the state hospital. @KOAA

Judge says he does not have enough information about the dissociative disorder in question: What triggered it? When was it triggered? Is it still
present or not? To restate - This is NOT a competency or insanity evaluation. @KOAA

The People argues the state hospital is a better place to have the evaluation. @KOAA

Judge now telling Stauch she will have an evaluation. She has the right to remain silent during the evaluation. It WILL be done at the state hospital, but the judge does not know when that will happen. Motions hearing is set for Jan 6, but judge is concerned about timing. @KOAA

MOTIONS WILL NOW BE JANUARY 13 AT 1:30 PM. If Stauch does not want to be here in the courtroom, she needs to file a motion 7 days prior. @KOAA

For the love of God and all things holy, is she going to tell us that Eguardo is real? And that he lives in her head? With how many others?

So she gets a free pass to not show up but LH traveled all that way. [Correction: LH was not present, per Twitter below. But still, how does T get to decide whether or not to show up?]

T is still trying to run the show.

Can't she be further charged with contempt of court? Sheesh, contempt of human decency.

Judge Werner tells #LeteciaStauch that she must be in court January 13th or must give notice at least 7 days before that. Stauch will be taken to the state hospital sometime between now and then. If she is still in Pueblo on January 13th, then the Court will re-evaluate.

The state would rather have #LeteciaStauch get the evaluation done at the state hospital rather than the jail. The judge ordered the new evaluation to be done at the state hospital. This new evaluation will be able to have info from the 2 previous competency evaluations.

Judge says he is open to suggestions on how to move this process forward faster, notes logistical problems at the state hospital regarding staffing. DA Michael Allen responds that he doesn’t believe there is a way to expedite this part.

Judge Werner has now left the courtroom. Hearing has concluded for today.

Judge says he believes #LeteciaStauch's evaluation will be "at the bottom of the list" for the state hospital. He knows they are struggling to get CNAs.

"I wish I had a solution, but I don't"

If the evaluation is not done by Jan. 13, they will postpone motions.

Judge Werner to Letecia: "I've been pretty patient with you." He goes on to tell her that she does need to appear in person sometimes. If she does not, an "extraction team" will get her here. They'll ask first, but then physically bring her after that using restraints.

When describing that team, the Judge said they have about four or five deputies and "some of them have biceps the size of my neck". She needs to file motions 7 days in advance before not appearing, or they will bring her here. He said sometimes people get injured in the process.

Letecia to Judge Werner about refusing to appear: "I have been refused my meds for the past five days, it’s not safe for me to be in the courtroom when I cannot control myself."

It appears that the defense is referring to her potentially having a generalized "dissociative disorder", they are not getting more specific than that. The prosecution is asking for this evaluation to be completed at the Colorado Mental Health Institute in Pueblo.

Here's the issue with this being performed at the CMHIP: Two weeks ago, Judge Werner got a letter on another case saying there's a 352-person waitlist for treatment there. He thinks it's grown since then. This evaluation would be less of a priority than those 352 patients.

Judge Werner: "There is slim hope of this getting done soon." They pushed her next appearance out by a week, it's now scheduled for January 13th at 1:30 PM. The judge believes they may have to push it even more if she's in Pueblo when this is scheduled to take place.

If the prosecution is planning to call an expert to testify about her mental health during the trial, he said that a written report (from a completed eval) must be disclosed 63 days before the trial -- which I think would be January 24 as her trial is scheduled for March 28 now.

What we expected out of the hearing. Rare in this case.

We learned the defense is saying #LeteciaStauch had a dissociative disorder - that’s going to be the mental health issue they plan on introducing evidence about at trial - related to actions after the alleged murder.

Based on the Judge's reaction to this allegation, I'm sure LS claim is bogus. I think it's more likely that LS disagrees with the therapeutic dosage of Rx she received and not that she was refused. She's no physician-- regardless of what she plays up in her evil head. :mad:

The evaluator will have all her files and past statements, including ones made to the court. If she refuses to even nod or shake her head in response to questions like her name, etc., she may well be found incompetent - again.

That means she'll stay in a mental institution indefinitely. Perhaps for the rest of her life. It's exactly like prison except that everyone is (very) mentally ill and often pretty dangerous.

Huh? I don't recall that LS was ever found incompetent after two evaluations. Did I miss something?
