this is the first I've heard of Andrew & Connor arguing before he killed him.

Teen pleads guilty to murdering 10-year-old brother


"DEARBORN Co., Ind. - The teen accused of murdering his brother pleaded guilty Monday morning.

Prosecutors said Andrew Conley of Rising Sun, Ind. strangled his 10-year-old brother, Conner Conley, in November. Police said Andrew confessed to the murder, saying he placed Conner in a headlock, which caused him to pass out on the floor.

According to court documents, Andrew dragged his brother to the kitchen where he proceeded to strangle him for 20 minutes until he died. He then placed Conner's body in the woods behind a Rising Sun elementary school. Despite his age at the time, Andrew is being tried as an adult. Andrew Conley pleaded guilty knowing there was no possibility of an agreement for a shorter sentence...."

You know, this is weird for me, considering that I Look at so many cases all the time, but I never realized that after a person put in a guilty charge, there's still a small trial? They're doing his trial today and tomorrow, so I guess they just present the evidence, so the judge can decide on a sentence? Is that always done?
 
Even when there is a guilty plea, there must be a sentencing hearing. The judge must determine that the plea still stands, consider all the facts at hand, and then decide on a sentence. This is also the time when victims can make statements for the court to consider. I think it's quite similar in ever state in the US.
 
The police had him demonstrate on a teddy bear how he killed his brother...yes, he should be reminded that it was something (someone) small and innocent that he killed, but that sounds like a pretty strange thing for police to do, doesn't it?

Mother says Ind. teen joked after killing brother


"A woman has testified that her older son ate popcorn and joked with her the morning after he strangled his 10-year-old brother. Andrew Conley's mother, BC, did not attend his sentencing hearing Friday in court in Rising Sun, Ind.

She told attorneys during a videotaped deposition played in court that Andrew seemed "fine" when she returned from her night shift at a casino in November. She says she sought counseling for Andrew in the days before he strangled his brother, Connor Conley, because claimed he had attempted suicide...."

DAY 2: Andrew Conley calls himself a "monster"


"The second day of the Andrew Conley sentencing hearing was marked by several delays -- and the defense claims that some of them were due to the teen murderer's emotional state.

Court was in session for only a few minutes Thursday morning before Conley's attorneys approached the bench and the judge declared a recess. The court was scheduled to watch a lengthy video interview of Conley -- taken one day after the then 17-year-old strangled his brother...."

"....When court resumed again, the Conley's defense attorneys asked that he be allowed to leave the room during the presentation of the video.

"He is too emotional at this point and he is insisting that he does not want to be present," Conley's attorney told the judge, adding that Conley, "can't bear to hear any more."

The judge addressed Conley directly, telling him that, "I think it's very important that you be here...I want you to make your best efforts to remain here with us...."

Everyone can say anything they wish. However, in my opinion, what we have here is a very sick and very confused boy. Plain and simple. Two boys died that day and my heart goes out to their family.
 
One of the investigators in the video asked Conley if he got a "thrill" from strangling his brother to death. Conley replied that "I didn't' get a thrill from strangling him" because it was his little brother and suffocation is too "exhausting."

"If it was a knife and somebody else, I probably would have," he said.

seems like he knew that he would lose control someday

and he was cutting himself and tried to commit suicide

Meant to post this days ago, but got sidetracked -- so sad all the way around.

the judge sided with the prosecution, sentencing Conley to life without the possibility of parole, instead of a term of 45-65 years as the defense requested.

The judge cited a perceived lack of emotion on the part of Conley. Defense attorneys told reporters after the sentencing that this wasn't the case.

I followed this case, it is a tragedy all round, the parents must be besides themselves, to know one of there sons murdered there other son his brother and will now spend the rest of his life in prison
