The Florida Supreme Court, in a 4-2 decision, ordered the death sentence of Michael Shane Bargo Jr., 25, convicted in August 2013 of first-degree murder in the 2011 death of Seath Jackson, 15, to be vacated.

His resentencing comes after a change in Florida’s death penalty scheme, which requires a unanimous jury vote for the death sentence. The jury in Bargo’s trial voted in favor of the death penalty 10-2.

“In light of the non-unanimous jury recommendation to impose the death sentence,” the order states, “it cannot be said that the failure of the jury to make the required determination was harmless.”

44-year-old James Young Havens III pleaded guilty Tuesday to accessory after the fact. No date was immediately set for his sentencing.

Havens, who was charged at the same time as the teenagers, was deemed incompetent to stand trial in 2012 and underwent treatment at The Centers in Ocala. Fifth Circuit Judge David Eddy found Havens’ competency to have been restored in 2014 after he received a letter from The Centers stating that was the case. Eddy ordered Havens to undergo further psychological evaluations to verify.

After some delays, including hiring a new lawyer, Havens was found competent in December 2017 by 5th Circuit Judge Anthony Tatti.
 
Bargo attorney wants one year to prepare for trial
Michael Shane Bargo, 26, of Summerfield, was sentenced to death in December 2013 for the killing, but under the new death penalty law was granted a resentencing in June 2017. Bargo, who is incarcerated at Union Correctional Institution in Raiford, was not present for a short pretrial conference held Monday.

Defense attorney Candace Hawthorne told 5th Circuit Judge Anthony Tatti there are multiple motions she needs to file and have heard before she can gauge when she will be ready for trial. She submitted two motions in May to exclude the death penalty and to receive adequate time to prepare for trial.
 
The resentencing trial for Michael Bargo held its second day Thursday at the Marion County Courthouse.

He was originally sentenced to death row for the murder of Seath Jackson, however, the jury was not unanimous in its vote to recommend the death sentence and a Florida Supreme Court decision, made last year, makes that mandatory.

The resentencing is expected to go into next week, as the defense now presents its witnesses.

Jury hears mental health expert testimony in Bargo trial

"...On Monday, defense called clinical psychologist Dr. Hyman Eisenstein to the stand. Eisenstein evaluated Bargo for hours after Jackson’s death. In the testimony Eisenstein told the jury Bargo has a long history of mental health and trauma including dysfunctional family. Eisenstein also testified Bargo had been diagnosed with anxiety, depression, bipolar and schizoaffective disorders.

Court proceedings are expected to end Tuesday, contingent upon closing statements and jury deliberations..."

Defense attorneys asked the jury to consider that Bargo was 18 years old at the time of the killing and his brain hadn't fully matured.

They also argued he wasn't the mastermind behind the killing..

The state argued Bargo didn't show any mental health issues when he carried out the crime...."

Update: One of the convicted in Seath'sf murder has been released. This happened June 2020

OCALA, Fla. – A woman who had been serving a life prison sentence for her role in the 2011 death of 15-year-old Seath Jackson is being released from custody after a federal judge vacated her original first-degree murder conviction.

Charlie Ely, 27, pleaded guilty Wednesday to the lesser charge of second-degree murder as part of a plea agreement that spared her from being put on trial again.
