TAMPA, Fla. — A Hillsborough judge ruled on Monday that a jail phone call between the accused Seminole Heights serial killer Howell Donaldson III, 26, and his mother, Rosita Donaldson, will not be released to the public.

"The request to prevent all future recorded conversations is denied," he said. "The court will review all further objections on a case-by-case basis."

That's the way it works -- the defense tries to delay for as long as they possibly can. Witnesses forget, they move away and possibly cannot be found, they die, etc., etc. It's what defense attorneys do...

TAMPA — Defense attorneys for the man accused of four killings in Tampa’s southeast Seminole Heights neighborhood have asked a judge to bar the parents of one victim from being witnesses at trial, citing a lack of cooperation.
Anthony Naiboa was the third person killed in a series of four apparently random shootings that occurred over several weeks in the fall of 2017. The state has accused Howell Donaldson III of the murders.

But both parents have avoided testifying. It is not clear why.

A recent court motion filed by the office of Hillsborough Public Defender Julianne Holt details the repeated efforts lawyers have made to have the couple testify. Both have failed to show up for scheduled depositions. After multiple subpoenas, Rodriguez finally did appear but refused to answer questions about her son.

When he spoke to the Tampa Bay Times in October 2020, he said his family had experienced fatigue at the case’s duration. He said that he and his wife had refused to testify in depositions because they believed the lawyers wanted to “dig up dirt” about his son. He said they felt re-victimized.

In late 2020, a judge agreed with defense attorneys that the four homicides should be split into four separate trials, instead of one. Prosecutors asked that evidence of the other crimes be allowed into each trial, but a judge denied their request. The case is on hold while a state appeal of that issue is pending.
 
All I can say is that prosecutors in that county certainly do things differently. How do they end up alienating the parents of one of the victims (per link above)?
Unfortunately, the prosecution can't protect the parents from insensitive and cruel questioning by the defense. The father expressed concerns:

When the donations were brought to Naiboa’s family, they turned them down. They instead want to start a scholarship in their son’s name to help other people with autism, just like Anthony.

TAMPA, Fla — Accused Seminole Heights killer Howell Donaldson will still face the death penalty if convicted of killing four people in 2017. Those few months nearly five years ago are hard to forget as the community waited for Tampa police to make an arrest.

Donaldson appeared in court Thursday with his defense team to go over 18 motions filed. Several of those motions had hoped to prove the death penalty is unconstitutional and should be taken off the table.

Attorneys for accused Seminole Heights serial killer Howell Donaldson III asked a judge to throw out the death penalty for several reasons, but all were denied.

Donaldson was in court for the hearing, as were his parents.

Donaldson’s defense attorneys argued he was denied due process because prosecutors didn’t inform the grand jury that indicted Donaldson about aggravating factors. Factors that would make these capital murder cases.

“We are asking the court to preclude capital punishment because the court did not, and the grand jury did not, have a chance to review the aggravating factors in this case,” said defense attorney Carolyn Schlemmer.

The judge denied that and a handful of related motions, so the death penalty remains on the table.
