Search at landfill for Kelsey Berreth's remains about 40% complete
The Woodland Park Police Department says investigators haven't found Kelsey Berreth's remains at a Midway Landfill after more than a month of searching, but they've still got a lot to sift through.

The department gave an update on Thursday saying that investigators are about "35 to 40% of the way" through a cell at the landfill that was identified as the search area. That area is about 250 feet by 125 feet and is 25 feet deep. Officers say the refuse is compressed, which is slowing down the search.

Kelsey Berreth murder case: Patrick Frazee expected to enter plea
Patrick Frazee is expected to enter his plea Friday morning to murder charges accusing him of tricking fiancée Kelsey Berreth into wearing a blindfold for a candle-sniffing game inside her Woodland Park townhome and then allegedly pummeling her in the head with a bat.

The 32-year-old Frazee has largely sat stoically at a defense table inside a historic courthouse in Cripple Creek during previous hearings, but now he has a chance to respond to allegations he struck the mother of his child so fiercely on Thanksgiving Day that whole teeth shot out of her mouth.

Authorities have spent weeks picking through decaying garbage at a landfill searching for Berreth’s remains but they have not found any.

Although Lee is the star witness in the case, a small army of state, federal and local law enforcement officers and forensic scientists have built a mountain of corroborating evidence that seems to support her allegations and dispute comments Frazee made about Berreth’s disappearance.

Judge postpones arraignment hearing for Patrick Frazee
A judge agreed Friday to postpone the arraignment hearing for a man suspecting of bludgeoning his fiancee to death with a baseball bat and burning her body in his Teller County Ranch.

Patrick Frazee, 32, was expected to enter his plea deal Friday morning in Cripple Creek. His attorney requested the hearing be delayed because of new information.

Prosecutors did not object, either. Jennifer Viehman said, "there are a number of items that are being forensically tested."

“We have some potential destructive testing of some of the physical evidence," said 4th Judicial District Attorney Dan May.

Almost every homicide case takes about a year to get to trial after the person accused is arrested in this district, May said after the session. Because Frazee was arrested in December, that provides a better look at the timeline for this case, he said.

Some of the evidence in the case not been tested yet, he said, and other items might need further testing. The defense and prosecutors look at pieces of evidence independently, he said. In some cases, a piece of evidence can only be tested once, so the two parties are working on how they can both observe the testing. They are working out those procedures, May said.

May said he can't comment on if Frazee could face the death penalty or not, since those decisions come after an arraignment. Should Frazee enter a not guilty plea, prosecutors have nine weeks to decide if it's a death penalty case, he said.

Petition started seeking additional charges in Kelsey Berreth murder case
An online petition seeking to add additional charges against conspirators in the case of a Colorado mom and Warden native who is presumed to be dead is nearing 1,700 signatures.

Kenney copped a plea and entered a guilty plea to a single felony count of tampering with physical evidence in early February. Per the plea deal, Kenney agreed to testify against Frazee during his trial. Frazee is scheduled for arraignment on a slew of charges, including two counts of first-degree murder, on May 24.

On April 11 supporters of justice for Berreth created an online petition to request the Attorney General of Colorado and the federal Office on Violence Against Women file federal charges of conspiracy to commit murder against Kenney, as well as other conspirators she named in the testimony she gave to investigators.

Authorities finish searching landfill for Kelsey Berreth; no remains found
FOUNTAIN, Colo. — Authorities have finished searching for the remains of Kelsey Berreth in a landfill south of Colorado Springs. Her body was not found, the Woodland Park Police Department said via Facebook Wednesday afternoon.

Investigators also did not find evidence related to Berreth’s death.

WPPD Chief Miles De Young said that a lack of items like discarded mail and local newspapers led him to believe continuing the search would be imprudent.

“This is not the outcome that we hoped for, but we knew going into this search that there was a chance we would not locate Kelsey or evidence related to her disappearance,” De Young said in a press release.

The department said that prior to conducting the search, NecroSearch International narrowed the search area to 135′ x 32′ x 13.25′ Law enforcement officials and other experts have completed a highly detailed search of an area approximately 65′ x 32′ x 13′ deep with no success, according to Woodland Park Police. This was the primary search area identified by NecroSearch International as having the highest probability of locating evidence relating to Kelsey’s disappearance.

"Not finding Berreth's body could make convicting Frazee more difficult, potentially raising seeds of doubt in jurors' minds about whether the victim is still alive, said defense attorney Shimon Kohn of Colorado Springs, who is not involved in the Berreth case.

"It's definitely a victory for the defense — a small victory, but a victory nonetheless — because now, there will always be that residual doubt in the jurors' minds," Kohn said.

Kohn compared it to the movie "Gone Girl," in which a man is accused of killing his wife who has gone missing. In the movie, it is ultimately discovered that the wife was alive and trying to frame her husband for murder.

"Of course, a real-life case can't be compared to a movie, but jurors have watched movies, and there will always be that residual doubt whether she's still alive and just ran off and left her child behind — which may be unlikely, may not be. I don't know anything about the case other than what I've read about it.

"As far as the defense goes, there will be a residual doubt in the jurors' minds, potentially, whether what the testimony and the evidence that it points to is accurate or not.""
