3/27/24 Update: Judge Yvette Roland, who presided over months of testimony & argument about the basis of John Eastman’s fringe legal theories, ruled that the veteran conservative attorney violated ethics rules & even potentially criminal law — when he advanced Trump’s efforts to overturn the election results based on weak or discredited claims of fraud. Though Eastman may appeal Roland’s decision, including to the State Supreme Court, the ruling forces his law license into “inactive” status while any review is pending, meaning he can no longer practice law in California. In all, Roland found Eastman culpable for 10 of 11 charges that State Bar investigators brought against him, including misleading courts, lack of candor and, most notably, plotting with Trump to derail the transfer of power.
4/1/24 Update: Mark Meadows requested that Judge Scott McAfee hold an evidentiary hearing on his motion to dismiss the charges against him – his latest attempt to try to assert immunity, which other judges have repeatedly rejected. If he gets what he wants, Meadows could have to testify under oath – in a courtroom that allows cameras.
4/4/24 Update: Fulton County Superior Court Judge Scott McAfee rejected the argument that Trump’s alleged efforts to overturn the 2020 election were protected under the First Amendment. “The defense has not presented, nor is the Court able to find, any authority that the speech & conduct alleged is protected political speech,” the Judge wrote in his order. In his order, the judge also denied similar First Amendment challenges raised by other co-defendants in the case. Judge McAfee ruled that statements made by Trump & 14 others charged in the indictment handed down last year were made “in the furtherance of criminal activity” & not protected by the First Amendment. “After considering the extensive briefing, the argument of counsel, and the indictment, the Court finds these vital constitutional protections do not reach the actions & statements alleged by the State,” McAfee wrote in his order. “Nor do the statutes themselves facially violate the First Amendment. The Defendants’ motions are therefore denied.” Judge McAfee’s ruling is the latest step inching the state racketeering case against Trump forward. Willis has suggested she would be ready to go to trial as soon as August, but the judge has still not set a trial date for Trump or his remaining 14 co-defendants. Trump’s Georgia lawyer Steve Sadow said in a statement that Trump & other defendants “respectfully disagree” with the ruling & will explore their options.
4/5/24 Update: A three-member disciplinary panel in Washington, D.C., came to a preliminary, nonbinding conclusion that Jeffrey Clark violated his ethical duties as an attorney when he attempted to help overturn the 2020 election & thwart the peaceful transfer of power to Joe Biden. Clark has not yet faced the nuclear option of being stripped of his license to practice law. A decision by the D.C. Bar Association’s disciplinary board as to what, if any, punishment Clark will receive will come after it reviews further submissions from both Clark & the disciplinary investigators.
4/8/24 Update: On Monday, Trump filed a joint motion with 14 co-defendants asking Fulton County Superior Court Judge Scott McAfee to allow them to appeal his April 4 order in which he said the charges should not be tossed because the defendants’ "actions & statements" about the 2020 presidential election were not constitutionally protected. In the Monday filing, Trump & the defendants argue that while the court held the indictment is not subject to dismissal, interlocutory appellate review of the defendants’ "vital constitutional protections," is "both prudent and warranted." Judge McAfee has 10 days from his April 4 order [4/15/24] to decide whether or not to let the parties appeal. If he does, they will have 10 days from that order to appeal to the Georgia Court of Appeals or the Georgia Supreme Court.
4/8/24 Update: Fulton county prosecutors asked the Georgia state court of appeals on Monday to reject Trump’s request to consider his claim that the DA Willis should be disqualified over a relationship with her deputy, arguing that the matter was correctly settled by the lower court judge. “The present application merely reflects the applicants’ dissatisfaction with the trial court’s proper application of well-established law to the facts,” prosecutors wrote in a 19-page filing.
*Scott Graham Hall – (fake GOP elector tied to Coffee County breach) Plead guilty (9/29/23) & sentenced to 5 years of probation in exchange for testimony moving forward (including at trials of other co-defendants), a $5K fine & 200 hours of community service. Probation becomes non-reporting after 2.5 years, assuming he does not violate his probation during those initial 2.5 years. And will have to write letter of apology to Georgia citizens.
*Sidney Katherine Powell (68) – took a plea deal & plead guilty to 6 counts of conspiracy to commit intentional interference with performance of election duties & sentenced to 6 years probation, required to testify at future trials, pay at $6K fine & #2,700 in restitution to the State & write an apology letter to the citizens of Georgia & admit her role in the January 2021 breach of election systems in Coffee County.
*Kenneth John Chesebro (61/now 62) – took a plea deal (10/20/23) & plead guilty to Count 15 Conspiracy to commit filing false documents. All other charges dismissed. Sentenced to 5 years probation, $5K restitution fine, 100 hours of community service & an apologize letter to the citizens of Georgia & testify against all other co-conspirators truthfully. Also no communication with media, witnesses & co-defendants, recorded proffer with prosecutors, provide documents & evidence. Resides in Puerto Rico & Judge will see if he can get probation transferred there. As part of his plea deal, Chesebro admitted that he conspired to put forward fake GOP electors in Georgia with Trump & former Trump lawyers Rudy Giuliani & John Eastman. Giuliani & Eastman have both pleaded not guilty in the Georgia case & now face the prospect of Chesebro taking the witness stand against them.”
*Jenna Lynn Ellis (38/now 39) – Took a plea deal to charge of aiding & abetting false statements & writings. Ellis plead guilty on 10/24/23. Sentenced to 5 years probation, $5K fine, apology letter to the citizens of Georgia, 100 hours of community service & testify truthfully against other co-defendants.
