Wondering now why the prosecution did not bring in "cult experts"? Did they not feel it necessary? I think they did a decent job with all the people/venues involved, and hopefully the Closing kicks it out of the park.
I'm thinking they made it as little as possible about "cult". If you remove the cult-gobbledygook, you have simple murders conspiracy, etc. It looks straightforward. Chad and Lori used cult to conceal the evil. Take away the cult, and the evil is in plain sight.

I've actually impressed by how the prosecution has simplified what could have been a complicated case to understand.

Cult experts may have more of a necessary role in Chad's trial.

Judge & attorneys to go over jury instructions / Part 2

Jim Archibald just walked by and is entering the courtroom. There likely won't be anything publicly until 11 a.m. at the earliest.

We've been told the courtroom will open at 1 p.m. I'll begin posting updates then.

We are back in the courtroom. Lori Daybell is sitting alone at her table with her back toward the audience. She is wearing a white hoodie/long-sleeved sweatshirt. Much smaller crowd today.

The defense attorneys are now in the courtroom. Lori is chatting with them. Rob Wood is sitting alone at the prosecutor's table.

All of the prosecutors are at their table. Judge Boyce is on the bench.

Boyce says there was an informal meeting this morning to discuss jury instructions and we will now go over the final instructions with all parties.

Boyce says instructions 1-10 have previously been instructed and read to the jurors. He will read them again to the jury tomorrow. Boyce is not reading the actual instruction right now - just the number. Neither side objects to instruction 11.

Instruction #12 is submitted. Instruction #13 - Lindsey Blake suggests a change from "either or both" to "any or all" since more than two are charged. Archibald says, "that makes sense because there are more than two charges." The instruction is amended.

Prosecution has no problem with #14. Archibald says this instruction refers to Arizona crimes and believes further information will assist the jury. Blake says adding the additional information will confuse the jurors.

Boyce says a sentence was added to #14 this morning and it will be given as indicated in the draft. On instruction #15, an amendment was made about exhibits. It will be admitted as it stands right now.

The state has no objection to #16, defense asks court to consider other language of aiding and abetting "since they may not be defined the same we will lodge an objection."

Again - we won't the wording of these instructions until tomorrow when the jury is here. State asks to keep the instruction as is. Boyce overrules the objection.

No objection on #17 or #18 from either side. Revisions were made to #19 and state has no objection. Archibald says there is some confusion about this rule and the language in the indictment charges.

Blake says they don't see the confusion and requests the instruction remain as is. Boyce says he made some changes already and the instruction will remain.

No objection from either side on #20, #21, #22, #23, #24.

No objection from state on #25. Archibald objects to "federal agency or United States of America" language in the instruction. Objection is overruled and the instruction will be allowed in.

No objection on either side from #26. On #27, state does not object but defense has some issues with how the amended indictment now reads. Boyce overrules the objection and it will be allowed to be read as is.

State has no objection to #28. Archibald says the language in the instruction does not mirror the indictment from the grand jury. He says the jury instruction tries to fix the indictment from the grand jury and points to errors

"where the and/or language has been added - that's not what the grand jury indicted my client on." Archibald points out other issues he has with the indictment and instruction language. He does not want the instruction allowed in.

Blake responds that she doesn't see the same issues as the defense and asks for the instruction to be read to jurors tomorrow.

Boyce agrees that some changes should be made to this instruction. It will be amended and all parties are fine with it.

No objection to #29 from either side. Some changes will be made to #30.

No objection to #31 from the state. Lori whispers something to Archibald, he nods his head and Thomas says, "Can we have just a second judge."

Archibald says the way this instruction reads is not how the grand jury indicted Lori. He points out words that are different and says #31 is instructing the jury "completely different than how the grand jury indicted her."

Boyce responds he does have a concern about language in the instruction and not the indictment.

Blake gives some suggestions on how the instruction would be modified. Boyce says he will take the issue under advisement and determine if there should be some modifications to instruction #31.

State has no objection to #32. Archibald objects to some of the paragraphs and says the instruction gives more options for conviction rather than how Lori was indicted. He asks for the instruction to be removed.

Blake believes the instruction is appropriate and asks for it to remain in its current form. Boyce overrules the objection.

State has no problem with #33. Defense objects. Boyce overrules and says it will be given.

State does not object to #34. Archibald says the instruction does not contain the same language as the indictment regarding the grand theft elements. Boyce says he reviewed it and the instruction is appropriate. He lets it in.

Instruction #35 gets to the verdict form, Boyce says. The content of the verdict form will be part of this instruction. Blake asks that changes be made to questions #2, 4 and 5 by removing "and grand theft by deception."

Boyce says the changes need to be made. Blake has no objection to the way the instruction reads. Archibald says the questions ask if Lori is "guilty" or "not guilty" - but the checkboxes are reversed - "not guilty" and "guilty. "

He asks the questions say "not guilty" and "guilty" and need to be consistent. Boyce says the verdict form will be redrafted.

No objections on #36, #37, #38 and the final instruction of #39.

Archibald brings up another issue with the questionnaire and asks for some changes to be made.

Blake pushes back on the changes and wants the wording to remain the same. She says changing it will confuse the jury and asks Boyce to deny Archibald's request. Boyce says he's reviewed the matter and modifications will be made so jurors are not confused.

Boyce says a new verdict form has been prepared. We are taking a quick recess while the attorneys review it. We will be back in 10 minutes.

We are back from the break. State has no problems with the revised verdict form. Archibald says question #6 is very similar to questions #1 and #3. Boyce says that's how it was charged.

If there are any other revisions to the verdict form, he will let the attorneys know. Jurors will receive these instructions tomorrow and then closing arguments.

Boyce mentions that references to Chad Daybell's crimes on the indictment should be modified before being given to the jurors. State asks for clarification on how the information will be redacted. Archibald asks if Chad's name will also be deleted.

Blake says that will only confuse the jury. She says it will get very confusing if his name is removed. Boyce says the name should be removed from a part of the caption but it will remain in other parts.

Court is adjourned for the day.

Trial began on 4/3/23 with jury selection & ended 4/7/23. 12 jurors & 6 alternates (10 men & 8 women).
Trial began on 4/10/23 (thru 6/9/23) @ 8:30am to 3:30pm. Trial will be held in Ada County. (will last about 10 weeks) Trials have been severed.

5/10/23 Wednesday, Trial Day 21: Without jury today. Boyce met with the defense & prosecutors to work on jury instructions. Closing arguments will be heard Thursday morning.

*Chad Guy Daybell (53/now 54) – Status hearing on 5/4/23. Trial was set to begin on 4/3/23 was vacated & reset in June, 2024.
 
I don't think it will be successful, but I think the ruling by Boyce (on the motion for acquittal on the various charges) will be the BEST chance Lori has to escape guilty verdicts on any of the charges.

Why? Because Boyle will have to give a reasoned decision based on whether or not there is actual evidence that can be proof.

Whereas, the jury can let their emotions drive their decisions, and fill in the gaps where proof is missing. And I strongly believe the emotional reaction by the jury (to all the weird ideas, to the death of Charles, to the out-of-control sexual desires that violated marriage sensibilities, to the unchecked self-focus, and especially to the murder of a nice lady and two innocent kids) will be sizable and likely lead to a desire to see her punished extremely, whether or not they have holes in the proof they have been given.
 
OMG, tonight's Live is awesome. Per the norm Tricia is knocking it out of the ballpark! If you haven't tuned in to her livestreams.. they are informative, hilarious, and pretty much a no holds barred. I laughed so hard at the comments about Chad and Lori at the pool (when Lori was served papers). Certainly was true that Chad needed to borrow Lori's bikini top... man *advertiser censored*, LOL. :D

I've seen it go both ways. Judge just says nope and moves on and other judges meticulously go thru the evidence giving their opinion on it before providing their decision.
 
Thanks for looking into this. It's an important distinction, because I don't know of any witnesses that could have been called or things that could have been said that would have made a difference. Would any of us have changed our minds if we'd heard a bunch of witnesses wax poetic about what a good mom LVD was? Or heard an 'expert' talk about all the ways a hair could have ended up on a piece of duct tape? Even if LVD had testified about how she was brainwashed by CD and didn't realize he was talking about actually in-real-life killing people, I don't think that would have changed anyone's mind about what happened unless there was new evidence to back up that claim.

I could not care less how good a mom she was. Once she conspired or killed her kid or kids all that is canceled out. A mom's hair on her kid is not evidence to me so that is meaningless. I also dont care if she was manipulated/brainwashed by Chad.

I noticed that while Lori kept her expressions neutral her body betrayed her. Seems to me like she was breathing hard when she was perusing the paperwork. Bit of an adrenaline rush going on there I'd guess.

yep that yoga position did not come in handy at all to calm down her heart rate!

She is quite interesting how she presents herself to the non believers and the outside world. ( thats everyone except half a dozen people:p)

She is so giddy and bubbly when she is winning and in her element.

She is brooding and silent when she is not.

We can count on our hands pretty much how many words she has spoken since her arrest.


But we all know she is silently seething and has got plenty she would like to say and will never be given the chance.

Be getting pretty lonely in that space between her ears I'd say.
Time to step up the fantasy to live in now.
Wonder if she will turn it on fully when she is sentenced and end up in a mental facility anyway?
where would she go for the criminally insane if that happened??


As long as she faces Charles trial first.

So I think it’s possible she did it on purpose but to protect herself not LVD. I also think it’s possible that she just couldn’t help herself. Her ex had just testified and she wanted to know if he said anything that would incriminate her and she just couldn’t resist taking a peek.
