FAIRFIELD, Iowa (KCRG) - Attorneys say it’s a race against the clock in the sentencing of one of the two teens who killed a Fairfield Spanish teacher.

He’s set to be sentenced in August, but his attorneys asked the court to delay sentencing until October, because a psychiatrist, who is set to testify at the hearing, isn’t available in August.

The state filed a motion against delaying the sentencing, saying Graber’s widower wishes to make a victim impact statement at the hearing. He’s facing a terminal illness, and the state says it’s unclear if he will survive until October.

A judge set a hearing on the matter for next month.

Willard Miller is the other teen who pleaded guilty to killing Graber. He faces up to 30 years in prison.

He’s set to be sentenced in August.



Actually I have Miller's sentencing hearing in July (6th) - Original on 7/5 & recently changed to 7/6. ?? I see NO August in his court files.

Miller's case was granted a continuance (request by prosecutor) but not Goodale. The Court did Order a hearing for Goodale's Motion for Continuance (opposed by prosecutor) on July 17.

Goodale is the defendant that cooperated with prosecutors. Initially, I incorrectly assumed it was Miller seeking the continuance!

Perhaps Goodale's defense can find a different psychiatrist to testify at the hearing. I can't believe this would require until October or four months. The victim's family deserves priority here.

I get the feeling we will be hearing from these punk teens for many years to come. JMO

O//T -- I followed the June 2019 murder of Iowa farmer Shirley Carter (shot in her kitchen by an assailant using a shotgun).

It's a terrible tragedy where Shirley's husband believed his own son, Jason Carter, was responsible for her death and filed a wrongful death suit against him in Civil Court, and won a Judgement of $10M against his son.

Shortly after the civil case was over, Jason Carter was arrested and criminally charged with the murder of his mother.

I recently watched an episode of "Killer Cases" about Jason Carter's trial for murdering his mother and it finally hit me why Willard Miller's attorney (Christine Branstad) was familiar to me -- she represented Jason Carter! Jason was actually acquitted in the murder of his mom, Shirley.

Miller’s sentencing hearing is scheduled to begin Thursday, July 6 at 10/9c.

Goodale’s sentencing hearing is scheduled for August 23, 2023, when prosecutors are expected to recommend a sentence of 25 years to life with the possibility of parole.

Actually, the sentencing hearing set for Aug 23 was set back in April and since that date, there is a hearing scheduled for July 17, where the defense is seeking to push the sentencing date to October because a psychiatrist that's expected to give testimony at Goodale's hearing is not available on Aug 23.

The State is opposed to pushing the date out due to the failing health of Nohema Graber's husband who would like to attend and make a statement.

*Sentencing Hearing (@ 9am) - IA - Nohema Graber (66), HS teacher, beaten to death by students, reported missing on Nov. 3, 2021, Fairfield; found in Chautauqua Park on Nov. 3, 2021. - *Willard Noble Chaiden Miller (16/now 17) arrested & charged (11/4/21) & arraigned (11/29/21) with 1st degree murder, an A felony & 1st degree conspiracy to commit homicide in, a C felony. Being charged as adult. Plead not guilty. $1M cash bond.
Trial was set to begin on 4/21/23 was cancelled, Miller took a plea deal & plead guilty to 1st degree murder (4/18/23). Sentencing hearing on 7/6/23.

4/18/23 Update: Miller withdrew his not guilty plea in the 2021 death of Nohema & pleaded guilty to 1st degree murder. Iowa Assistant Attorney General Scott Brown told the Judge the State would recommend a minimum prison sentence of 30 years with a possibility of life. Because Miller was 16 at the time of the murder, he is not subject to the mandatory term of life in prison. During the hearing, Brown said Miller planned the murder. In Iowa, the penalty for a 1st degree murder conviction is life in prison. The judge said Miller will not receive mandatory life without the possibility of parole because he is a minor. He will be responsible for restitution & other costs. No sentencing date given. PSI will be scheduled. Sentencing hearing on 7/6/23 @ 9am. Court reporter memo & certificate-McFall/Showers guilty plea. Procedendo-Appellate Courts. 4/18/23: Order for PSI. 4/19/23: Written plea of guilty filed by Chauncey Tyler Moulding. 4/25/23: Indigent defense claim form created.

I watched the part of the proceedings and the presentation of the evidence found in Willard's iPhone Notes app. The Notes document first lists materials to use in the crime, a procedure (involving the use of a stun gun I presume) and then a source cited at the end of the document.

Nevermind the fact that this person killed a human being..wouldn’t it have been easier to study his dang Spanish grammar than all of this.

There isn't one yet. Right now the defense states that the heinous nature of this crime does not eliminate the need for expert testimony.

The defense is explaining that their client exhibited juvenile behavior by lying when investigated for this crime. The defendant is now 6'4" and was 5'8" when he was arrested.

At this point the defense is asking the court not to impose the mandatory minimum sentence.
