Victims at Ruya 3rd B’day party: 2- 4 yr olds, 6 yr old, 8 yr old, 12 yr old & 3 adults. 3 still with life threatening injuries, 8 yr old treated & released as of 7/3/18; as of 7/18 5 of 9 have been released from hospital.

5/17/19 Update: Hearing continued to 7/9, Judge imposes gag order in case. 6/11/19: Had motions hearing on 6/11 in a closed hearing re competency. Next hearing on 8/1.
7/11/19 Update: Had Review hearing on 7/11, will continue to receive psychiatric treatment at the Idaho Maximum Security Prison South of Boise for another 90 days. Next Status hearing regarding competency on 8/1.
8/1/19 Update: Next competency hearings are set for Sept. 5 and Sept. 12.

The man accused of fatally stabbing a 3-year-old girl and wounding eight other people at or near the child’s birthday party on June 30, 2018, is back in the Ada County Jail after a judge on Saturday (10/12) declared that he is competent to stand trial.

In an order on Saturday, though, Baskin wrote that Kinner “has sufficient present ability to consult with his lawyer with a reasonable degree of rational understanding — and (that) he has a rational as well as factual understanding of the proceedings against him.” Hearings had been held again in September to determine whether or not he was competent to assist in his own defense.

Kinner’s jury trial is tentatively set for Jan. 13, 2020.

The defense argued that they have 21,000 pages of discovery to review and didn’t have the opportunity to work with Kinner when he was being restored to competency. Because of that, the defense argued that they couldn’t be prepared by January and asked for a trial date sometime in late 2021.

Fourth District Judge Nancy Baskin landed in the middle and said she would chose a date in “early 2021.” Kinner has waived his right to a speedy trial, and a final date will not be set until after Judge Baskin reviews other motions in November.

Baskin rearraigned Kinner in court Wednesday, reading his charges out loud, and again informed him of his rights. She also notified him again that the state is pursuing the death penalty.

Kinner responded softly with “yes, ma’am” and “no, ma’am” when the judge asked questions about the charges and his rights. Baskin also questioned Kinner to make sure he understood what the maximum punishment for his charges could be, and Kinner said he understood.

Part of Wednesday’s hearing was closed to the public. When the judge reopened the courtroom, she heard the defense and prosecution make further statements about how long the case should be postponed. The defense said that it believes jury selection alone could take at least three months, and the death penalty trial is expected to take at least eight weeks.
 
This is supposed to happen sometime in November - but haven't heard anything as of today & November is almost over. Anyone?

Trial date for man accused of Boise mass stabbing has been moved to early 2021

BOISE — A judge on Friday scheduled a 2021 trial date in the case of a man accused of stabbing nine people at a Boise apartment complex in June 2018.

The trial for Timmy Kinner Jr., 31, has been postponed by a year and is now set for Feb. 2, 2021, according to a scheduling order issued Friday by 4th District Court Judge Nancy Baskin.

At an Oct. 23 hearing, Baskin agreed to grant a motion from Kinner’s attorneys to push the date back, according to court minutes from the hearing. Attorneys have asked for a two-month trial setting, and the order specifies a pool of 300 potential jurors should be provided.

Baskin did agree to move the trial date, however. Friday’s scheduling order included deadlines for several other matters in the case. Discovery, for instance — the process through which attorneys exchange evidence and information in preparation for trial — must be completed by Dec. 1, 2020. Attorneys also must file their lists of witnesses and exhibits by Jan. 21, 2021, according to the order.

11/6/19 Update: Judge sets 2/2/21 as new trial date instead of 1/13/20. Discovery — the process through which attorneys exchange evidence & information in preparation for trial — must be completed by Dec. 1, 2020. Attorneys also must file their lists of witnesses & exhibits by Jan. 21, 2021.Had motions hearing on 11/12 & next motions hearing on 12/19.

Civil Suit Against Boise Stabbing Suspect Timmy Kinner, Others Still On Hold

A judge has denied a request to split up a civil lawsuit by the parents of a young girl stabbed to death in Boise two years ago while the suspect awaits his criminal trial.

Fourth District Court Judge Samuel Hoagland denied the request this month to let the civil case against the property management company and others go ahead until Kinner finishes up all of his criminal proceedings. Hoagland says this civil case would clearly threaten Kinner’s Fifth Amendment right against self-incrimination.

Kinner was only recently found to be mentally competent to stand trial in October. He faces the death penalty if found guilty in a trial that’s scheduled to begin in February 2021.

Still, Hoagland didn’t leave out the possibility that this could change at some point in the future. Even if Kinner is convicted, his appeals could stretch on for years – especially if jurors hand him a death sentence.

New trial date is 2/2/2021...….Yes 2021.

Idaho Supreme Court won't consider competency of Boise's mass stabbing suspect

BOISE — The Idaho Supreme Court on Monday decided not to opine on the mental competency of the man accused of Boise’s 2018 mass stabbing at this time.

Defense attorneys representing Timmy Kinner Jr., 32, in December asked the state’s highest court for permission to appeal a district judge’s ruling that Kinner was mentally fit for trial; the justices’ order on Monday did not grant that permission.

In January 2019, 4th District Court Judge Nancy Baskin found Kinner mentally unfit for trial, and ordered him to undergo mental health treatment to restore his competency. Ten months of treatment for Kinner in a mental health ward at the Idaho Maximum Security Institution followed; in October, Baskin was convinced Kinner was competent enough to go to trial. Roughly two months after that decision, on Dec. 5, Kinner’s attorneys filed a motion for permissive appeal with the Idaho Supreme Court, a move which drew an objection from prosecutors.

In a permissive appeal, attorneys request that a higher court to review a lower judge’s order and decide if the order was proper. It is filed before a case is final at the district court level, and attorneys can still file for an appeal later on. Permissive appeals are narrowly focused, and doesn’t ask justices to decide a case, but rather only one piece of it.

The Idaho Supreme Court received 20 motions for permissive appeal in 2019, and granted only four of them, according to Sara Thomas, Idaho’s administrative director of the courts.

Kinner is accused of stabbing nine people — including six children — on June 30, 2018, at an apartment complex off State Street in Northwest Boise. Three-year-old Ruya Kadir died as a result of the injuries she received that night, and prosecutors have charged Kinner with first-degree murder, as well as eight counts of aggravated battery, among other charges. They also intend to seek the death penalty if Kinner is convicted.

Concerns about Kinner’s mental health have slowed court proceedings from the beginning. It didn’t take long for his attorneys to voice concern about his fitness for trial — they mentioned it in court by the late summer of 2018. At a November 2018 hearing, Anthony Geddes, an attorney representing Kinner, told Baskin there were some days when Kinner could hold a normal conversation, but other days regular communication was impossible, making it difficult for attorneys to work with him at times. According to court documents, when Boise police arrested Kinner on the night of the stabbing, he told them he felt “crowded” and “ambushed.” He had been staying with one of the apartment’s tenants, who a day before the stabbing had asked him to leave.

Kinner spent the better part of 2019 receiving treatment, and a flurry of sealed court documents and hearings referencing his competency followed after he was found fit to proceed. Through the end of the year, the prospect of the Idaho Supreme Court granting the motion for permissive appeal hung in the background. Monday’s order put an end to that waiting period, which means Kinner is still considered competent to proceed.

In April, Baskin issued a gag order in the case, prohibiting those involved from talking to the media.

Kinner had a closed court hearing on Wednesday, but, according to the Idaho Supreme Court’s online repository, his next immediate court date has not been scheduled. A two-month jury trial in the case remains slated for February 2021.
