True that! Barry could have killed her easily with his bare hands. So why was the darn .22 shell on the floor in the bedroom and on Suzanne’s side of the bed? I’m wondering now if she ran to the bedroom, locked herself in and was going for a gun when Barry busted the door open. Maybe the gun wasn’t loaded and she was trying to load a cartridge and dropped one and Barry didn’t see it. Maybe it rolled under the bed? I need to get my mind of this. I just think it’s kind of a big deal or clue that this .22 shell was found where it was.

We know BM was an avid hunter; I wouldn't be surprised if there were guns on both sides of the master bedroom bed.

Yes, journal is thought to have been burned in the fireplace. I'm saying that if the door was busted at some other time, I'm feel sure that SM would have put that even into the journal.
I think that Suzanne would have taken a photo of it and sent it to JL or SO with an explanation of how it happened.

Busting in a door would be traumatic. To me, the only reason that Barry would do it would be during an argument or pursuit to get at Suzanne.

Lol :D Maybe he wanted toT talk to her about purchasing an extended warranty.
The only way that we would know this for sure is to see the nonstop calls on her phone, which just so happens to be missing. Oh, that's probably why. The same extended warranty person who rifled through her vehicle also stole her phone as part of his coverup. ;)

When did LE pick up Suzanne's Range Rover? Was it already sold and in Indiana by then?
I was wondering about that too. You can hire people to drive your car across country. But I’m pretty sure LE impounded all their cars and would have had to release the RR back to Barry before he could sell it.

as per Order Regarding Defense Motion to Limit Public Access Court Records Already Filed [05-14-21]

2. Until the court resolves the Motion, the arrest affidavit, the Motion and any response to the Motion are to remain inaccessible to the public.

signed Patrick W. Murphy

I stand corrected. Until the AA is unsealed then released, we really don't know which judge signed it.

My apologies.

So the defence is implying that a serial sexual offender hopped into Suzanne's RR - left partial prints on glove box, cushion in rear and somewhere else, but NOT on a door handle or ANY other part of the vehicle or anything else that was present in the vehicle?

@Lilypad13 said:
Does the defense want us to believe some sexual predator abducted Suzanne in her Range Rover, tossed the bike, raped & killed Suzanne and then returned the RR to her house?! Where there could be a security camera? And wiped all prints & DNA from everywhere except the glove box? That’s just ridiculous. If anything I would think it could indicate Barry hired a hit man so why are they pressing this issue? o_O MOO[/QUOTE]

Yes IMO that’s exactly what they want us to believe.
Never mind that these types typically don’t remove dead bodies from the scene and conceal them so well never to be found. Nor do hitmen.

The whole reasoning is something only a lawyer could come up with- That there is no evidence its not a match. We are all partial matches to every criminal in the system at some level- every locus in the genome they interrogate has a frequency in the population, some are more variable than others. You can only get a match when its astronomically unlikely to be anybody else because you match all of the alleles that were interrogated. Just because you match one or two alleles to a random person does not mean that its more likely to be that person vs any of the other people who matched those alleles, including people who are not in the database.
So they basically could have had 300 "matches" and then only chose to mention the 3 that had sexual assault cases.

I think I understand this because I did 23 and me and it shows I have all these family matches an most are 2nd cousins or less.. like 4th cousins based on 3 or 4 segments matching. If that is what is going on here, then that is 100% ridiculous and should not be mentioned to try to suggest something else.

  • #591
It’s my understanding that his best chance at bond is if the Judge lowers it to M2, which I think defense will request, based on the fact they already requested it once before.
I am so confused as to why they would want a lesser charge instead of dropped charges? They could have said there was not enough there to charge him with her disappearance, but they haven't that I'm aware of?
Someone please help me with this. The charges reduced*, I understand that bond would be granted, but dropping everything about her disappearance would be better or no?

Defense says the DNA profile matches that from an unsolved sexual assault case was from Tempe, Arizona outside a convenience store. DNA was uncovered to see who the suspect was in that case and to see if it had any relation to the disappearance of #SuzanneMorphew

Lauren Scharf
@LaurenScharfTV
The matches are from Pheonix, Chicago, and Tempe, Arizona. Tempe case was looked into in Dec. 2020. Cahill contacted the investigator in charge of the attempted sexual assault outside a local convenience store. However, the Tempe case had two suspects.

Defense noted before we took the break that Agent Cahill is set to be their last witness.

They'll have it more clear in time for trial. ;)

I think this is exactly what the defense wants, confusion, and it will be presented as such at trial.

One of the sexual assaults occurred outside of a convenience store in Tempe. Judge overrules an objection reminding courtroom that the defense is allowed to question further in a proof evident presumption great hearing. Cahill then agrees the assault happened outside a conv store
So it's a reported assault. I wonder if the victim can clarify for LE what the perp looked like. moo

I think it's interesting that a whole slew of witnesses that were barely mentioned or not mentioned.

Steve on Crime Talk mentioned that there was a middle of the night phone call to CC. We know SO had more to say. MG was the only witness used very much at trial - but she had already gone public.

The bleach in the hotel hypothesis seems to be irrelevant now.

There were several points at which the daughters could have helped the case, but their testimony was not mentioned. For example, the burnt journal-like book in the fireplace still had some visible binding. Did not either of the daughters try to identify it?

We heard very little to nothing about Suzanne's daily habits, except from MH at the beginning.

I am saddened to learn that LE apparently did not test the coffee mug or the plate/silverware in the dishwasher for DNA.

The first witness on Day 1 was Commander Alex Walker. He wrote the 129 page affidavit starting on May 11 the day after SM went missing.
Back then he worked for the DA’s office . Defense has already claimed that he “ set his sights” on BM from the beginning.
I predict the Defense will be closing with him today.

Yes- you're on the right track. Without the report, we can't say for sure, but if the DNA was a high probability match to known sexual attacks in other states then my sense is the prosecution wouldn't have arrested Barry Morphew.

My theory is that he ejected the .22 bullet from the gun in order to load the tranquilizer dart. He either dropped the bullet (or intentionally let it drop without touching it) or he put it in his pocket where it fell out later during a struggle. Or maybe he just carries .22 shells in his pockets normally (see: chipmunks) and one fell out as he pulled the tranq dart from his pocket.

I don't think there is any way he could have shot her with a bullet inside the home without leaving blood evidence of which none was found. If he shot her with a bullet, IMO it happened away from the home. But I think it's more likely he strangled or suffocated her, probably while she was under the influence of whatever was in the tranq dart.

Also -- where is the uncapped syringe he used to fill the dart? Are they reusable or disposable? I suppose that went in one of the trash stops...
