Prosecution rests after closing statements in Patrick Frazee trial
The prosecution has rested following closing statements in the trial of Patrick Frazee.

The day began with Judge Scott Sells instructing seven female and five male jurors how to proceed their deliberation, only considering the facts of this case, and having no communication or research about the trial to influence a decision. Frazee wore a blue-stripped-dress shirt, staring at the jurors during instruction.

Assistant District Attorney Elizabeth Reed stood up slowly in the courtroom. “We all wish Kelsey Berreth could walk through that door right now,” she said. “That’s never going to happen.”

Reed laid out Berreth’s final known actions. Conversations with co-workers about a Christmas party, and whether Frazee would attend, going to Walmart to buy medication for Frazee in the middle of the night, because he had fallen ill.

“While Kelsey Berreth is planning the future, this man was plotting her murder for months. Months!” As she points directly at Frazee. “This is not consistent with someone who’s going to walk off and leave her child. Not consistent with someone who is suicidal. It’s consistent with someone who is planning the future with the man she plans to marry.”

Reed went slide after slide, poking holes in Frazee’s timeline of events. He was seen with video surveillance at the Federal Credit Union and Walmart in town. According to Frazee, at 2:45 p.m. he went back to Florrisant to check on his cattle.

“He’s not home for Thanksgiving Dinner, he’s in Woodland Park because he just killed Kelsey Berreth,” Reed said, pointing towards cellphone records that show Frazee’s phone pinged off a cellphone tower in Woodland Park at that time.

“Kelsey Berreth is in that box. Her beaten and battered body is in that box,” Reed said. “He’s taking it back to his house because he’s going to eat Thanksgiving Dinner with Berreth in his truck.”

“Second degree murder does not apply in this case,” Reed said. “There is nothing about this case that screams degree murder. Everything is premeditated. Everything is deliberated. Do not check that box on your verdict.”

“She didn’t have to come forward at all, but when she did come forward she told us everything,” Reed said. “Including the things that subject her to criminal prosecution.” Reed continued by saying everything Lee said can be backed up by evidence. “Everything the defendant said is contradicted by the evidence.”

... The defense will likely attack the credibility of the prosecution’s key witness and focus on the lack of a body, murder weapon and other physical evidence directly tying Frazee to the crime.

Reed did not expound on one particular motive Frazee may have had, but instead outlined many possibilities. She said maybe Frazee killed Berreth because he didn’t want to pay child support or because he wanted to assure he would have sole custody of their young daughter, Kaylee. Reed told the jury they didn’t have to agree on the verdict but that the prosecution had proved the murder beyond a reasonable doubt.

“Do you know how much of the defendant’s story is corroborated by the evidence?” Reed said. “Zero. None.”

Reed walked the jury through the evidence showing where Frazee, Berreth and Kenney’s phones were between Thanksgiving Day and Nov. 25. The phone data – some of the prosecution’s strongest evidence for their case – contradicts Frazee’s timeline he gave to law enforcement and is consistent with Kenney’s account.

The prosecutor also highlighted the fact that Frazee never attempted to contact Berreth even as a nationally publicized search for her began.

The separate first-degree murder charges represent two different legal theories. To convict Frazee of first-degree murder after deliberation, the jury will have to find that Frazee decided to kill Berreth and, after reflection, acted on his plan. Second-degree murder does not require the prosecution to prove prior thought before the killing and manslaughter charges only require that one person recklessly killed another.

Reed, the prosecutor, forcefully told the jury to convict on first-degree murder and not any lesser charge. She said the state had presented ample evidence that Frazee planned to kill Berreth, including trying to convince Kenney to kill her.

“Do not fall down the rabbit hole of second-degree murder,” Reed said.

More than 100 spectators, news reporters and family members of both Frazee and Berreth filled the wooden seats of the Teller County courtroom Monday morning to hear the end of the case. A line started to form outside the Cripple Creek courthouse as early as 6 a.m. — two hours before the doors opened.

There are six forms of verdict in this case.
  • Verdict count 1– murder in first degree after deliberation. They answer questions: did he use or threaten use of deadly weapon, did defendant cause death. Both should be signed if guilty. Only one if not guilty. Prosecutors must prove beyond a reasonable doubt.
  • Verdict count 2 — solicitation to commit first degree murder (allegations he told Kenney to poison a coffee for Berreth on Sept 23).
  • Verdict count 3 — murder in first degree felony murder. They answer questions: did defendant use or threaten use of deadly weapon, did defendant cause death. One signed if not guilty. Both if found guilty. Prosecutors must prove beyond reasonable doubt.
  • Verdict count 4 — solicitation to commit first degree murder (allegations he told Kenney to kill Berreth with a bat on Oct 21).
  • Verdict count 5 — solicitation to commit first degree murder (allegations he told Kenney to kill Berreth with a pipe on Oct 15).
  • Verdict count 6 — tampering with deceased human body.

Patrick Frazee trial: 'Sick plot' resulted in fiancee's brutal death by baseball bat, prosecutor says
Patrick Frazee had one thing on his mind last Thanksgiving as he ran errands with the mother of his child, prosecutors say — and it wasn’t a holiday dinner.

“While Kelsey Berreth is planning a future, the defendant — this man, this man — is plotting her death,” said prosecutor Beth Reed, jabbing her finger in the defendant's direction during closing remarks at his nationally watched trial.

"The evidence is compelling. It is overwhelming, and the defendant is guilty."

“Do not check reckless manslaughter!” Reed barked as she encouraged the panel to convict Frazee, 33, of the top charge, with its automatic life sentence in prison.

Accusing Frazee of a long record of manipulation and lies, Reed frequently turned Frazee’s alleged words against him.

When one of Frazee’s friends suggested the missing Berreth might resurface, Frazee allegedly told her, “She’s never coming back,” Reed reminded the jury.

To a different friend, Frazee allegedly said he knew the secret to murder, reportedly telling him, "No body, no crime."

And when Frazee arrived late to his home on the holiday, he felt sorry for himself for having to celebrate under a cloud, she said.

“You know how hard it was to eat Thanksgiving Dinner while Kelsey’s in the truck?” Reed said, quoting words attributed to him by his mistress, Krystal Lee, who say Berreth's remains were in a plastic storage bin in the truck bed.

'Premeditated, cold and cruel': Prosecutors' final arguments in murder trial
As the trial of a Colorado man accused of killing his fiancee came to a close, prosecutors Monday described the case as a "deliberate, premeditated, cold and cruel murder."

In closing arguments on Monday, prosecutors said Frazee knew Berreth, 29, was dead because he never attempted to contact her after Nov. 25, 2018.

Prosecutor Beth Reid also reminded the jury that Frazee was captured on a neighbor's surveillance camera outside Berreth's condo at the same time he claimed he was 40 miles away tending to his cattle.

Notably, Patrick Frazee’s public defender called him a fool and stupid, but said that’s not reason alone to convict him. He was talking about the jailhouse notes where Frazee apparently asked for help killing key witnesses in the case.

The defense argued there is no blood or DNA evidence found on Patrick Frazee. His DNA wasn’t found in Kelseys condo either. There is no video of him leaving her condo with a black tote. Krystal is also never seen on surveillance coming or going from the condo.

Looking back at my notes, here's a very choice quote from #PatrickFrazee's public defender: “He acts a fool, and he starts to freak out in 11 months of waiting... “It’s proof of him being an idiot, it’s not proof he committed a murder, it’s not proof he killed Kelsey.”
