SS, Tuba or Magic-Cat do you believe, as I do that the grand jury decided to indicted Melissa Huckaby for murder? I'm sure it does, but still curious, what if anything a might chart shows for Monday! TIA

I do understand you are all very busy, with active missing cases, where they are not found at this time....& those cases should take priority over a case where a child has been found. As awlful as it is, that she was murdered in the manner she was, I just really want to see justice for Sandra!

Thanks again for everything you all do on so many cases.....so sad that we even have to live in a world where so many go missing & never found. :cry: :furious:

The story of 8-year-old Sandra Cantu is what inspired Thurmont resident Charline Zalewski into activism.

A stranger is not accused in her death. The accused is her next-door neighbor and the mother of one her friends.

“That kind of did it for me,” Zalewski said. “No one wants to talk about it, but we need to.”

Tired of similar stories like Sandra’s, Zalewski has started a program called S.T.O.P. — Speak up and Tell On Predators which teaches awareness, prevention education and empowerment to parents and children.

While children are taught to watch out for strangers, 90 percent of sexually abused children know or are related to their attackers, according to Childhelp.org.

Zalewski is among that 90 percent. A relative abused her as a child.

“Too often many parents ignore the statistics believing it could not happen to their child,” she said. “Unfortunately it can and will happen to anyone, anywhere.”

Angel, it would indeed appear Huckaby has been indicted for murder.

HuckabyHearing081709.gif

I'll keep my comments brief and to the point:

1. The Arabic Part of Imprisonment 14 Taurus is exactly on the 7th House Cusp, showing the 7th House person (Melissa, ruled by VENUS) is a prisoner at Event time.

2. The Arabic Part of Death 6 Libra is close square the antiscion of MARS the prosecution (5 Cancer) showing prosecution is closing in for the kill.

3. Scorpio, the sign of murder, rises. Lord 1 MARS the prosecution applies opposition co-ruler PLUTO, modern ruler of Scorpio. MARS the prosecution squares SATURN, Lord 4 End of the Matter. Notice SATURN is partile conjunct its dispositor MERCURY, with MERCURY ruling the 8th House of Murder & Death...

4. MARS the Prosecution is posited in the 8th House of murder & death. If we give 7th House to Melissa, the radix 8 = the turned 2nd ---- Melissa's 'Near Future.' Notice the VERTEX (fate) and HADES (another death marker and one that particularly references a degrading death such as Sandra suffered) are also posited in the Radix 8th / Turned 2nd).

5. 22 degrees, a degree of murder, marks the 10th and 4th House cusps. The 10th House is what comes before the Public Eye (as well as the goal of the chart) and the 4th House symbolizes the End of the Matter.

6. VENUS (Melissa) applies inconjunct to JUPITER the 5th House Child (Sandra). JUPITER is retrograde and in critical degree 21 Fixed, in this case, dead, applying conjunct the Arabic Part of MURDER 24 Aquarius. Since SUN, which always describes the nature of the Event, opposes, and MARS the prosecution trines this Part, we see more testimony Melissa Huckaby will be formally and publically charged with the kidnapping, rape and murder of Sandra Cantu.

7. Notice VERTEX (fate) in Fateful Degree (same degree as the NODES). Before the MOON goes Void of Course, at 28 Cancer she will conjunct the malefic SOUTH NODE and thus seal Huckaby's fate.

Thanks,
Soulscape

Huckaby Back in Court

A crush of media is expected Monday at a hearing for the woman accused of killing 8-year-old Tracy resident Sandra Cantu.

Former Sunday school teacher Melissa Huckaby is set to appear in court at 1 p.m. What happens in court is considered a minor legal move according to legal experts, but it was enough to get the Today Show on NBC to send a live satelite truck for some pre-hearing coverage on national television.

She is accused of the rape and killing of Cantu, whose disappearance and death attracted national attention back in March.

Huckaby pleaded not guilty back in June to charges she kidnapped, raped and killed the little girl.

She also pleaded not guilty to charges that she previously drugged a 7-year-old girl as well as a 37-year-old man, whom police believe she had been dating. The girl lives in the same mobile park where Huckaby lived just down the street from Sandra.

Huckaby is charged with murder with the special circumstances of rape, kidnapping and lewd or lascivious conduct with a child under 14, which could make her eligible for the death penalty if convicted. She also is charged with two counts of furnishing someone a harmful substance and one count of child endangerment in the drugging case.

Monday's hearing is not expected to make any changes in the case. The judge has already scheduled a preliminary hearing for Huckaby to start the last week in September.

Thank You So Much SS for taking the time to do a chart for all of us. I'm happy that there will be "Justice For Sandra"!

My wishes would be that she was still here with us, but she is safe from any harm in God's arms now. She has Caylee Anthony, Robert Manwill, & all the other little angels that were all taken before their time to play & dance with forever now.

If I'm understanding your chart correctly, Melissa's in the 7th House next to the VERTEX (fate) and HADES's death markers, that she will soon receive the DP! She deserves nothing less than that after what horriable things she did to little Sandra.

Along with much more discovery & details being released come the trial. That the prosecution has her fate sealed to a T!!!
As much as I want to know some of the details of what happened to Sandra, at the same time I don't. At least we know she will never harm another child ever again.

Thank You to all of our astrologers, for working so hard helping to find all of our lost little angels & adults. As well as helping so many families closure when they don't know what or where their loved ones are! :blowkiss:

Huckaby back in court at 1 p.m. today

Melissa Huckaby is expected in a Stockton courtroom today in a rescheduled hearing following a secret grand jury proceeding.

Originally set for a September hearing, Huckaby's new court date may indicate that the grand jury has indicted 28-year-old Huckaby, who will face a new arraignment today.

The case that drew national media attention could result in a death sentence for Huckaby.

A secret grand jury met during the last two weeks in July to hear evidence against Huckaby. With an indictment, Huckaby's case goes straight to trial rather than the anticipated preliminary hearing in open court.

The hearing is scheduled for 1 p.m. before San Joaquin County Superior Court Judge Linda Lofthus.

Grand Jury Indicts Huckaby in Cantu Murder, Poison Attempts
August 17, 2009
UPDATED: 4 mins ago
<snipped>
The San Joaquin County grand jury indicted Huckaby on five counts: murder with the allegation of kidnapping; sex with a child 10 years old or younger; child abuse and endangerment; furnishing a harmful substance to a child; and furnishing a harmful substance to an adult.

The murder indictment carries two special circumstances: lewd and lascivious acts on a child, and rape by instrument.

The harmful substance indictments stem from charges prosecutors filed in May alleging Huckaby tried to poison a 7-year-old girl and a man. The girl recovered. The man has not been found.

Huckaby had visible marks on her forehead when she appeared in court Monday. A prosecutor indicted Huckaby had made the marks herself Monday morning.

The former Sunday School teacher did not enter a plea to charges.

A trial date has not been set.

The district attorney's office has not determined if it will seek the death penalty against Huckaby.

The judge has imposed a gag order on the case, prohibiting court officials and participants from commenting to media.

Indictment in Sandra Cantu Case
Posted: Monday, 17 August 2009 1:35PM

Melissa Huckaby, accused of killing and raping her 8-year-old neighbor in Tracy has been indicted on five counts.
The indictment includes three special circumstances, which makes the case eligible for the death penalty.

The 28-year-old was in court on Monday after being arraigned on murder, kidnapping and rape with a foreign object in the Cantu case last month.

She is also accused of giving a foreign substance to another child and a man.

Huckaby had visible cuts on her forehead and forearm while appearing at the courthouse.

Those cuts apparently stemmed from an incident in the jail, although that could not be confirmed because of a gag order in the case.

There was no plea entered in court Monday; Huckaby had previously plead not guilty to all counts.

The next trial date is tentatively set for September 10.

Indictment against tearful Huckaby read in court today
Aug 17, 2009
<snipped>
Tracy murder suspect Melissa Huckaby was indicted today on charges that she kidnapped, raped and intentionally killed an 8-year-old girl and drugged two other people.

The 28-year-old appeared in court this afternoon with two bright red scratches on her right temple and some on her left arm, apparently from an incident at the jail this morning that San Joaquin County Superior Court Judge Linda Lofthus mentioned was an attempt by Huckaby to get out of her court appearance.

“Hopefully something like this doesn't happen again,” Lofthus said.

Though she's heard them before, Huckaby broke down in tears when she heard the charges read against her. She looked quizzically at her public defender when the judge read the charge of child abuse and endangerment against a 7-year-old Huckaby allegedly drugged in January.

The single mother and one-time Sunday school teacher did not enter a plea to the charges handed down today. Her attorney Sam Behar said he needs more time because he has yet to review the indictment filed on July 31. Prosecutor Thomas Testa, apparently annoyed that Behar had yet to read the indictment, said the case needs to move along because there are underage witnesses whose memory may fade.

Prosecutors convened a grand jury in July instead of holding a preliminary hearing to decide if there's enough evidence to take the case to trial.

A trial date has not been set, but could be within a few months, prosecutors said. Lofthus said she wants to give the defense enough time to review the lengthy transcripts from July's grand jury proceeding before both sides can agree to a trial date.

Because of the special circumstances of rape and kidnapping, Huckaby does qualify for the death penalty.

“Until otherwise indicated, your honor, this is a death penalty case,” Testa said to the judge.

Lofthus ordered Huckaby back in court on Sept. 10, when she's expected to enter a plea.

Indictment in Sandra Cantu killing
Monday, August 17, 2009
<snipped>
Huckaby wept and wiped at her eyes as Judge Linda Lofthus read the murder and rape charges.

The judge ordered Huckaby to return to court Sept. 10 after her attorney, Deputy Public Defender Sam Behar, said he had not had the chance to review the indictment.

Deputy District Attorney Thomas Testa asked the judge to set a trial date, saying he wanted to move the case along because children were involved and memories could fade. The judge said she agreed with the prosecutor but noted that Behar had to review the indictment first.

The prosecutor also said he wanted to ensure that Huckaby makes it to her court date next month.

Without elaborating, Testa referred to an incident in the San Joaquin County jail, saying at one point that he had been told Huckaby would not be in court this afternoon as a result of what happened. Behar and sheriff's officials declined to comment after the hearing.

Sources have said Huckaby tried to commit suicide in the week leading up to her arrest in April.

Huckaby, who also lived at the mobile home park, was arrested April 10. After listening to two weeks of testimony, a grand jury charged her July 31 with murder and three special circumstances. Those allege that the killing was committed during a kidnapping, involved a lewd or lascivious act on a child, and involved rape with a foreign object.

Lofthus sealed the autopsy report on Sandra's body in April, citing the "heinous" nature of the crime and the need to ensure a fair trial for Huckaby. Today, the judge also sealed the grand jury transcripts.

Prosecutors will decide within the next two months whether to seek lethal injection, Testa said. Huckaby is being held without bail at San Joaquin County Jail in French Camp.

UPDATED: Grand Jury Indicts Huckaby For Kidnapping, Rape, Murder
August 17, 2009
<snipped>
Huckaby is also charged with drugging another 8 year old girl in January and a Hayward man in two unrelated cases. During today's court hearing, a plea was delayed until Huckaby's public defender, Sam Behar, could examine the Grand Jury indictment and until he can have his own experts test several pieces of physical evidence.

Prosecutors say they sought the Grand Jury indictment because proceedings are held behind closed doors. The transcripts were sealed by a judge at today's hearing. Prosecutor Tom Testa says he wanted to avoid a change of venue in the nationally publicized case.

"We really don't want to go to Imperial County or some other county with all the expense involved. We want the case to be tried locally," said Testa.

Testa asked that a trial be set for thirty days after a plea is entered. Testa said several children will be called to testify. "With children, time passes differently.. So it's very important to move the case along. Their memories fade more quickly," said Testa.

But legal analyst and former prosecutor Steven Clark says that's unlikely. "Realistically in a potential death penalty case you would never, never go to trial in 30 days," he said.

Testa also asked Judge Linda Lofthus to insure that Huckaby appear at all court hearings. He referenced an incident this morning involving Huckaby, who had several scratches on her forehead and arm. He would not elaborate because a gag order has been imposed in the case. He did talk about another case involving a jailed murder defendant who three weeks earlier also tried to avoid a hearing.

"He threatened suicide, he banged his head against the walls and Judge Lofthus ordered him to court," said Testa.

Legal analyst Clark says such actions could give the defense more ammunition for a mental incapacity defense strategy. But he also said, "If it's perceived as game plying the court's not going to look kindly on that."

Huckaby is expected to return to court on September 10th to enter a plea and possibly be assigned a date for a trial.

Huckaby Injuries Seen in Court Appearance
August 17, 2009
Updated: 1 hr ago
<snipped>
The woman charged with the kidnapping, rape and murder of a Tracy girl last March was indicted in San Joaquin County Superior Court Monday with what appeared to be injuries to her forehead.

Although a gag order prohibits court personnel from commenting on the case, prosecutor Thomas Testa implied in court the scratches were self-inflicted to help Huckaby avoid her court appearance.

"It's very frustrating. I hope it doesn't happen again. We need to move this case along," said Testa afterward. "We have a no- nonsense judge. When she says you're coming to court, Mr. or Ms. defendant, you're coming to court."

The murder indictment carries two special circumstances: lewd and lascivious acts on a child, and rape by instrument.

The harmful substance indictments stem from charges prosecutors filed in May alleging Huckaby tried to poison a 7-year-old girl and a 37-year-old man. The girl recovered. The man has not been found.

Huckaby began crying when the indictment was read.

The district attorney's office has not determined if it will seek the death penalty against Huckaby.

Huckaby Indicted On Charges Of Murdering Tracy Girl
Posted: 2:22 pm PDT August 17, 2009
Updated: 6:38 pm PDT August 17, 2009
<snipped>
Melissa Huckaby broke down in tears Monday as Superior Court Judge Linda Lofthus read the indictment against her. The reading came after prosecutors convened a grand jury last month to determine whether Huckaby would stand trial.

Lofthus said the grand jury transcript would remain sealed. No trial date has been set.

Defense attorney Sam Behar asked Lofthus to delay setting a trial date, saying he has not read the indictment or lengthy transcript because he's in the middle of another trial.

But Deputy District Attorney Thomas Testa said he delivered a copy of the indictment to Behar's office earlier this month. "He's had a lot of time to read this indictment," Testa told Lofthus.

The judge then proceeded to read the indictment charges to a weeping Huckaby, who appeared in court with two fresh scratches above her right eyebrow. Neither Behar nor Testa would comment on the nature of Huckaby's injuries after Monday's hearing. A gag order barring attorneys, investigators and potential witnesses from commenting on the case remains in effect.

On Monday, Huckaby entered the courtroom smiling, but her demeanor became tearful and somber as the indictment was read and debate on her next court appearance ensued.

Testa said the district attorney's office is treating the case as if it will be a death penalty case, but no decision is expected for at least two months.

Prosecutors convened a grand jury instead of holding a preliminary hearing in the case to ensure a speedy trial and avoid a possible change of venue. Testa also told Lofthus he wants a speedy trial because the case involves minors and should be made a priority.

Lofthus countered that it would be premature to set a trial within 30 days because Behar had not seen the indictment or the voluminous grand jury testimony.

"We need to do the case one time, and we need to have the case done right," the judge said. "The defense needs time to prepare."

Lofthus then scheduled a Sept. 10 hearing to discuss possible trial dates. Huckaby remains in the San Joaquin County Jail without bail.

Melissa Huckaby Indicted: Sandra Cantu Murder Indictment
Monday, August 17th, 2009 at 7:39 pm
<snipped>
A California grand jury has delivered a five count indictment of Melissa Huckaby; indicted for the kidnap, rape and murder of 8 year old Sandra Cantu. Back in April, Melissa Huckaby pled not guilty to killing the 8 year old who’s body had been found stuffed into a black suitcase and found in an irrigation pond near Huckaby’s home.

As well as the Sandra Cantu indictment, Melissa Huckaby was indicted for attempting to drug a 7 year old girl and a 37 year old man. Authorities say that the 7 year old recovered but are unaware of what happened to the man.

The indictment includes kidnapping, lewd and lascivious acts with a minor, and rape with a foreign object. Melissa Huckaby could face the death penalty if convicted of these heinous crimes. The Melissa Huckaby indictment includes new charges that surfaced in April.

An 18 year old woman said that her 7 year old sister disappeared with Huckaby and came back drugged. From ABC News:

“Her speech was slurred … like she had a really bad lisp,” the woman said of her sister. “And she would cry a lot like something was wrong with her. She couldn’t stand up without help. She couldn’t walk. Every time she tried to walk, she would fall.”

“So they took her to the hospital, and the hospital told us that she had muscle relaxants in her system,” the teenager said

The 18 year old alleges that Sandra Cantu may still be alive if authorities had taken her sister’s case more serious. Melissa Huckaby by all accounts was a decent individual, she lived with her grandparents and 5 year old; her grandfather was the pastor at a local church where Melissa Huckaby was a Sunday School teacher.

With Melissa Huckaby indicted, now comes another painful chapter to this story for the family; the trial. Perhaps this will help in the healing process for a family that has gone through something most of us can not even imagine. Melissa Huckaby’s trial date has not been set.

Former Topekan Indicted in Sandra Cantu Rape, Murder
A Sunday school teacher with ties to Topeka was indicted Monday; Melissa Huckaby charged with kidnapping, raping and killing an eight year old California girl.

A San Joaquin County grand jury has indicted a Sunday school teacher on charges she kidnapped, raped and killed an 8-year-old girl and drugged two other people.

Huckaby in June pleaded not guilty to killing Sandra as well as to charges that she previously had drugged a 7-year-old girl and a 37-year-old man, whom police believe she had been dating. The girl and Huckaby lived in the same mobile park. She and her ex-husband used to live in the Topeka area.

Huckaby is charged with two counts of furnishing someone a harmful substance and one count of child endangerment in the drugging cases.

Former Sunday school teacher indicted in girl's death

Melissa Huckaby, 28, is accused of killing 8-year-old Sandra Cantu, who disappeared on March 27 in Tracy, California. Her body was found April 6 in a suitcase in an irrigation pond near the mobile home park where her family lived. Huckaby and her daughter, who played with Sandra, also lived in the mobile home park.

San Francisco Chronicle reporter Henry Lee, who was in the courtroom in San Joaquin County on Monday as the indictment was read, told CNN:

"Melissa began weeping as the judge read the charges of murder and rape aloud. ... She was shackled and wore a red jail jumpsuit. Otherwise, she said nothing."

The grand jury heard two weeks of testimony.

In June, Huckaby pleaded not guilty to all charges.

The judge scheduled her next court appearance for September 10, giving her attorney time to review the indictment. No trial date has been set.

The rape accusations, involving special circumstances, are "grotesque to think of," Lee said.

Prosecutors will take about two more months to decide whether to seek the death penalty, because of the special circumstances.

Huckaby appeared in court with several fresh scratches on her forehead, according to Lee. She remains in the San Joaquin County Jail without bail, according to CNN affiliate KCRA.

"There were reports she tried to commit suicide in her jail cell. ... She has previously tried to commit suicide by means of swallowing razor blades," Lee added.

Change of venue court cases are extremely rare
August 22, 2009
<snipped>
As in most states, judges in California rarely have moved criminal trials. But this year attorneys in several high-profile cases want proceedings relocated because they believe the local jury pool has been contaminated by publicity and the prominence or heinousness of the alleged crimes.

The attorney for a white former transit cop videotaped shooting a black passenger on New Year's day in Oakland wants his murder trial moved. And a venue change request also is expected in the nationally publized case of Melissa Huckaby, a Sunday school teacher accused of kidnapping, raping and murdering 8-year-old Sandra Cantu this spring in the agricultural town of Tracy.

But prosecutors have taken steps to prevent that by, among other things, moving to keep grand jury transcripts sealed.

"We don't want this case tried anywhere else," San Joaquin County prosecutor Thomas Testa said. "We want it to remain right here."

Venue changes are a longshot in California, where the state Judicial Council reports that only four of the scores of requests during the past two years have been granted.

A PLAYGROUND in memory of Sandra Cantu has been erected at Jacobson School in Tracy, where the 8-year-old was a student until her disappearance last March.

"And the kids are just thrilled," Sasser added. "It's so popular that my husband said we should treat it like Disneyland and start offering 'fast passes' to cut down the line."

Cantu's death marked the end of the last school year, and Sasser said the Jacobson community has not forgotten the tragedy as the new year gets under way.

"Sandra is still in our hearts and is mentioned on campus often," she said. "She will always be a part of this community and this school."

JARDINE: Vigil to mark 6th year in unsolved case
Sunday, Aug. 23, 2009
<snipped>
In 1982, Boni Driskill moved her family to Modesto from East Los Angeles.

"I didn't want (my children) to be involved in gangs," Driskill said. "It was like Mayberry here back then."

Any hope of that bucolic life she sought disappeared the night of Aug. 24, 2003, when her daughter, 25-year-old Lacy Ferguson, was shot at a south Modesto convenience store. Authorities believe Ferguson was the victim of a gang attack, taking a bullet intended for someone else on the day Ferguson's daughter, Haleigh, turned 3. Ferguson died the next day in a Modesto hospital.

Six years later, Ferguson's killer remains at large and Driskill longs for answers. She will hold her annual candlelight vigil at 6 p.m. Monday at Paradise Park in west Modesto to honor her daughter's memory and to keep the case alive in the media. Other victims' family members, including relatives of slain 8-year-old Sandra Cantu of Tracy, will attend.

"We hope they can get some publicity, too," Driskill said.

The reality is that after six years — and five lead sheriff's investigators — thorough detective work alone probably won't solve her daughter's case. It's going to take that plus lots of luck.

Just maybe, someone will get a conscience and the investigators will get the break they need to solve another case.

Sandra Cantu's family finds support at Modesto vigil
Monday, Aug. 24, 2009
<snipped>
Driskill contacted Sandra's family shortly after the girl disappeared from her Tracy mobile home park. Driskill lost her daughter, Lacy Ferguson, in 2003, an innocent bystander in what authorities believe was a gang-related shooting at a south Modesto convenience store. Her killer has not been found.

"Somebody understood, somebody knew what we were feeling," said Sandra's grandfather, Joe Chavez. Others wanted to help, he said, but they hadn't experienced the same soul-crushing grief.

"(Boni) gave us comfort," said Sandra's mother, Maria Chavez. "She was there to support us."

On Monday evening, in a shady corner of Paradise Park in west Modesto, the Chavezes joined Driskill and other crime victims for a candlelight vigil to mark the sixth anniversary of Ferguson's death.

Chavez said he couldn't talk about Sandra's case. But the Chavezes spoke freely about Driskill and the bond they've formed with her and other members of Wings of Protection. Susan Levy, mother of 2001 murder victim Chandra Levy, helped start the support group. Driskill joined a few years ago.

Joe Chavez said Driskill offered something that other people couldn't: true understanding. "It's all about experiencing the death and grief that never ends," he said.

At Monday's vigil, family members of murder victims stood up one by one to say aloud the names of their loved ones. A gallery of loss stood nearby. A poster-sized photo of Sandra Cantu was propped next to framed collages of Ferguson. The family of murder victim Nancy Arellano added a photo as well.

"It's hard for us to say anything because we're still too much involved in this loss, but we wanted to be here to support the other victims," Joe Chavez said after the vigil. "It's a club nobody wants to belong to."

Attorneys in the Mehserle and Huckaby cases face long odds in trying to have trials moved
Venue changes rare in court proceedings

As in most states, judges in California rarely move criminal trials. But this year attorneys in several high-profile cases want proceedings relocated because they believe the local jury pool has been contaminated by publicity and the prominence or heinousness of the alleged crimes.

In addition to the Mehserle case, a venue-change request also is expected in the case of Melissa Huckaby, a Sunday school teacher accused of kidnapping, raping and killing 8-year-old Sandra Cantu this spring in Tracy.

Venue changes are a long shot in California, where the state Judicial Council reports that only four of the scores of requests during the past two years have been granted.

"It's rare everywhere. Very, very rare," said Robert Weisberg, a law professor and director of the Criminal Justice Center at Stanford University. "The court system does not like it, because they're very complicated and expensive."

Melissa Huckaby, suspect in Sandra Cantu case, acted oddly and tried to harm herself in jail

Updated: 09/03/2009 03:56:58 PM PDT

Melissa Huckaby acted strangely and apparently tried to harm herself in the days leading up to her last court appearance, San Joaquin County Court records show.

Jail records in Huckaby's court file said that two days before her most recent court hearing on Aug. 17, Huckaby was found hiding behind the mattress in her cell with a blanket tied around her neck. She was taken to the safety cell, the records showed, and later that day she refused to eat dinner.

On Aug. 12, a deputy reported seeing Huckaby sitting next to her bed with a trash can. When asked what was wrong Huckaby replied, "I took pills."

She was taken by ambulance for treatment. That incident took place about an hour and half after she was found lying on the floor in her cell. She told the deputy that she had felt dizzy and passed out. Huckaby was checked by a nurse, and psychiatric staff was called to the scene.

Huckaby had two unexplained scratches on her forehead when she showed up Aug. 17 to hear the five-count indictment against her. Deputy District Attorney Thomas Testa asked the judge during that hearing to order Huckaby to attend all her court hearings.

Huckaby is scheduled to return to court Sept. 10 in Stockton to enter a plea. A public defender has been assigned to her case, but a gag order prevents parties from speaking to the media.

The District Attorney's Office will decide whether to pursue the death penalty on the case in the next month or two, Testa said at Huckaby's last hearing.

Decision on death penalty looms
Word on fate of Huckaby may come next week
September 04, 2009 12:01 AM
<snipped>
Prosecutors could announce as early as next week if they plan to seek a death sentence against Melissa Huckaby, the Tracy woman charged with raping and murdering 8-year-old Sandra Cantu.

An ever-growing file at the San Joaquin County Superior Court gives some insight into the case that continues to resonate with San Joaquin County residents.

Sixteen FBI agents and 20 Tracy police officers participated in the investigation of Sandra's March 27 disappearance from the Orchard Estates Mobile Home Park. About 75 witnesses testified before the grand jury that indicted Huckaby.

The file also gives some answers to two bright red scratches above Huckaby's right eye seen Aug. 17 in her last court appearance, the Contra Costa Times reported Thursday.

Records say that two days before the hearing, jailers found Huckaby hiding behind a mattress in her cell and she had tied a blanket around her neck. She also refused to eat dinner, the newspaper reported.

A nurse and psychiatrist checked her out Aug. 12. A jailer noticed Huckaby next to her bed with a trash can and asked what was wrong. Huckaby said, "I took pills." Huckaby told jailers she felt dizzy and passed out, the story says.

In Huckaby's last court appearance, Superior Court Judge Linda Lofthus told Huckaby that she had to be at all of her hearings. The judge and attorneys hinted at her misbehavior at the jail but gave no specifics in the hearing.

"Hopefully, that doesn't happen again," Lofthus said at the time.

Huckaby's attorney, San Joaquin County Deputy Public Defender Sam Behar, is expected to enter a plea on his client's behalf in the hearing set for Thursday. The judge could set a date for Huckaby's trial then.

Huckaby acted up in jail, possibly tried to kill herself
Sep 04, 2009
<snipped>
Tracy murder suspect Melissa Huckaby acted up and tried to hurt herself before her last court hearing, according to San Joaquin County jail records.

An incident report from the jail says that a couple days before her Aug. 17 court hearing, Huckaby hid behind a mattress and wrapped a blanket around her neck. She was taken to a “safety cell” and refused to eat dinner.

An Aug. 12 report says that a deputy found Huckaby lying on the floor by her bed. She said she felt dizzy and then passed out. The jail ordered a psychiatric nurse to check up on the inmate.

About a half-hour later, another jail employee found Huckaby sitting next to her bed with a trash can. When the employee asked her what was wrong, Huckaby replied, “I took pills,” according to the incident report. An ambulance took her to a doctor for treatment, records show.

Huckaby apparently acted up the morning of her last court appearance in an attempt to get out of going to the proceeding. She showed up in court with a couple fresh scratches on her forehead and on her left forearm.

More than 70 people testified before a secret grand jury that charged Huckaby with murder and three enhancements that could qualify her for the death penalty: kidnapping, lewd and lascivious acts on a child and rape by instrument. A separate count charges her with having sex with a child younger than 10.

Huckaby has yet to enter a plea, and is due in court on Sept. 10 in Stockton. A gag order bars anyone involved with the case from speaking publicly about it.

Prosecutor Thomas Testa said at the last hearing that the case is a death penalty case until otherwise indicated.
