Patrick Frazee to appear in court Friday for motions hearing
Patrick Frazee, the man accused of killing his fiancée Kelsey Berreth, is set to appear in court for a motions hearing Friday afternoon.

We’re expecting to learn the outcome of two motions filed in the case. As of Friday, Frazee has still not seen the probable cause affidavit in the case against him, but prosecutors said they wanted to keep him from seeing the documents, calling it an active investigation.

Prosecutors also motioned on Monday to allow consumptive evidence testing in the case. News 5 asked former El Paso County detective Mark Pfoff what consumptive testing means.

“You’re usually looking at some form of body fluids, whether it’s blood or saliva or something like that,” Pfoff said.

Pfoff said the amount of evidence is so small, it’s likely not visible to the eye — meaning testing that evidence once tested would prevent any follow-up testing moving forward.

The hearing comes as NBC News reports that the Twin Falls Sheriff’s Office is investigating a 32-year-old nurse who might have disposed of Berreth’s phone.

Idaho Woman Under Investigation in Case of Missing Colorado Mom Kelsey Berreth: Reports
Authorities are investigating an Idaho woman in connection with the the suspected killing of missing 29-year-old Colorado mother Kelsey Berreth.

According to multiple news outlets including CNN and ABC News, authorities suspect that the Idaho woman had something to do with disposing of Berreth’s phone.

It is unclear if the unidentified Idaho woman is connected to Frazee.

PEOPLE reached out to multiple law enforcement agencies, but authorities are not disclosing information about the woman. “Unfortunately we cannot provide comment as the case is active and ongoing,” FBI spokeswoman Amy E. Meyer tells PEOPLE.

A spokeswoman from the District Attorney’s office also had no comment, telling PEOPLE, “this case is under seal.”

According to the documents, prosecutors filed two murder counts because they have two theories about how the presumed killing may have taken place: either Frazee killed Berreth by himself, or he and someone else allegedly tried to rob Berreth before she was killed.

Tamra Freeman told CNN that Frazee and Berreth had split back on New Year's Day in 2018, just three months after the couple welcomed daughter Kaylee.

That contradicts comments made by Berreth's aunt suggesting that her niece had broken up with Frazee on November 22, the day she was last seen in public.

Frazee was in court on Thursday for a custody hearing regarding his daughter Kaylee, and both his mother Sheila and sister Erin stood by his side in a show of support.

The two women were seen exiting the courthouse, and did not stop to speak with any of the media assembled outside.

Frazee also has an older brother Sean who is a law enforcement officer with the El Paso Sheriff's Office.

DailyMail.com spoke with two people who know the nurse professionally, and they both said that they had been told that Frazee was having an affair with the woman.

The woman was divorced from her husband a few years back, they explained, and had met Frazee at a rodeo.

Neither of those individuals knew exactly when the relationship started, but they believed it could have been as early as 2016 - prior to the birth of Frazee's daughter with Kelsey Berreth.

One of the the people DailyMail.com spoke with also said that the nurse was in Colorado around Thanksgiving.

Prosecutors in Kelsey Berreth murder case say evidence set for testing is no longer critical to the investigation
Prosecutors in the murder case against Patrick Frazee have agreed to unseal the arrest affidavit and share it with the defendant and his lawyers, but it will not be released to the public.

In the courtroom, which was closed to cameras, prosecutors reportedly said that a small amount of evidence previously believed to be significant was no longer considered critical to the investigation. It is not known what type of evidence was being considered for consumptive testing, which reportedly would have destroyed the evidence given its small size.

According to the KOAA reporter, a judge will rule on testing the evidence at an upcoming pre-trial hearing, originally scheduled for January 29, but Frazee’s defense has reportedly asked to delay the hearing until mid-February.
