KISSIMMEE, Fla.
– The estranged husband of a slain Osceola County woman will face a judge Tuesday after sheriff’s officials filed a new charge against him.

The Osceola County Sheriff’s Office has charged Christopher Otero-Rivera with failing to report the death of Nicole Montalvo.
 
The man accused in the death of his 33-year-old daughter-in-law will remain held on a $350,000 bail in Osceola County after a motion filed to lower the bond amount was denied in appeals court this week.

Investigators said Otero-Rivera killed his estranged wife in October, then buried her remains all over the family’s property near St Cloud. Investigators said witnesses watched as Otero-Rivera and his father, Rivera, used an excavator, rented by Angel Rivera, in the back of their yard.

Montalvo was reported missing in October when she did not pick up her son from school.

In a letter sent from jail by Angel Rivera to his wife Wanda, Angel Rivera seems to place blame on his son Otero-Rivera, writing "I’m sure that someone helped Chris. I just don’t know who would help do such a thing."

He also said, "Chris will have to do some time."

The documents revealed a claim that four members of the Rivera family saw Nicole Montalvo’s body in their garage and two of them dismembered her, but nothing was said about how she was killed.

Nicholas Rivera, Oter-Rivera's brother, claims when he went out to the garage he saw Montalvo dead on the floor with blood pooling by her neck. That night, he told investigators he saw Angel Rivera using an excavator and cleaning a push cart, which he presumed was related to Montalvo's death, according to new evidence.

Another woman who had been renting a room at the home said Montalvo's son was there during the entire event.

Documents said at one point Montalvo's son attempted to run out of the residence toward his father and grandfather but Wanda Rivera restrained him.

Her remains were found at Christopher Otero-Rivera’s home near St. Cloud.

Osceola Sheriff Russ Gibson said the victim’s dismembered body made for the worst murder scene he’s ever witnessed.
 
Hundreds of pages of documents are shedding new light on the case of Nicole Montalvo, the mother found dead in Osceola County last year.

Her estranged husband, Christopher Otero-Rivera, and his father were both accused, but still have not been formally charged with her murder.

“There is no rock you can hide under from being held accountable for the heinous actions, the cowardice actions that you have done,” Gibson said.

WFTV Orlando is reporting that the DA has requested a formal hearing tomorrow morning
before a judge asking him to revoke the FIL's bond as a witness came forward and stated he was seen at his home which he was ordered to stay away from.
