Arrested (in Kauai, Hawaii) on 2/20/20 & charged (6/30/20) & arraigned (9/20/20) with 2 counts of conspiracy to commit destruction, alteration or concealment of evidence. Bond was set at $5M & reduced to $1M.

Trial was set to begin on 7/12/21 has been vacated. No further dates yet.
Grand Jury convened from May 17 to May 20 re JJ Vallow, Tylee Ryan & Tammy Daybell. Indicted on 5/25/21 (see above).
Vallow was found incompetent to stand trial on 5/27/21. Transferred to mental hospital on 6/24/21.

12/3/21 Update: Motion hearing on 12/29/21 re Motion to Quash or modify subpoena duces tecum (a writ ordering a person (witness) to attend a court & bring relevant documents under his/her control to produce into evidence) filed by The Church of Jesus Christ of Latter-day Saints will be heard at 10am & William John Dalling & Idaho Dept. of Health & Welfare will be heard at 10:30am.
12/2/21 Update: Means response to State: Declared defendant counsel response & objection to motion for contempt. The hearing discussed Vallow’s extension of her mental health commitment according to this motion to seal filing. Judge Boyce agrees as he granted the motion & signed the order to seal. Vallow remains unfit for trial & incompetent with her case still on hold. 180 days will be next status hearing. Approximately on 3/7/22.
12/28/21 Update: Mark Means has been disqualified from representing Lori Vallow in Fremont County & all matters related to her case. Judge Steven Boyce signed the 17-page memorandum decision & order to disqualify counsel. Judge Boyce grants the State’s motion to disqualify Means. The motion cited conflict of interest, detailing these findings of fact. At one point Means represented both Lori Vallow & Chad Daybell. Per memorandum signed by Boyce, “Means’ practice of submitting declarations under penalty of perjury have called into question his ability to competently & effectively represent Vallow going forward, despite the pending stay in this case.” The court voicing concerns about a conflict of interest & Means possibly making himself a witness in the case amid the defendant’s current inability to face trial per Idaho Judge Steven W. Boyce. Means is not certified for death penalty cases, Boyce wrote. The judge noted that public defender R. James Archibald, who is qualified for capital cases, was appointed to cover bridge this gap in certification back in August. On top of that, the court has declared Lori Vallow incompetent to face charges, and are currently trying to have her get better for her pending trial. As if that was not enough, the judge said Means potentially made himself a witness in the case by revealing statements that Vallow made to him, potentially under attorney-client privilege. “Mr. Means has potentially made himself a witness in the case, by filing multiple pleadings in the form of declarations, containing factual assertions of Mr. Means submitted under penalty of perjury,” Boyce wrote. “That unusual manner of practice has further caused the Court to be concerned about the effectiveness of Mr. Means’ representation of Vallow in the case. Also of concern, is a possible intentional or unintentional waiver of Vallow’s attorney-client privilege, where Mr. Means has submitted to the record purported facts from statements Vallow made to Mr. Means under the umbrella of the privilege she enjoys, while she has been deemed incompetent to proceed. This is precisely the situation that ethics rules caution against, where the rules stress that lawyers should avoid becoming witnesses in their clients’ cases.” According to court records Means is still “active” in her case for misdemeanor charges in Madison County, regarding Vallow snubbing a court order to turn over her children back when they were considered missing.
12/29/21 Update: Motion hearings were continued with no date set. J. Archibald said he would talk to the lawyers representing the parties (the church & the DHW) to see whether agreement could be reached & if another hearing might not even be needed.
12/29/21: Motion request for amended Rule 16 Motion for Protective Order. Request for shorten notice. State prosecutors want the court to prohibit Lori Vallow & her former attorney Mark Means from publicly speaking about her case. This motion is to extend the protective order preventing dissemination of discovery which “contains many confidential, sensitive documents.” Notice of motions hearing on 1/5/22 @ 3pm.
