KY - Gabriella Doolin, 7, Allen County, 14 Nov 2015 #2 *Arrest*

5/3/19 Update: 180 to 200 jurors, Judge Crocker said, will be pooled from Hardin County -- a change of venue that became necessary because of the case's publicity. Defense attorney Griffith's made a motion in hopes of taking away jurors cell phones to prevent researching of the case -- something Judge Crocker over-ruled in favor of the court's standard admonition. It's unclear at this time how long the jury vetting & selection process will take. It will take a week, probably 10 days to get this jury empanelled Judge Crocker said. The Commonwealth's Attorney was granted his motion for a mental health evaluation by the Kentucky Correctional Psychiatric Center in Oldham County, to determine if Madden had any mental disease at the time of the alleged offense. The defense has submitted DNA samples for retesting. The next status conference, which will be telephonic, will be next month, to see if there are any additional motions or changes being made to the case. A motion to exclude the death penalty in the case was overruled.
6/7/19 Update: Status (phone) hearing. Judge approved defense motion to inspection of evidence against Madden. Next Pretrial conference hearing on 7/24, jury orientation on 8/5, final pretrial conference hearing on 8/9, and trial starts 9/4 in Hardin County.

Madden to undergo psychiatric evaluation, hearing dates changed

SCOTTSVILLE — The intended purpose of a telephonic hearing in Allen Circuit Court on Tuesday was to discuss procedural issues and scheduling matters regarding a mental health evaluation that defendant Timothy Madden was to have undergone at the Kentucky Correctional Psychiatric Center at LaGrange.
[.....]
Madden is being evaluated at KCPC because he alleged a mental capacity defense. Madden has already been found competent to stand trial.
[.....]
[Judge]Crocker explained she has urged [Timothy] Allen [Mental health evaluator] to proceed with Madden's mental health evaluation.

“I want this evaluation completed on Aug. 1,” she said. “If your expert can be there, fine, … but this evaluation has got to be completed and completed on time.”

The judge continued that the court can't move forward to a pretrial conference in the case at this point without the results of the mental health evaluation.
[.....]
As part of the mental health evaluation, Madden will be transferred from KCPC to the University of Louisville on July 31 where he will undergo an MRI on Aug. 1.

Originally, a pretrial conference was scheduled to take place in the case in Hardin County on Aug. 9. That hearing has now been cancelled and rescheduled for Aug. 7 in Allen County.

Jury panel orientation is scheduled to take place in Hardin County on Aug. 5. Crocker plans to obtain a list of juror questions and excuses for not serving on the jury by Aug. 7.

Another pretrial conference was scheduled on Tuesday for Aug. 24 in Allen County to hear any objections to jurors who have been excused and to take up any other matters.

A final pretrial conference will take place on Aug. 30 in Hardin County. It is during this hearing the court will walk through the logistics of the trial and discuss how to examine jurors on individual voir dire.

Trial is scheduled to start on 9/4.

Thanks, Niner, for the info on the trial -- we'll see if the trial actually begins on 9/4 -- It certainly should -- it's been long enough for justice to be held back for this little girl and her family, and for the citizens of the town.

Again, many thanks for keeping all of us up-to-date on trials and hearings -- you don't miss anything! ;)

Trial preparations nearly complete in Madden case

SCOTTSVILLE – With the trial of Timothy Madden a month away, attorneys on both sides indicated they anticipate being ready to proceed on the scheduled date.

At a pretrial conference Wednesday in Allen Circuit Court, Madden’s attorney, Tom Griffiths of the state Department of Public Advocacy, said he has been informed by his retained expert witnesses that DNA testing of certain evidence and a psychological evaluation of Madden have been completed.

Madden’s trial is scheduled to start Sept. 4 in Hardin County, where it was moved because of pretrial publicity and other factors.

In court Wednesday, Allen Circuit Judge Janet Crocker said 146 Hardin County residents have been summoned as potential jurors for this case.

Allen County Commonwealth’s Attorney Corey Morgan said he believed the jury pool was large enough to empanel a jury of 14 people, including two alternate jurors.

After the hearing, Morgan said he anticipated jury selection would take about a week.

Edited to add: I have his next court date as pretrial hearing on 8/24 in Allen County. Final pretrial hearing on 8/30 in Harden County.
