DA will seek the DP. Held without bail on Fugitive warrant (in Benton County, WA). Was extradited on 10/20/23 to Florida. Plead not guilty. No bond.
*Mario Enrique Fernandez Saldana (34/now 35) arrested (in Kissimmee, Orange County, 3/22/23) & charged & indicted (3/16/23) & arraigned (4/4/23) with 1st degree murder with a weapon, conspiracy to commit 1st degree murder, solicitation to commit a capital felony & child abuse. In Orange County jail waiting for transfer to Jacksonville in Duval County. Transferred to Duval County on 3/22/23. Held without bond. Plead not guilty. DA will seek the DP.
Trial set to begin on 4/13/24 for both.

Among those contested materials Judge Foster will review is a word document concerning Fernandez titled “Confidential Communications” & dozens of emails between Gardner & her attorney & a recorded phone call between Gardner & her attorney. Until the disqualification issue is resolved, the case is on hold.

In Monday's hearing, Assistant State Attorney Alan Mizrahi argued that Judge Foster should be the one to decide if the State Attorney's Office Fourth Judicial Circuit stays on the case since he has seen the unredacted communications and he would be best suited to decide if there was prejudice. Mizrahi argued that knowing the content of the messages matters.

Patrick Karody, the defense for Gardner, says the crux of his motion is what he alleges was substantial misconduct.
"That would be the actions by the prosecution team, that includes the State Attorney's Office, ATF and the Jacksonville Beach Police Department that there was this agreement and they all willfully and intentionally sort of disregard it and then start going through materials that they knew were carbon copies of the phones they were not allowed to touch," tells Karody.

Judge Kite said she will take the issue under advisement and issue her order in writing. The next court date is set for April 4.

3/25/24 Update: Prosecutors have filed a motion asking that the judge who makes that decision be the special master who was appointed to review communications captured via a search warrant that are at the center of a defense motion to bar the State Attorney’s Office from trying the case against Gardner & Fernandez. Gardner’s lawyers have filed a motion to dismiss the indictment against her & both defense teams want State Attorney Melissa Nelson’s office removed from the case. Judge Robert Foster was appointed by the court to determine which of those communications captured via a search warrant must be shielded from prosecutors. The state wants Foster to be the one to decide whether prosecutors are disqualified from the case, not Judge London Kite, who is presiding over the murder trial. That motion is being considered after arguments were made by both sides in court Monday morning. Among the contested materials Foster will review is a Word document concerning Fernandez titled “Confidential Communications” & dozens of emails between Gardner & her attorney, and a recorded phone call between Gardner & her attorney. JACKSONVILLE, Fla. — A new court order filed this week shows decisions about whether or not the State Attorney's Office Fourth Judicial Circuit will remain on the high-profile prosecution of Shanna Gardner and Mario Fernandez-Saldana will stay with the current Judge London Kite.

Gardner and her second husband, Fernandez-Saldana, are facing first-degree murder charges in the death of Gardner's ex-husband, Jared Bridegan. Both have pleaded not guilty.

... in a March 25 hearing, the State Attorney's Office and defense teams were back before Kite arguing over which judge should then make the ruling on whether or not the State Attorney's Office will stay on the case. The state wanted Foster to make the decision and the defense wanted Kite. In the hearing, it also seemed the parties were not in agreement over what exactly was to be viewed and decided on in regards to the possible attorney-client privileged communications.

"These directives were derived from what the Court thought was an agreement by the parties as to the limited scope of the Special Master's role in determining whether certain documents are privileged attorney-client communications. It is apparent from the parties' arguments that this is not the case. Considering this, the court believes that without an agreement by the parties as to this role, there is no longer a benefit to using a special master to assist in assessing these documents," wrote Kite in her order.

I'm not sure if Judge Kite was side-stepping the decision or moving forward with an abundance of caution or maybe both. Hopefully she will share her decision on Monday.
