Chutkan is asking Lauro why the case should be considered complex and Lauro has responded that he will be filing 2 motions - presidential immunity and selective prosecution.

Selective prosecution is the argument that Trump shouldn't be criminally liable for breaking the law because the criminal justice system has discriminated against him by choosing to prosecute.

Presidential immunity is absolute immunity. Though I need to point out criminally it is NOT tested and largely only predicated on an OLC memo from Watergate days regarding those currently in office iirc. The Constitution is silent on the matter though.

Lauro apparently also told the judge they're going to try to get the case tossed saying, in their view, it's a political prosecution.

reports that according to the Special Counsel, Trump’s claim to executive immunity has already been litigated . . . in 5 sealed hearings concerning the grand jury testimony of 14 witnesses.

Many of the issues have already been litigated because of the J6 committee too. And I gotta say - asking for a trial date in 2026 was a really boneheaded move. It was so unreasonable on it's face that it looked like nothing other than a delay tactic.

Date totally jumps out to me, as someone very interested in American history.

From 1793-1933, all presidential inaugurations were held on that date. That won't mean much to most people and I'm 100% sure the judge did not pick the date because of that, but for anyone who has an interest in such matters, the date is meaningful.

Preserving the record as due diligence for future appeals, yes. (Btw, successful ineffective assistance of counsel appeals are RARE...I've mentioned before lawyers quite literally sleeping or being high during trial and those cases not even being overturned.)

There will undoubtedly be appeals of course but they're also setting pieces into play to try to buy more time later, change of venue motion, juror questionnaire and probably a dozen or two other pretrial motions I'm not thinking of right now.

That is the proposed trial date for his Georgia case....
This will likely go first since that's a proposed date when the defendants haven't been arraigned and considering how many there are it would never make it to trial in a timely fashion.

Chutkan did consult with the NY judge (Merchan) regarding the date and stated there was no conflict. (NY hush money case is late March, I think.)
