Comes now Court and informs the parties and members of the public of the following safety precautions implemented due to the COVID-19 pandemic: (1) DEFENDANTS, ATTORNEYS, AND WITNESSES WHO HAVE BEEN SERVED WITH A SUBPOENA MUST ATTEND HEARINGS IN PERSON. NO OTHER PERSON WILL BE ADMITTED. This is because we are following the CDC's social distancing and masking recommendations, and seating in the Courtroom and hallway is very limited. (2)
In order to honor the Constitutional provision of open Courts and to accommodate non-essential persons, State of Indiana vs. Demetrius Jackson will be live-streamed on the Indiana Supreme Court's website at: IN Court Streams - IN Court Streams. All members of the public may watch the live proceedings on this website. (3) Although the Indiana Supreme Court has authorized video transmission of these proceedings to encourage social distancing and lessen the possibilities for spread of the COVID-19 virus the Supreme Court has not eliminated its general prohibition against cameras in the courtrooms and specifically has not altered its administrative rules prohibiting recording, re-transmission, or broadcasting, either live or delayed, without the court's express written permission pursuant to Indiana Judicial Conduct Rule 2.17. THEREFORE, IT IS STRICTLY ORDERED that no person viewing these proceedings may broadcast, televise, record or take photographs of these proceedings, either directly or indirectly, either by camera or computer-assisted program, application, or any electronic means whatsoever, while this Court is in session without the express prior approval of this Court and the Indiana Supreme Court. Failure to follow this Order shall constitute contempt of court and may subject the violator to sanctions including potential incarceration.
