FL - Former President Donald Trump indicted, 40 counts, classified documents and obstruction of justice, June 2023, Trial May 2024 #2

Special counsel Jack Smith's team has questioned several witnesses about a closet and a so-called "hidden room" inside former President Donald Trump's residence at Mar-a-Lago that the FBI didn't check while searching the estate in August 2022, sources familiar with the matter told ABC News.

As described to ABC News, the line of questioning in several interviews ahead of Trump's indictment last year on classified document charges suggests that -- long after the FBI seized dozens of boxes and more than 100 documents marked classified from Trump's Mar-a-Lago estate -- Smith's team was trying to determine if there might still be more classified documents there.

According to sources, some investigators involved in the case came to later believe that the closet, which was locked on the day of the search, should have been opened and checked.

As investigators would later learn, Trump allegedly had the closet's lock changed while his attorney was in Mar-a-Lago's basement, searching for classified documents in a storage room that he was told would have all such documents. Trump's alleged efforts to conceal classified documents from both the FBI and his own attorney are a key part of Smith's indictment against Trump in Florida.

In addition to the closet, the FBI also didn't search what authorities have called a "hidden room" connected to Trump's bedroom, sources said.

Do we know how many classified documents were found in those many boxes that lined the stage and filled the bathroom? All of those boxes are a sign of serious hoarding.

But.... he would be Commander in Chief - isn't that an Officer of U.S.? Maybe not...

If the Commander in Chief is not an officer, Collins dictionary is going to have to revise its published description.

A commander-in-chief is a senior officer who is in charge of all the forces in a particular area.
"He was to be the commander-in-chief of the armed forces."


Even if trump considered himself to be the chief "executive" of the armed forces at the time .... a CEO is still an officer. We don't call a chief executive position a "CE".

Smith filed motion for Judge Cannon to reconsider order unsealing names & stmts of some witnesses in MAL docs case:

Publishing the names of government witnesses would expose them to “significant and immediate risks of threats, intimidation and harassment,” which has already happened in the former president’s cases, Smith said.

On Wednesday, the prosecutor revealed authorities were investigating online threats made against a potential witness in the Mar-a-Lago case. Cannon granted a request to seal the exhibit that detailed the threats.

Another potential witness, who discussed possible obstruction and witness tampering, declined to have his interview recorded because of the risk in “Trump World” for doing so, Smith says.

The federal judge presiding over Trump’s criminal case in Washington received a "racist death threat," Smith says, and a magistrate judge in Cannon’s district has also received numerous threats.

“The Court should not ignore this reality and expose the witnesses to such harm, particularly absent any defense argument for why exposure is justified,” Smith writes.

Judge ruled that, in the meantime, De Oliveira must hand in his expired U.S. passport within 48 hours.
Mr. Nauta & Mr. de Oliveira conspired to delete footage from security cameras after the Dept. of Justice issued a subpoena asking for surveillance footage of the basement where it said confidential documents were held. In the court documents, Mr. de Oliveira is claimed to have texted another employee who was the director of information technology that "the boss" wanted the server deleted. The documents allege that Mr. de Oliveira later met with the employee in a small IT room, told him their conversation should remain private, then pressured the man into obliging his request after the employee told Mr. de Oliveira that he did not have the authority.

2/9/24 Update: Legal experts sounded the alarm after the judge overseeing Trump’s classified documents case rejected special counsel Jack Smith’s bid to keep government witnesses secret. Smith’s team opposed making information public that could reveal the identity or any personal identifying information of any potential witnesses in the case or any transcripts or other documents they may have provided, citing concerns about witness intimidation. Trump-appointed U.S. District Judge Aileen Cannon ruled in Trump’s favor on the matter, writing: “Following an independent review of the Motion & the full record, the Court determines, with limited exceptions as detailed below, that the Special Counsel has not set forth a sufficient factual or legal basis warranting deviation from the strong presumption in favor of public access to the records at issue.” Cannon questioned Smith’s concern for witnesses, writing that “the Special Counsel’s sparse & undifferentiated Response fails to provide the Court with the necessary factual basis to justify sealing.” Next week Judge Cannon holds a hearing under Section 4 of the Classified Information Procedures Act (CIPA), where she will make rulings on what classified material in discovery can be used at trial. In two recent Orders (ECF Nos. 283, 286), the Court has denied the Government’s request to seal or redact certain material that was provided to the defendants in discovery pursuant to a protective order, and then attached either to the defendants’ Motion to Compel Discovery or the Government’s response thereto. That discovery material, if publicly docketed in un-redacted form as the Court has ordered, would disclose the identities of numerous potential witnesses, along with the substance of the statements they made to the FBI or the grand jury, exposing them to significant and immediate risks of threats, intimidation, and harassment, as has already happened to witnesses, law enforcement agents, judicial officers, and Department of Justice employees whose identities have been disclosed in cases in which defendant Trump is involved. Co-Conspirator *Carlos de Oliveira (56) has also been indicted & charged (7/27/23) with 1 count each of obstruction of justice, concealing records & documents & 1 count of making false statements to FBI. He is alleged to have asked what could be done to delete the footage. Plead not guilty (8/15/23). $100K Surety bond-out on bond. Judge ruled that, in the meantime, De Oliveira must hand in his expired U.S. passport within 48 hours.
Mr. Nauta & Mr. de Oliveira conspired to delete footage from security cameras after the Dept. of Justice issued a subpoena asking for surveillance footage of the basement where it said confidential documents were held. In the court documents, Mr. de Oliveira is claimed to have texted another employee who was the director of information technology that "the boss" wanted the server deleted. The documents allege that Mr. de Oliveira later met with the employee in a small IT room, told him their conversation should remain private, then pressured the man into obliging his request after the employee told Mr. de Oliveira that he did not have the authority.

U.S. District Judge Aileen Mercedes Cannon. In addition to Cannon, Magistrate Judge Bruce Reinhart's name also appeared on the summons sent to Trump on Thursday, 6/8/23.
Waltine Nauta will be represented by Stanley Woodward. De Oliveira will be represented by Jack Irving. Trump’s lawyers are Todd Blanche & the former Florida solicitor general Chris Kise & maybe Lindsey Halligan.
Trial set to begin on 5/20/24 with Jury Selection. (trial expected to take 2 weeks). U.S. District Judge Aileen Cannon suggested Wednesday, 11/1/23 that she might delay the timeline for court proceedings in Fort Pierce, Fla., noting the upcoming trial in D.C. (on 3/4/24) & requests from Trump’s lawyers to have more time to prepare.
