9/22/22 Update: Stauch is now claiming her rights have been violated in a civil lawsuit filed in federal court. The lawsuit names two El Paso County Sheriff's jail guards (L. Stengle & R. Snipe), a food service provider (Trinity Food Services) & medical service (WellPath) in the jail. Stauch says her 1st Amendment rights were violated when she experienced problems with her pre-approved kosher foods in jail. She claims meals were "not wrapped appropriately" & that non-kosher items were placed in her diet. According to the lawsuit filed on September 22, Stauch says she attempted to alert multiple jail deputies of this since August 2021. She claims no steps were taken to fix the supposed contamination of the kosher foods. Stauch's second claim is that her 8th Amendment rights were violated by the jail's medical provider. According to the lawsuit, Stauch says the medication that was given to her to treat stomach issues & constipation was not working in November 2021. Stauch claims she has suffered from a "leaky gut & abdominal pain." In addition to that, she says has blood in her stool seven or more days a month. The lawsuit says she requested to be checked by a doctor for multiple months in early 2022. Doctor visits, she claims, never happened. The civil suit will call into question her defense team's insanity argument. 9/23/22 Update: Order: Granting leave to Proceed by Magistrate Judge Gordon P. Gallagher. Evidentiary hearing on 10/13/22 & review hearing re escape attempt on 10/13/22 also.
10/13/22 Update: The defense has withdrawn a request for a medical exam at the state mental hospital in Pueblo & will instead have a defense-retained expert conduct testing at the El Paso County Jail by December (in October or November). The move to a spring trial date means there are other new hearing dates in this case. The deadline for all motions to be filed by 12/22/22 with those motions being considered in February, 2023. Trial is set for 3/20/23. District Attorney Michael Allen said the defense had requested for the trial to take place without a jury, but that the prosecution would not consent to that request. As a result, Stauch will have to face a jury. Judge Werner said he anticipated the jury trial lasting about six weeks. She was in the courtroom today for the hearing & informed the judge she would not be answering any questions, according to her defense counsel. Despite that statement, the judge confirmed with attorneys that "the clock for a speedy trial" will not start until the requests reviews & tests are complete in December. These evaluations are meant to determine Stauch's sanity at the time of the alleged crime, not her competency to stand trial. She has been found competent to stand trial twice. Stauch claims she's been mistreated while in jail by claiming she was not properly given kosher food & that the jail neglected to give her medical care. Currently, the case is in the initial review period with the court. A judge will decide if the case should be dismissed or if it should proceed. Next motions hearing on 2/2/23 @ 1:30pm & pretrial readiness hearing on 3/9/23, with review hearings re escape attempt on the same days.
12/12/22: Defendant's Waiver of a Jury Trial & request to proceed with Court Trial. State's Do not consent to defendant's waiver to Jury Trial & should be denied.
12/28/22 Update: Attorneys representing El Paso County & two El Paso County sheriff's deputies filed a motion in federal court on Wednesday to dismiss a lawsuit filed by Stauch. The lawsuit, filed on Sept. 22, 2022 claims El Paso County, the jail's food provider, a pair of El Paso County sheriff's deputies & the jail's medical provider had mistreated Stauch & violated her First & Eighth Amendment rights, which protect the freedom of religion & protect against cruel & unusual punishment, respectively. The motion states that even if Stauch's First Amendment rights had been violated that the two named deputies specifically could not be responsible for any such violation. The motion also says El Paso County should not be named as a defendant because it does not have control over the jail; rather, the Sheriff's Office does. Magistrate Judge Shane Kato Crews has yet to make a ruling on the motion.
1/12/23: People's Motion for Discovery concerning defense experts pursuant to Crim. P. 16(II(b) & CRS 16-8-106(2). People's attachment A to People's Motion for Discovery re defense experts re sanity evaluation. 1/23/21: [O-25] Matters to discuss at 2/2/23 hearing. All motions were to have been filed by 12/15/22. Defendant previously filed a motion for change of venue & a motion to waive jury trial. Those motions remain outstanding. The Court did not receive any other motions by the deadline imposed by the Court. Defense's report from the 2nd evaluation has not been received by DA. Jury selection to commence on 3/20/23. Court will discuss mechanics of jury selection. Counsel should be prepared to discuss anticipated length of time for presentation of evidence for trial. The proposed venire will need to be advised of the potential witnesses in this case. The court will discuss media restrictions with counsel Filed by District Court Judge Gregory R. Werner.

BBM

Not going to happen, early on in the first few weeks of this case I said LS would drag this out and do everything in her power to cause chaos and confusion.

LS will never do the right thing, she's innocent (in her mind), she's spiteful, and she has no respect for sweet Gannon, his family or even her family. She is truly a monster.

MOO
It’s her MO.

Wonder if she's will show up on her own or if they gotta bring her kicking and screaming. I'd prefer her in a straight jacket in a wheelchair with a gag. But that's my preference.
LOL. I just had a picture in my mind of LS in a straight jacket in a wheelchair with a gag and couldn’t help but laugh. No offense Leticia but my sympathy is for Gannon and the ones who loved him and miss him terribly.
