Frazee murder trial: Blood found in apartment confirmed to be Kelsey Berreth's - KRDO

The expert witness said that the samples were all at least "46 septillion times" more likely to be Kelsey Berreth's blood than blood from an unknown individual.

A second witness called to the stand was a board certified forensic anthropologist and PhD. She discussed her analysis of two tooth fragments found in Berreth's apartment.

The second witness told the courtroom that the fragments were likely human, and had likely been broken as a result of blunt force trauma.

The larger of the fragments was only 5 millimeters, so the witness said she could not be certain that the fragments came from the same tooth.

CBI forensic serologist explains DNA evidence found at Berreth townhome

Lindsay Roup, a forensic serologist for the CBI, testified about the DNA evidence collected from Berreth's townhome and how the items were tested.

Roup said the toilet in the home tested positive for blood, along with other areas of the bathroom: Swabs from the wall, under the towel rack, the sink, the side of the tub and the door.

Previous townhome owner testifies about blood in home

The early afternoon testimony centered on the blood discovered inside Berreth's townhome — and who it belonged to.

Sue Gorney, the previous owner of Berreth's townhome, took the stand after court resumed on Wednesday afternoon. Gorney testified that she had lived in the townhome primarily alone for 26 years, aside from having a roommate for the first five months. She sold it to Berreth on May 11, 2018.

Gorney said she was moved out of the home by the end of April and had vacuumed and mopped the floors and wiped down the walls, cabinets and appliances.

Forensic expert: Confident tooth fragment was human

Diane France, a forensic anthropologist and adjunt professor at Colorado State University, was called to the stand as an expert in forensic anthropology.

France said she went through "her extensive remains collection" and determined that the tooth was consistent with a human tooth. She said it definitely did not belong to a dog, horse or elk.

Frazee's attorney Adam Stiegerwald cross-examined France and referenced that she had said she was 80 percent confident it was a human tooth.

CBI forensic scientist: Blood found in townhome was likely Berreth's

Caitlin Rogers, a forensic scientist with the CBI who specializes in DNA analysis, testified about the evidence items that were tested at the CBI's Pueblo lab.

When Viehman asked if it was fair to say Berreth was the main contributor to this blood spot, Rogers said yes.

CBI scientist: Tooth fragments tested positive for human DNA

[..]

Viehman asked Rogers about her tests on a sample of hay from Nash Ranch. The hay tested negative for blood and did not detect human DNA.

Prosecutors then returned to the possible tooth fragment found on Frazee's property.

Rogers said she analyzed the fragment, which tested negative for blood and saliva. But a DNA test detected human DNA and not from a male, Rogers said. She tried to develop a DNA profile from the fragment, but there wasn't enough DNA available.

The trial will resume at 8:30 a.m. Thursday. Fourth Judicial District Attorney Dan May said he expects the prosecution will be able to wrap their witnesses Thursday. One witness, who will arrive in Colorado from out of state on Thursday morning, is their second-to-last witness, May said. At the latest, they will rest their case Friday morning, he said. Defense attorney Adam Stiegerwald said he also anticipates closing statements on Friday afternoon after their witnesses.

When Judge Sells asked how much time they'll need for closing statements, May said about 30 minutes for the prosecution and Stiegerwald said an hour for the defense.

Human tooth found near burn site on Kelsey Berreth murder suspect’s property, expert says
Late last year, law enforcement unearthed a burn site that had been covered with gravel on Frazee’s Florissant ranch, and an arson investigator testified there’s evidence it contained both melted black plastic and possible human remains.

While sifting through the charred area, investigators found a fragment that appeared to be a tooth. Later, they sent it to Dr. Diane France, a forensic anthropologist who regularly analyzes cases in Colorado.

“I think this is a human tooth,” France said.

After France analyzed the tooth, it was sent to the Colorado Bureau of Investigation, which attempted to conduct a DNA test.

Caitlin Rogers, a forensic scientist with the CBI, was in charge of that analysis. She also took the witness stand on Wednesday afternoon, and said that when she swabbed the tooth, she was able to find evidence of human DNA.

“I attempted to develop a DNA in the profile and unfortunately there was not enough DNA present in the profile,” she said.

The tooth was later sent to the FBI for what’s known as mitochondrial testing. This test also proved unsuccessful because scientists said there simply wasn’t enough DNA left on the tooth to gather any information.

Rogers also testified about the DNA found on various items in Berreth’s condo that tested positive for blood. This included near the fireplace, on the baby gate, two chairs that had been used as a TV stand, and on the floorboards.

The prosecution pointed to samples that contained Berreth’s DNA, though some of those swabs also included DNA that likely belonged to Frazee, Berreth’s mother and brother, and the last woman who lived in the condo.

Five of Berreth’s former coworkers and supervisors at Doss Aviation also took the witness stand Wednesday, the eighth day of testimony in the trial. One witness even pointed to a potential motive in the alleged crime.

The former manager of human resources, Jennifer Barks, said Berreth listed Frazee as the beneficiary of her life insurance policy at some point during her work at the Pueblo pilot instructor program. But Barks said Berreth’s life insurance may not have been active because the company changed ownership about the same time that Berreth was reported missing and she never enrolled in the new owner’s life insurance program, Barks said.

Prosecutors also asked Berreth’s coworkers if they ever saw signs that Berreth had problems with drugs or alcohol, as Frazee had told multiple people in Teller County. Each said they saw no such signs.


Her coworkers also said that Berreth loved being a mother to her and Frazee’s daughter, Kaylee, and that Berreth never talked about giving up custody of the child. Frazee told others that Berreth had given up all her rights to the child and abused the girl.

Frazee told multiple people that Berreth went to rehab for addiction, testimony on Tuesday showed. But Berreth’s friends said that wasn’t true.
One friend, Peter Sergev, said that Berreth went to California for some days in 2018 for treatment for depression and anxiety.

Her coworkers described Berreth as a hardworking, sweet young woman who did not often speak of her private life.

“She was quite a strong woman,
” said Carolyn Sharp, a pilot instructor at Doss who worked with Berreth.

Late last year, law enforcement unearthed a burn site that had been covered with gravel on Frazee’s Florissant ranch, and an arson investigator testified there’s evidence it contained both melted black plastic and possible human remains.

While sifting through the charred area, investigators found a fragment that appeared to be a tooth. Later, they sent it to Dr. Diane France, a forensic anthropologist who regularly analyzes cases in Colorado.

She was called to the witness stand on Wednesday as an expert in her field. France said she was able to rule out the possibility the tooth belonged to the horses, cattle, dogs, deer and elk that were also known to be on the Frazee family’s mountain ranch.

“I think this is a human tooth,” France said.

FRAZEE TRIAL DAY 9 LUNCHTIME NOTES:
• CBI DNA analyst Caitlin Rogers retook the stand for cross-examination. Defense attorney Adam Stiegerwald had her run through several evidence items taken from Berreth’s townhome. He points out that Krystal Kenney’s DNA is never found on any of the evidence. Also, when Frazee’s DNA is found on two separate parts of the torn up living room floorboards, the level of certainty is significantly lower compared to Berreth’s DNA.
• On redirect, lead prosecutor Jennifer Viehman asked Rogers if she was surprised at the absence of Kenney’s DNA. Knowing Kenney wore protective clothing and used bleach, Rogers testified she wasn’t surprised. She notes they use bleach at the CBI lab to sterilize their stations.
• A Teller County DHS worker testified on her Dec. 26 interview of Frazee. This was done to gather information for a custody decision on the couple’s daughter. She didn’t offer much new information — saying Frazee said they were working on co-parenting and that Berreth wanted to go their separate ways.
• CBI Agent Gregg Slater, one of the lead law agents on the case, also retook the stand. He says he doesn’t know where this investigation would be without Kenney coming forward to cooperate. Stiegerwald was quick to point out (again) Kenney didn’t offer her full interview until the plea deal was signed. On redirect, Viehman clarifies that Kenney offered a brief initial statement before the plea deal was signed.
• We’re waiting on a witness that flew in this morning. Court will resume at 1 p.m. MT.
