@Cool Cats - Looks like 2 weeks for jury selection - ??!! or maybe a week & a half. Let's hope they get a jury quick so we can get on with this trial.

They should be able to find a jury pool this first week with 600 jurors assigned numbers for this Monday. I will be surprised if it goes into the 2nd week as this would be unusual in normal circumstances from my own experience being called for jury duty.

However, this is a very high profile murder case for 3 defendants and requires very specific jury questionnaires and so forth, so I could be wrong thinking they will find a jury this week.

Like you, I hope they do!

9/7/21 Update: Next closed hearing for Larry English on 9/15/21 which is the capture him on video & played at trial for the jury. 10/1/21 Update: Arbery’s mental health records can’t be used as trial evidence. The decision by Superior Court Judge Timothy Walmsley further limits defense attorneys’ efforts to portray Arbery as an aggressive young man with a troubled past when the case goes to trial soon, with jury selection scheduled to start Oct. 18. The judge ruled that Arbery's medical privacy, even in death, trumped the rights of the men standing trial to a robust defense. And he concluded that a registered nurse's "highly questionable diagnosis” that Arbery suffered from mental illness during his first & only visit to a mental health services provider in 2018 could unfairly prejudice a trial jury. “There is no evidence that the victim was suffering from any mental health issue, or had otherwise decompensated, on February 23, 2020,” the date Arbery was killed, the judge's ruling said.

Jury selection is scheduled to begin Monday, 10/18/21. A total of 600 people are being told to report Monday morning to a courthouse annex building. An additional 400 will be on standby to show up Oct. 25 if there are not enough qualified jurors in the first batch.
10/15/21: English's attorney filed a "motion to quash" the subpoenas for English & his wife, Amy English. Attorney J. Elizabeth Graddy states in the motion that Larry English already provided testimony in a deposition on Sept. 24. He was granted the ability to give the recorded deposition because of health reason & the possibility that he would not be able to attend the trial. "Mr. English is afflicted with sarcoidosis & needs a heart transplant. Although Mr. English’s condition is matter of record, the threat that these proceedings pose to his life appears unappreciated," a portion of the motion states. "If Mr. English appears for trial & gives testimony, doing so may kill him. As for asking the court to reject his wife's subpoena, a portion of the motion states, "Amy English’s knowledge is limited to privileged marital communications, all of which is hearsay." "The Englishes never enlisted the McMichaels to do what they did & do not want to be part of any effort to justify the McMichaels' actions," a portion of Graddy's May 2020 statement says.

I'm posting this stream right now because the feed in the Glynn County courthouse is not working properly at the moment. Judge Walmsley is on the bench now taking up a motions hearing on media access in jury selection, before starting jury selection.
Media is not allowed in the courtroom for the trial or jury selection and is being asked not to show juror's faces (standard) but also not to record juror's voices meaning we would not be able to see or hear anything. Attorneys for media are asking for courtroom access.

Travis McMichael is third from top left. Gregory McMichael has the dark colored glasses on, to the left of his lawyer, Laura Hogue. Roddie Bryan is closest to the camera.

More people in the 1st jury panel have a negative view of Greg McMichael than they do of Travis, his son and #AhmaudArbery's shooter. In the one-on-ones, a juror said for him that it was because he viewed Greg as "stalking" Ahmaud & that he seemed to be "the lead dog"

Trial of Ahmaud Arbery’s accused killers will scrutinize the use – and abuse – of ‘outdated’ citizen’s arrest laws

The three defendants say they chased Arbery because they believed he was behind neighborhood burglaries and allege they saw him trespass prior to the incident.

Arbery, of course, had committed no crime; under Georgia’s “criminal trespass” law, entry onto “land or premises,” including a construction site, is only a crime when committed “with an unlawful purpose” or when there are posted “No Trespassing” signs. There is no evidence of either in this case.

And even if Arbery had committed a burglary, his death would have still been the result of an unjustified act of vigilantism. As the Supreme Court has said in the context of police uses of force, “It is not better that all felony suspects die than that they escape.” Remembering that as the U.S. considers reforming citizen’s arrest statutes may go a long way in preventing any further unnecessary deaths.

The judge dismissed 8 total potential jurors before adjourning Monday evening; 4 others were individually interviewed; no final decision on their status. Eight remain from the initial panel of 20; questioning resumes Tuesday at 8AM.


Juror #5 speaks harshly of defendant “Roddie” Bryan, “His videotaping the scene was disgusting & vicious,” she said. “However at the same time I’m thankful that he did, because we are able to see what happened. But still very sad.”

Key takeaways from trial of 3 men in Ahmaud Arbery killing: Day 1

About 600 of the 1,000 prospective jurors who received questionnaires in the case were called to the courthouse on Monday to begin voir dire or the process to whittle down prospective the jury pool to 16 impartial people, including four alternates.

About 20 of the would-be jurors spent Monday afternoon answering general questions as a group before lawyers began questioning individual jurors. While Chatham County Superior Court Judge Timothy R. Walmsley, who was appointed to preside over the Glynn County trial, allowed the media to observe and livestream the general questions of the group, he barred cameras from filming questioning of individual prospective jurors.

During the general questioning of the first batch of prospective jurors, 13 of the 20 said they had already formed an opinion on the guilt or innocence of the accused based on pre-trial publicity.

Before the actual questioning of potential jurors began, a hearing was held on what questions prosecutors and defense attorneys will be allowed to asked candidates.

In addition to how much prospective jurors know about the case and whether they can put that aside and decide the case solely on the evidence presented in court, defense attorneys for the McMichaels proposed 30 additional questions. Many of the defense questions pertained to thoughts on racism, the Black Lives Matter movement and whether would-be jurors believe the Confederate flag -- which the McMichaels had on their pickup truck -- as a symbol of racism.

Linda Dunikowski, the lead prosecutor in the case, objected to more than half of the defense questions, calling them too broad or unrelated to the evidence, including whether prospective jurors supported the Black Lives Matter movement or participated in any social justice demonstrations before or after Arberry's death.

"That question has absolutely nothing to do with what the defendants did on Feb. 23, 2020, and participating in a constitutionally allowable peaceful assembly about social justice has absolutely nothing to do with these defendants," Dunikowski said in court.

Walmsley said he'll allow some of the defense questions, but ruled most of them, including questions on gun ownership, were too broad or would lead prospective jurors to prejudge the evidence.

Walmsley also said he would not allow the attorneys to ask whether the prospective jurors are "concerned about your safety, your reputation, your livelihood if you were to be a juror on this case." Robert Rubin, an attorney for Travis McMichael, said that was likely the most important question on the list.

"This is a case that has garnered significant attention in this community as well as around the country, and I have no doubt that the 1,000 or so individuals that were summoned when they received that summons, reacted in some way to that," Walmsley said. "This is not an easy thing for anybody."

A north Florida reporter covering the trial tweeted photos of the potential juror initial questionnaire - their starting point for voir dire. Heck, this questionnaire alone would take me hours to complete. After asking if you've heard or read info on this case from news media, then social media, even just the "what is the news media source for your information" and "what is the source for your information in social media" would take me eons to full and 3 lines for handwritten response is just not enough!

10/18/21 Monday, Jury Selection Day 1: Judge Walmsley took up a motions hearing on media access in jury selection, before starting jury selection. Media is not allowed in the courtroom for the trial or jury selection & is being asked not to show juror's faces (standard) but also not to record juror's voices meaning we would not be able to see or hear anything. Attorneys for media are asking for courtroom access. Jury selection is expected to begin around 1 p.m.
Judge Walmsley says he has no problem with media pool being in the hearing but has limited space. He's discussing how reporters can get live stream of feed while not being in the courtroom. He's recommending having one pool reporter in the courtroom to tell everyone else what is happening.
Judge is considering various questions to allow or ban. There's a concern that jurors may be asked about the prosecution team being from Atlanta & working with the Fulton County DA's office. (They are not). The prosecution team is from Cobb County.
Judge discussing concerns about timing & desire to make questions relevant & reasonable given volume of jurors. "I don’t rush anything in a case, but I also don’t burn time for the sake of burning time," Walmsley said.
Judge will not allow attorneys to ask jurors if they themselves have tried to conduct a citizen’s arrest or if anyone they know has tried to. He says it's a "legal question," and won't be asked for jurors to answer.
State objects to asking jurors if they support or oppose the Black Lives Matter movement, saying that movement is not relevant to the case. State suggests instead asking what bumper stickers do jurors have on their cars to explain what messages they seek to promote. State says those questions are "pre-judging," ask jurors to put themselves in defendants' places.
State is opposing questions asking jurors to describe what behaviors makes a person a racist in their opinion.
Greg McMichael's attorney Frank Hogue's 1st objection is to the State's introduction in which they tell jurors that "This is not a death penalty case." He says it raises a specter unnecessarily.
Bryan's attorney Kevin Gough says he'll move for a mistrial if the State's question asking not just whether they've heard of the lawyers in the Arbery case, but what they've heard of their reputations.
State objects to defense voir dire agree/disagree questions re: #10, No one should be allowed to shoot an unarmed person under any circumstance. Also, #11, No one should put themselves in a situation where they have to use a firearm for self-defense.

Judge Walmsley says shooting, firearms questions are too broad, as are "revealing racism in community" & "media coverage" questions. Permits confederate/old GA flag question. Should people never attempt to detain a person" question is not allowed.
Judge Walmsley won't allow safety/reputation/livelihood question. Travis McMichael attorney Bob Rubin says that's probably the most important one. Walmsley says as phrased, it's so broad & almost everyone would raise their hand.
On strikes for jury selection: defense lawyers say they hope to agree to use the 9 on the same jurors. Judge will split them evenly--3 apiece. Five additional strikes for each defendant, for total of 8; State gets 3 more for total of 12. They begin at 1PM.
Attorneys plan to ask jurors 30 questions. Jurors will be brought in 20 at a time to be questioned about their ability to serve as an impartial juror. Hundreds of potential jurors are being held at a nearby park right now for extra space.
About 600 of the 1,000 prospective jurors who received questionnaires in the case were called to the courthouse on Monday to begin voir dire or the process to whittle down prospective the jury pool to 16 impartial people, including four alternates.
The judge dismissed 8 total potential jurors before adjourning Monday evening; 4 others were individually interviewed; no final decision on their status. Eight remain from the initial panel of 20. Jury selection continues on 10/19/21.

Suppressed Ahmaud Arbery Documents Accidentally Shared by Court With Juror Pool

The website of Georgia's Glynn County Superior Court accidentally made suppressed evidence and documents accessible to potential jurors in the trial of Travis and Gregory McMichael and William "Roddie" Bryan.

In order to avoid a potential mistrial due to bias, attorneys may have to ask jurors whether they saw suppressed evidence on the court website, a legal expert told Vice News.

A woman seeking justice in the death of Ahmaud Arbery wore a jumpsuit bearing the likenesses of Mr. Arbery’s accused killers, Gregory and Travis McMichael and their neighbor William "Roddie" Bryan.

"We are aware of that [website] issue, and the decision about that will be made by the judge," Glynn County Superior Court Clerk Ronald Adams told the aforementioned publication.

Defense lawyers had wanted to include evidence about Arbery's past police interactions to argue that he had planned on committing a crime on the day of his slaying. A judge ruled that doing so would effectively put Arbery on trial rather than his killers.

Defense attorneys had also wanted to include details of Arbery's mental health in order to suggest that his state of mind may have influenced his behavior on the day he died. A judge ruled that the slain man still deserved medical privacy, even after death.
