That is the allegation by the defense. Did any other witness corroborate that?

Not that I heard. I saw most of the testimony but not all; although I remember someone finding a phone on a lawn and just surmise that that was the one Joan took to the
phone store.

Edit to add: I believe she wanted them to unlock it though and they refused and called LEO's. Not that I was paying attention so I could be imagining that.

As it stands now,unless the state brings some huge evidence against Kit Martin. I don't see Probable Cause to even continue on. Not that I know anything about it; just watch trials.

So far...unless something huge happens...it may be one of those rare times when the defense asks for a mistrial because the prosecution has not proved their case, after both sides rests...it actually may be granted...although ‘this’ judge may not.

So Martin is charge with complicity ? with who? Joan and her son, who had moved out and on? When did they part ways?

Laura Spencer stated she and Kit have been together 8 years now. That's 2013. The murders happened in 2015. Why would Joan still be messing with Kit? Because it hadn't come to Court Martial yet?

None of the hairs or blood found were Kit Martins. The ME talked about the damage to Pam and Ed. Pam had been shot in the head and once in the heart. Ed had been shot 3 times in the head. I can't find a link to support the correct number. (If I get it I will edit if possible)

Neither side address how the phone came to be in Joan's yard, the sales rep lady also said it was Dec 22nd or 31st I think before she brought the phone in. So what did she do with it for a month or so. There is no reason for her or her son to take the 5th unless they will incriminate themselves or each other. Well, to do that wouldn't they also incriminate Kit? I think the witch thought she had him and is now realizing she's not as smart as she think she is. I could be wrong.

The lady for the Commonwealth is so annoying, she makes faces, loses track of what she's talking about, asks a question,gets an answer and changes subjects completely. She is also talking about one thing and then confusing yet and constantly repeating back to the witnesses what they just said. Is this a trick? An enforcement of 'info' to the Jury? Things like this didn't occur in the law office I worked at so I'm so blown away at the seemingly unprofessionalism. The defense could be making so many points and they are failing. The Judge is not high up on my esteem list either. He seems very biased.

As to not naming names. It is very hard to hear who is called. Names are NOT being put on the screen. The Judge, yesterday, finally had them start spelling their first and last names. So it's not just me who isn't catching names.

Hi All, I am just hearing about this case and watched the trial today which left me very confused. What is the alleged motive for Martin killing these 3 people? I've heard Calvin was going to testify against him but also Calvin was having an affair with his wife who was not really his wife because she was married to someone else ... ? Phillips (58) & Calvin Lee Phillips (53) (Nov. 19, 2015, Pembroke) - *Christian “Kit” Richard Martin (51/now 53) arrested & charged (5/11/19), indicted (5/10/19) & arraigned (5/22/19) with 3 counts of 1st degree murder, 1 count of arson, 1 count of attempted arson, 2 counts of 2nd degree burglary & 3 counts of tampering with evidence. Plead not guilty. Held without bond, changed (10/16/19) to $3M bond.
May, 2016 was convicted of 2 counts of mishandling classified materials & 2 count of assault on a child; sentenced to 6 months in jail & discharged from the military.
Trial began on 6/2/21 with jury selection & concluded. Trial started on 6/3/21 (Day 1) & will be in Hardin County moved from Christian County due to pretrial publicity. Jurors: 10 men & 4 women (2 are alternates). Juror is excused (6/7/21) for medical reasons. 1 alternate left.

Actually I remember..The defense attorney asked about Lt Stokes and discussed that he was taken off the murder case because his brother was dating Joan Harmon. Don’t know if she still is, but the jury heard that she was around the time of the murders.

What does he mean when he says "with the woman I thought was my wife, Joan Harmon, really Joan Garrett"? Voided for bigamy. How did he not know?

He was with Joan for eight years, thought they were married, but supposedly she was still married to a former husband...so bigamist. Lots of stories about her, so maybe another name she used.

I've only just started reading about this case.
I thought it would all become clear to me the more I read.

Instead I just keep getting more confused. What a cast of characters.

Every time I think I'm on the right track and it becomes clear in my mind, I learn a bit more and realise I'm right back not really knowing anything.

I keep going back to the prosecution’s opening statement and how lackluster it was. I’m getting a clearer picture of why now.

I think there is also a possibility he may testify.
