his 1st Christmas was spent with her in that cheap motel. I hate that it is usually a speacial day for a child to have his 1st Santa. No pics no presents No half eaten cookies and milk..what a shame

IMO she murdered him later on the 26th or early the 27th and dumped his little body that was inside the diaperbag(that I have not heard was in the motel room or the car)on her way to the bus station. Disgusting.

I think you hit the nail on the head, now the question what if anything will be done about it.. is it still no body no case in Texas?

It's not just that there is no body, its the fact that there is no physical evidence besides a verbal threat made to Logan and maybe that confession she took back. There is some type of law in place that even if someone confesses there must be hard evidence of the murder. I hope they have something more and can try her for it.

We are here 37 minutes late today . . . Judge on bench . . .
State calls Det. Jenny velazquez - Miami Beach PD - 7 1/2 yrs - special victims unit since 2007 . . . different from Miami - but Miami Beach is divided by 2 causeways . . . 2 different PD's.... 12/30/09 asked to assist in investigation by Tempe PD - Gabriel Johnson - she was asked to locate EJ and Baby Gabriel.....notified they were in area of Miami Beach. She spoke to Sgt. Shoenfeld (sic?) told EJ was in area of hostle off Collins ave ...previous familiar with hostle - transient/condo type setting - where transient would stay for night or 2....u-shaped apts top and bottom....in center u shape area to sit.....don't know if there are kitchenette -very small rooms.....didn't have room number....went to hostle provided by Tempe and missing & exploit. children..... bldg mgr said she hailed cab and went to shopping centers.....it was dark night time......cops waited for her in courtyard area (u-shape) - photos of EJ and Gabriel on flyer they had....saw someone who appeared to be person on flyer - got out of cab - she went to enter hostle on the side - Det. stopped her...Det ID'd EJ in courtroom.
Det asked her if she was EJ and @ first said No . . . gave name of Sarah Evans....Det wrote a report as part of duties ..... Victoria Evans was the name she gave (per report)....confronted EJ saying looks like you on the flyer - EJ admitted it was her.....she advised Gabe not with her.....went upstairs to gather EJ's belongings - no items appear to belong to child.....nothing child related in the room - took EJ into custody on Tempe warrant.....placed her in handcuffs and transported her and contacted FBI - waited til they arrived....not this Det intention to interview cuz thought FBI would.....EJ started conversation with this Det....EJ began to sob - said abusive boyfriend relations....that is how she ended up in Miami Beach.....det asked EJ where Gabe was and if ok.....EJ told Det she gave baby away to someone @ hotel she was staying at ....later said she gave baby away to couple in park....no recollection of where park was, no details, no info on the couple.....EJ gave info on TPS due to probs with the Father (of Gabe).....EJ advised she left Phoenix, drove down to Texas, then told her she drove to Miami and took cab to miami beach......got property from EJ's room and impounded it @ Miami Beach PD. State Atty pulling ou box to take to witness - showing exhibit #117 - items inbox.....appears to be pink back pack ....witness recognizes items in box she impounded....property sheet receipt filled out by FBI......admit exhibit #117 - State Atty showing #130 and #131 in evidence - recognized items Det impounded that were within EJ's property when she arrested EJ - these items are listed on property sheet #117. State calls Special Agent Regino Chavez....sworn....takes stand....agent w/FBI Miami office for 9+ yrs....crimes against children.....sex traffic, kidnapping, all forms child sex assault.....asked to assist in Gabe Johnson case....called from Phoenix office - working with kidnapping by Mother.....asked execute State arrest warrants.....called their contact (Sgt Shoenfeld) and FBI in Phoenix Mike Conrad.....found out they located EJ....they were starting their investigation they would call if needed him....11pm on 12/30 they called ....arrived just before midnight to talk to her....he read her miranda warnings....explained miranda and fbi adds if they chose to answer without atty they can stop at any time and talk to atty.....EJ said she didn't want to talk to FBI.....later she talked about whereabouts of Gabe - EJ agreed to talk with him.....she began to tell him....when Gabe was 1 month old she met TPS in airport...talked about EJ giving Gabe to TPS.....didn't go thru with it - went separate ways....when Gabe was 7 months old she gave TPS Gabriel for 1 week - then TPS gave baby back......then she went to SA about 1.5 mile away 6 flags atlantis...she went for walk in park....unknown male and unk. female in the park llater id'd as "cheryl"- they approached EJ as she was upset @ time.....they were couple who had no kids....they met on 12/25 - they agreed to meet on 12/26 @ hotel - they showed up with 1 pg - 1 paragraph document for EJ to sign saying she was mother....she turned him with a bag and he was wearing baby suit....while she was @ homegate and spoke w/TPS....TPS said she had friends in SA who could adopt and take Gabe.....EJ said she left SA......both couple were white, middle age, married couple had weddingrings onfingers....never gave her money nor espouse religious views....couldn't give any specifics on what they plan to do with Gabe, their plans, their car, whether they had car seat, no info on tattoos or specific identifiers of the couple.....
This Spec. Agent spoke w/9 females in Miami jail with EJ......none of them could give info on where to find Gabe.....spoke w/Det. Velasquez and obtained property.....bringing up box #117, #130 & 131 - looked @ box.....pink& grey back pack....he is sorting thru items in the box......he recognizes items .....confirms he sent this to Tempe PD on 1/5/10. No further questions

from what I remember TS never gave EJ the name of the pastor I think it was who would be willing to help out..is that correct? TS claims she was unaware EJ was taking off to San Antonio for this trip, so she says anyway

Det. Patricia Ramirez....city of Tempe PD...10 yrs....she was patrol...then transferred to property crimes for 1 yr.....then sex crimes unit - for crimes against children and elders....three det assigned on-call to respond in timely manner to assist patrol officers from Fri to Mon morning on call...she was on-call for Gabriel investigation....got phone call on 12/27 .....missing child possible kidnapping possible child homocide.....case agent are the point of contact for fellow detecties and other LEO's to go to ....to see case thru it's closure.....that person is in charge of the investigation....obtain all info from all Le involved and put it all together....doesn't know by memory everything that happened in this case but it is all documented.....she has reviewed and talked to other detectives in this case.....Tempe and other LE received high volume of tips....she is not familiar with each and every tip on this case but those are documented.....other officers would advise her if anything was relevant or important on the case.....she originally going to respond to trailer home in Tempe but got 2nd call @ 5:30 in evening asking her to go to PD....a briefing...Sgt John King, Det's Larsen and Riberg(?) and Elliot Campbell, and officer Snell, and Det. Aguilara was available by telephone from TPS residence....another Sgt was present who briefed about EJ' Gpa's car .....conversations with Logan .....learned info about what was at the trailer, in the dumpsters, and financial info about EJ.....Logan was quiet and sad and reserved.....
This det. attempted to reach EJ by phone - unable to reach her.....FBI was not involved @ this point....later Mike Conrad became involved.....jurisdiction FBI doesn't always take over - they assisted in this case and offered resources....her was point of contact.
On 12/18 church on McDonald drive - church was searched and EJ's phone records obtained.....Sorin Stenasco (?) ....Det. Campbell provided phone number communicating with EJ local phone number....@ 23:55 Sorin (male answered) phone....he attempted tocall EJ @ the time but not reach her....
She then returned with Larson to PD....gave briefing to Sgt. King re: Sorin ....about 2 am...at 3 am they contacted Maricopa County asking for emergency order of protection for Gabriel....later Det. Thompson came....she went home about 4am and returned about 10 am Mon.....she had further contact w/Sorin @ his place of employment.....he infomed no further followup from EJ.....
NCIC - monitored by FBI....she spoke w/Logan in afternoon to provide update to this point....Logan informed her of phone conversation w/TPS and JS.....concerned her and affected the investigation.....their names had come up from Sunday the day prior.....call from Logan with further info - she was trying to figure out if Smiths were involved or not with this investigation.....she then contacted TPS to inform they were thinking of using America's Most Wanted.....plant a seed in TPS mind how important .........also Myspace of EJ using web address in Miami Beach.....learned of Miami Beach hostle @ that point.... EJ was in custody but no sign of Gabe.....
This witness talked to TPS that day...had talked to her prior and on 12/29 and then on 12/31 told TPS EJ was arrested and no Gabe was found.....she asked TPS to no longer contact Logan as Logan had already infomed TPS.....Det's talked to EJ's brother, gpa, and gma...
1/2/10 - witness followed up on tip someone look like EJ in Alabama....further info on TPS also , talked to EJ's gpa.....learned info that PD had scheduled press conference for 1/4/10 for Logan and his Dad, Frank, press conference to media to provide further info.....also learned media interview w/Bob Johnson, EJ, and TPS ....(interview already heard in court).....worked with McClusky on wire tap
1/7 - she went to Florida for extradition of EJ arrest on outstanding warrant.

Disc #13 edited and replaced and ok'd by both parties...
Defense doesn't like that media press conferences being brought up....he didn't object to this during testimony - didn't want to draw attention to it......State Atty intended to bring up recording testified yesterday....
Defense says doesn't want pulling on heart strings ....too much of that in this case already....
State ATty rolled her eyes looking away
Judge doesn't see it as an issue so far......doesn't believe State Atty meant to do what Defense is alleging....nothing about what was said during press conference....
State asks if #86 can be opened by the witness.....Judge said it was not used in TPS trial they are ok with the court of appeals.....

judge asks if they want to use court room from 12:45 forward.....asks if 1:00 ok.
