*Hearing on Advisement (@ 8:15am MT) - CO – Rita Gutierrez-Garcia (34) (was last seen at 2:30 a.m. March 18, 2018, in a parking lot in the 300 block of Coffman Str. in Longmont; has not been found) – *Juan Jose Figueroa, Jr. (29 @ time of crime/32) indicted & charged (4/6/21) with 1st degree murder after deliberation, 1st degree murder felony murder & 2nd degree kidnapping.
Figueroa was last person to speak with Rita. The indictment also states that investigators found DNA evidence that confirms Gutierrez-Garcia was in Figueroa’s pickup. Cellphone data from early March 18, 2018, also shows that her cellphone traveled the same path as the pickup until it was turned off at 3:10 a.m., just after Longmont Police dispatch received a hang-up 911 call at 3:07 a.m. Dispatchers tried calling back twice but got no answer. He was a Person of interest named by LE in July, 2018.
Figueroa was convicted (5/29/18) of sexual assault involving submission against will with serious bodily injury, sexual assault on a physically helpless victim with serious bodily injury, sexual assault involving submission against will with force and threats, sexual assault on a physically helpless victim, attempted second-degree murder, & two counts of first-degree assault in 11/25/17. Sentenced to 93 years to life in prison.
6/4/21 Update: Figueroa told a cellmate that he strangled Rita & burned his clothing in his sister's fireplace, according to a grand jury indictment. The indictment was returned this week against Juan Jose Figueroa on the following charges: First-degree murder after deliberation, first-degree murder felony murder & second-degree kidnapping. Figueroa was sentenced in May 2019 to 93 years in prison on numerous counts in a separate, unrelated sexual assault case. He's currently housed in the Colorado Dept. of Corrections & it is unclear when it might be transferred to Boulder County to face charges due to COVID-19.

Times Call/Daily Camera makes me crazy this way.

"Figueroa on Wednesday appeared in Boulder District Court virtually from prison and pleaded not guilty to the charges and was set for trial on April 11.


Prosecutors and defense attorneys asked that the case be set for a three-week trial, but Boulder District Judge Thomas Mulvahill said he wanted the attorneys to try and shorten that time frame.


“That seems exceedingly long, even for a case of this nature,” Mulvahill said.


In order to allow for the April trial setting, Figueroa waived his speedy trial rights, which would normally require his trial be set within six months of his plea.


Figueroa told Mulvahill the move to delay his trial was “a hard decision,” but said he was OK with the later date, as his defense attorney Jenna Kruszka said it would allow her to provide more effective representation."

The remains of a woman missing for more than four years have been positively identified, the district attorney’s office and Longmont Public Services said Thursday.

I noticed that the article posted above said his next hearing was on 6/3/22 & I had 7/12. Here's an update from the court site.

Also - articles says: His next court date is 6/3/22 for a dispositional hearing for a guilty plea and sentencing.

I'm wondering - did he already plead guilty - or he will at the hearing??
