Man accused of killing Davenport girl asks for trial to be delayed

DAVENPORT, Iowa - (Iowa's News Now) — Henry Dinkins, accused of kidnapping and murdering Breasia Terrell, says he won't be prepared for his February trial date.

Dinkins' defense attorney Miguel Puentes filed the motion for continuance Thursday, asking a Scott County judge to push back the trial. The filing says the defense is still working on discovery and has experienced "unforeseen delays" that will keep them from being ready for trial, set for February 14th.

While prosecutors have yet to file a response, the defense filing says they've advised prosecutors of the need for a continuance and have had "informal discussions" about when to reschedule. Both sides were scheduled for a status conference next week.

So when is the expected trial date now?

I've read several of the linked articles. Is anyone else confused by what Culberson has stated? If Dinkin's phone was in the home at 3 AM and she put it on a charger. Why the additional calls later that morning? Also she saw Breasia standing outside by a car? Color me confused, none of that makes any sense IMO. Reading what she states makes my skin crawl with suspicion.

Updated: Henry Dinkins was the only person of interest in the disappearance of Breasia Terrell. Now he's charged with kidnapping and murder.

Breasia Terrell’s disappearance in the summer of 2020 galvanized the Quad Cities community. The search ended in heartbreak when her body was found near Dewitt in March last year.

Now, in partnership with One Eighty, basketball players at Monroe Elementary in Davenport will wear purple jerseys – purple was Breasia’s favorite color – with her initials printed on the front in remembrance of her.

Trial delayed for man charged in death of 10-year-old Breasia Terrell

The trial for a Davenport man charged in the shooting death of 10-year-old Breasia Terrell in July 2020 has been delayed until May 9.

During a short status hearing Tuesday, Judge Henry Latham granted the motion. The judge also set a status hearing for April 19 and a final pretrial conference for May 4.

Dinkins seeks new attorney in the Breasia Terrell murder trial

Feb. 9, 2022

The man accused of the 2020 kidnapping and murder of Breasia Terrell will appear in court Thursday to ask for a new attorney.

Henry Dinkins is scheduled to be in Scott County Court at 8:30 a.m. Thursday for a hearing with Scott County District Judge Henry Latham to review the written request Dinkins made for a new attorney in late January.

Dinkins' letter to Latham was stamped Jan. 25 — the same day Latham moved the start of the trial to May 9, with a final pretrial hearing set for May 4. Before the change, Dinkins' trial was slated to start Feb. 14.

Judge tells Dinkins to work out differences with public defender, denies request for new attorney

It took 14 minutes for 7th District Judge Henry Latham to deny Henry Dinkins' request for a new attorney.

A pair of deputies from the Scott County Sheriff's department escorted Dinkins to the seat next the attorney he wanted to replace — public defender Miguel Puentes.

Latham summarized the contents of a letter Dinkins sent to the judge Jan. 25 — the same day Latham moved the start of Dinkins' trial to May 9, with a final pretrial hearing set for May 4. Before the change, Dinkins' trial was scheduled to start Feb. 14.

In the letter, Dinkins said he had not seen public defender Puentes "but once in eight months." Dinkins also claimed Puentes gave him false phone numbers and he could not contact the attorney.

During Thursday's hearing, Puentes explained that as late as last Friday Dinkins had not expressed to Puentes a desire to replace him. He also explained a combination of factors led to infrequent in-person visits, including the the fact Dinkins is housed in Clinton County and "discovery has not been done in a timely manner."

Latham concluded the hearing by ordering Dinkins to have better access to Puentes via phone and ordered Puentes to have a physical visit with Dinkins "at least once a week." Latham also pointed out Puentes " ... is a very good attorney with a lot of trial experience."
