What to expect when Brooks Houck appears in court Thursday for arraignment
Brooks Houck's attorney has requested his $10 million bond be reduced to $500,000 with the condition of a GPS monitor, if posted.

The defense team is asking for a $500,000 cash bond and GPS monitoring. The judge has turned it over to the prosecution for a response to the bond motion.
Shane Young said he has never asked for a $10 million bond until this case. This is the first multi-millionaire he has ever prosecuted for murder.

Judge has asked for time to read documents. Will discuss the written order on Houck's bond later. Court has been dismissed.
WHAS11 will provide more information once that becomes available.

Sherry Ballard's eyes filled with tears as they mentioned Tommy Ballard, her husband.
1:41 p.m.
The judge said he is very concerned for the safety of the witnesses.
He said his office is also investigating the murder of Tommy Ballard which they believe will be linked.
Young said they purchased a gun from Nick Houck and are currently testing it. They believe that was the weapon used to kill Tommy Ballard, Crystal's father who was mysteriously murdered a year after her disappearance.

Prosecutor Shane Young said Houck does have a loving, supportive family. "I completely agree, they've been supportive."
Grand jury proceedings are secret. In this matter, Young said Houck's sister, brother, mother, brother-in-law, and mother's boyfriend secretly brought in recorders and recorded the grand jury.
"I've been practicing for 28 years and have never heard of that!" he said.
Young is alleging Houck's family violated Kentucky law when they illegally recorded grand jury proceedings.
Young said Brooks Houck showed his sister how to run the same recorder in July 2015, the same month Crystal Rogers was murdered. He said they wanted to get their story straight.

Now the court is hearing the defense's motion to reduce bond. Butler wants the $10 million cash bond reduced to $500,000. He said in his 28 years of practice, he has never heard of a bond even close to that.
Houck's constitutional rights are being violated with this bond, Butler said.

The next court date scheduled for Feb. 8, 2024, at 1 p.m. for pre-trial.

Pre-trial is set for February to see if discovery is complete and they are ready for the actual trial.
Shan Young said he would be ready for a trial in the summer of 2024, but Defense attorney Brian Butler said "there is no way Mr. Houck can get a fair trial in 2024."

Brooks Houck is in court today on his charges in the disappearance of Crystal Rogers in Bardstown. His attorneys have argued his bond should be lowered from $10 million. They cited, among other things, that Houck’s co-defendant Joseph Lawson’s bond is only $500k.
The commonwealth just said that Lawson’s only possession is a truck, and that when he was arrested he was found naked in that truck. To Lawson, $500k “might as well be $10 million,” the prosecutor said.
The prosecutor also just said that members of Houck’s family illegally brought recorders and recorded closed grand jury proceedings in this case.

Link please if you have one. I hope the fact that all the Houcks were in on recording the grand jury that custody of E goes to the Ballards asap. Justice for Crystal, Tommy and all of Bardstown! Sounds like they have the goods on Nick too!

Just over an hour before arraignment of Brooks Houck. Lots of media here - and we expect a lot of Crystal Rogers’ family to be here. He’ll be arraigned on charges of murder & tampering w physical evidence in disappearance of Rogers

To no surprise, Houck’s attorney said they’ll likely ask for a change of venue. Lawyers ask for that when they believe a case has gotten too much publicity.

BIG NEWS: prosecutor says gun used in Tommy Ballard murder may have been bought from Nick Houck who was allegedly using a fake name. This is the first time prosecutor has publicly mentioned Brooks Houck’s possible connection to Ballard’s death.
Houck’s atty is now arguing for a lower bond. He says Houck won’t be a flight risk because he has stayed in Bardstown for 8 years knowing law enforcement named him as a suspect almost immediately.

Not only custody, but I hope they deny the bond reduction. He has a loving and supportive family can be good and bad.. in this case bad. Supportive does NOT mean committing illegal acts to help the person. That outta be enough to keep him locked up. Goodness this entire family thinks they are above the law.
