The core elements of E's theft claim seem very strange- He leaves 6K worth of fishing tackle unsecured in a modest home under construction, the gear is stolen and he makes no insurance claim.

I suspect that even prior to the incident, "E" gave different people different spins regarding how much of fishing gear was purportedly stolen- and whom he suspected of stealing it.

In the wake of the enormity of the defendants actions, "E" has since further spun his even indirect involvement down to that of "shocked, horrified- and in no way involved."

This has included going philosophical regarding what it means to truly converse with somebody and what it means to truly discuss a particular subject. ( whether he had any conversations with McMichael senior and what was discussed).

In the end, what E said and to whom he said it seems pretty murky and spun several times.

JMOO, The fishing gear would not be a covered loss because it was personal property. Once, we had a generator, nail guns, and a jobsite radio stolen, but our agent told us the radio wasn't covered, even though it had been purchased so the crew could listen to music as they framed. It even ran on the same cordless DeWalt batteries the tools ran on, but no....they excluded it.

English was probably covered by a contractor's risk policy, which wouldn't cover anything other than construction materials and tools.

The court is now in session this morning. Defense Attorney Kevin Gough said he was asked to address the comments he made yesterday:" My apologies to anyone who may have been inadvertently offended".

The state has called Officer Robert Rash to the stand. He had conversations with Larry English about intruders at his home under construction in Satilla Shores.

Today Officer Rash is on the stand. He's the one that texted that if someone was on the property to contact Greg McMichael as he was former LE. The prosecutor is trying to get in front of this. Let's see what he has to say!

I find this trial so difficult to watch, which is why I am not watching all of the time. The police working on the assumption that Mr. Arbery was a burglar based on what he was told by McMichael--when all he did was go for a jog-- is almost too much to take. The police calling his mother and telling her that her son was dead and that he was a burglar. It is just too much. If these trash heaps are not convicted I will lose the last thread of confidence I have in the justice system.

Technically very true.

And from a further technical point of view, Rash probably does not have the authority to deputize anybody- so even if he had deputized McMichael, it would not have been valid.

But, leaving the technical world behind, and entering the real world....

Rash suggested that due to resources, no further police action could be taken in regards to the past thefts. He then identified McMichael as a retired police officer. Then he informed residents that Mc Michael was their solution in regards to future thefts.

The totality of Rash's actions did deputize McMichael in the real world sense. And.... with 20/20 hindsight, empowering McMichael had the potential to snowball- then roll south.

no fan of Sharpton, but his presence in the courtroom is at the family and the court's discretion. Gough's comments about that situation though, I found highly offensive and tells me exactly why he is perfectly suited to represent his [unusual] client. :rolleyes:o_O

One conclusion after watching Officer Rash on direct & seeing his body cam from Feb 11: what excellent customer service SS residents received from GC police! My goodness! A "black boy" is seen wandering around in an unfinished house at night exactly *twice,* without taking anything or even rummaging around in anything, and LE asks everyone he sees in the neighborhood if they recognize the still he has conveniently stored on his phone. My goodness!

And when he's seen on video again on Feb 11, why, they even call in D & R to help conduct a river search in addition to a neighborhood search, after they watch him casually sauntering around inside the unfinished house. Oh. And with obviously nothing in his hands. No gun, no flashlight, though Travis tells the 911 dispatcher he sees the scary trespasser inside with a flashlight.

And how interesting, that a white man (nope, not called a boy) is actually caught on video breaking & entering into a car on Dec 8, 2020, and did he....take a gun? A video that was shared with everyone on the SS's FB page. And yet, somehow Travis & Greg conclude it must have been AA who *allegedly* stole T's gun from his unlocked truck on a few weeks later. OK.

And, lo. There is an actual, verifiable, wanted by feds felonious man living right there in the neighborhood, but Officer Rash says, nah, we never looked into him as suspect for any of the alleged crimes happening in SS.

He was comfortable enough to say that OUT LOUD, this is outrageous. What on earth is he trying to achieve. Influencing the jury is a flimsy way of justifying him saying that black reverends are intimidating, and he said it with his chest.

I honestly don’t understand what his strategy is, he just seems to love wasting everyone’s time.

I think your observations and conclusion in bold are descriptive of somebody in way over his head and thus.... grasping at straws.

A good many attorneys have no, or very little trial experience. Anecdotally, I knew a good corporate tax attorney in that category- but he has the professionalism to admit it to clients and partner with an attorney who does if a trial cannot be avoided.

My guess is that having no trial experience can also extend to criminal defense attorneys whose usual practice is to plea bargain immediately. Then factor in that Gough is also going against a prosecutorial "All star" team.

In the end, being in over ones ahead and facing a highly skilled opponent in any activity can cause one to sink that much faster- and become even more desperate.

Travis wasn't truthful to the 911 dispatcher about the timeline. The part he left out is he had in fact left the scene to run home to get daddy & his gun, and possibly his phone. AA had plenty of time to exit before the posse arrived.

PS. I wonder how Greg felt about English choosing to rely upon the "really short Hispanic guy" (Greg's words) to watch his house & run over when called, rather than Greg, the ex-LEO & police investigator who had volunteered to do that. And who English had never even called to say no thank you.

Good morning! Back in place, viewing #AhmaudArbery shooting case. This morning, Kevin Gough said he's been asked to address yesterday's comments. Judge Wamsley said that request was made by the Court. Gough says he'll be "putting those concerns in the proper context."

State called GCPD Ofc. Robert Rash, the one Larry English eventually got into contact with about concerns over people coming onto his under-construction property.

Jurors heard testimony taken from Rash's bodycam of him telling Greg & Travis McMichael in late 2019 that English "hasn't actually seen him take anything." Greg McM replied: "It's criminal trespassing."

Rash says English wanted to ID trespasser, tell him not to come back. He alerted English that he could call Greg McMichael any time, as GM had offered to help if cameras caught trespassers. Bodycam shows Rash on phone w/English while talking to McMichaels

Rash says he didn't "deputize" Greg McMichael. He thought GM could make an "expert witness" since he was former law enforcement. Travis McMichael atty Bob Rubin is cross-examining Rash.

Rash bodycam from 2.12.2020 shows him responding to Travis McMichael's 911 call when he said he'd seen a trespasser who might have a gun. Rubin drills down: Why's your gun drawn if it's a property call? For your protection, not to hurt anybody? Rash: Yes

Rash explains he had his gun out b/c Dispatch told him caller said trespasser might be armed. Rubin: It's standard procedure when you go into a possible armed situation to have your gun ready for your protection? Rash: Yes, sir

I’ve had tears over how attitudes of the defendants, and some of the police personnel, too. Ahmaud Arbery, is being demonized, essentially being blamed for his murder. The emphasis on Ahmaud’s color permeated, nearly every conversation, and to me exhibits, a clear bias. How many times is the identification of AA as a”black male” said? It’s as though that description, makes an assumption of guilt.

Truly exquisite customer service by GC police! They're not only willing to investigate the bejeebers out of a crime absent the victim actually officially reporting the crime- a theft, but a LEO is willing to pass along messages to the alleged victim from his neighbor!

Greg McMichel atty Frank Hogue says he's adopting everything Rubin did on his cross and not repeat any. Talks about the day Ofc. Rash saw GM in Satilla Shores in December and showed him English videos. Rash knew GM from work.

Rash says the discussion did include the info that the guy in question'd been to English property multiple times. Based on video of young black male or white couple, did you get info from Greg McMichael that day that helped you solve the crime? Rash: No

Oh, even best yet. Rash says English told him maybe the contractors took the items from his boat, they're on video actually carrying stuff in and OUT from near the boat, but " there was no reason to suspect them" of the theft. Though English told him he did. Though *AA* was never seen near the boat, or touching anything on the property, much less carrying anything away from it.

And, English explicitly told Rash he might not (and then didn't) report the stuff stolen because filing an insurance claim might be problematic.

great post- Poor Mr. Arbery- He had no idea he was being stalked and criminalized, even before the horrible day he was actually shot down. I am so incensed and so so sad.
