9/12/23 Update: Judge London Kite said the case is currently in limbo & she won’t bring Fernandez back to court until the co-defendant, Gardner-Fernandez, is in this jurisdiction. Gardner-Fernandez has not yet been extradited to Duval County from Washington & her next court appearance is Thursday, 9/14/23 in Benton County, Washington. The judge in Fernandez’s hearing on Tuesday set a tentative date of 10/2/23 for the next pretrial hearing but said she would adjust that if Gardner-Fernandez is not yet in Duval County.
10/2/23 Update: Fernandez Saldana had a pretrial hearing scheduled for Monday that was moved to 10/12/23 & has now been moved on 10/26/23 @ 9am. 10/19/23 Update: Pretrial on 10/26/23 has been cancelled per Court.
11/3/23 Update: Next pretrial hearing on 12/1/23 @ 9am. Gardner & Fernandez Saldana will be tried together & their future court hearings will be in tandem. The trial is expected to begin on 4/13/24.
11/14/23 Update: The lawyers for Mario Fernandez have filed a sweeping motion asking the trial judge to disqualify 4th Judicial Circuit State Attorney Melissa Nelson’s Office from prosecuting him for the murder of Bridegan. In the 63-page motion filed with the Duval County Clerk of Court, defense lawyers Jesse Dreicer & Frank Tassone say the State Attorney’s Office (SAO) is using as evidence privileged communications between Fernandez & Gardner, and communications protected by attorney-client privilege. The communications include text messages & emails. The documents also note that there were wiretaps in place involving the FBI, ATF & Secret Service. Defense attorneys asked the SAO to refrain from viewing the cellphones of Fernandez & Gardner until a motion for a protective order could be taken up by the 5th District Court of Appeals. Judge London Kite, who is presiding over the case, will decide whether to recuse the 4th Judicial Circuit State Attorney’s Office. If that’s the case, Florida Governor Ron DeSantis will appoint a special prosecutor from a different circuit. The closest circuits are in Daytona Beach, Gainesville & Orlando. The next hearing for Fernandez & Gardner is Dec. 1, and it is expected this motion will be discussed.
