Criminal defense attorney Rachel Fiset, managing partner of Los Angeles-based Zweiback, Fiset & Zalduendo, spoke to Newsweek about the likelihood of finding Ana Walshe's body at this stage in the investigation, as well as the chances of convicting her husband.

"Ana Walshe's body seems unlikely to ever be found particularly as the Internet searches specifically suggest that part of the crime was dismembering her body and discarding it in a way that would go undetected," she said.

A foreclosure notice has been taped on Ana Walshe’s Washington, D.C., home as federal prosecutors seized two bank accounts from her husband, who is charged with her murder in Massachusetts.

Winter Hill Bank filed legal action in June to foreclose on unit 104 at 20 Vine St. (also known as 20 Huss Court) in Lynn, Massachusetts, which is in Ana Walshe’s name.

According to a federal court docket, Walshe has a status conference hearing set for 9 a.m. on Tuesday in federal court.

The case started in 2016 when a buyer saw two Andy Warhol paintings for sale on eBay. The listing, according to prosecutors, included photographs of authentication stamps. The buyer arranged to buy those paintings, part of the "Shadows" series, for $80,000. However, after having an assistant pick the paintings up, the buyer discovered there were no authentication stamps and that the canvas looked new. This ultimately led to an FBI investigation.

The prosecution and the defense asked the court to delay the case because of the pending murder charge against Brian Walshe.

"The parties are considering whether they might agree on a proposal for the court's consideration, which might resolve the federal case while the state case is proceeding," the court document read.

Prosecutors and the defense are asking to put off the case while he faces charges in connection with his wife’s death.

Brian Walshe, 48, was indicted for the murder of his wife, Ana Walshe, 39, in March, and was arraigned on the charge in Norfolk Superior Court in Dedham on April 27. At that time, Judge Beverly J. Cannone denied him bail and set a next court date for Aug. 23, this Wednesday, a date confirmed by the clerk’s office last week.

The case has been largely dormant since that time, minus a treasure trove of District Court-level filings that were released when the case was kicked up to the Superior Court, as the defense and prosecutors build their cases.

"Two persons in the Peabody community unconnected to the prosecution of Brian Walshe contacted State Police investigators with their belief that an area of that community may be of investigative interest in that matter," spokesman David Traub said in a statement. "A search of that area by the Massachusetts State Police SERT team yielded nothing."

Tuesday's search site was between Interstate 95 and a shopping center on Bourbon Street, less than one mile from the transfer station where several items connected to the case were found in January, including a hacksaw and a rug with blood. Ana Walshe’s body has not been found, but those items have been linked to her by DNA.

During Brian Walshe’s arraignment, prosecutors said he dismembered and discarded his wife's body parts at multiple transfer stations across eastern Massachusetts.

DNA evidence could be crucial to Ana Walshe murder case

NBC10 Boston Legal analyst Michael Coyne said the DNA is especially important in this case because investigators never found Ana Walshe’s body. Coyne said not only do prosecutors have to prove that he murdered his wife, they also have to prove that she’s dead.

“A bone fragment in and of itself doesn’t prove death necessarily. It proves she may have been injured, but they’re trying to prove first-degree murder,” Coyne said.

The DNA development comes after a community tip from two people prompted a police search of a wooded area in Peabody Tuesday. Authorities later said the search yielded nothing, but Coyne said the timing is curious.

“That is interesting that so much time has elapsed and both of these witnesses referred to the same place and the government feels that it’s sufficiently strong information that they undertake the search of that area,” Coyne said.

New DNA evidence expected to be discussed in Ana Walshe murder case

A pre-trial hearing which may include new DNA evidence is scheduled in the case of Brian Walshe, a Cohasset, Massachusetts, man who is accused of murdering his wife, Ana Walshe, and dismembering her body.

Items from the high-profile case were sent to an independent laboratory for DNA analysis in August. Prosecutors and defense attorneys are expected to discuss any new evidence that was discovered during Thursday's hearing.

Assistant District Attorney Greg Connor did not specify the items that were sent to the lab for DNA testing, but the prosecution previously revealed they had recovered numerous items with blood, including a knife, hacksaw and a hatchet.

Ana Walshe murder: New DNA evidence expected in Brian Walshe case

“The Commonwealth and the defense are still in the process of identifying and exchanging discovery. In addition, the Commonwealth is currently awaiting DNA analysis from an independent laboratory and is expected to have those results in approximately two weeks. Both parties are moving for the joint motion to continue,” court documents obtained by Boston 25 News in August stated.

In court on Thursday morning, it was announced that the hearing was postponed again until Jan. 23, 2024.

Attorneys give update to evidence-gathering process in Brian Walshe case

A prosecutor said that attorneys for both sides of the case recently had a conference call with a private lab called Bode, which the state sent about a dozen samples to. A number of those samples were said to be "quality limited," and testing was stopped. An expert for the defense is expected to visit the lab for a viewing.

The Commonwealth added that the state crime lab has completed its criminalistics, although attorneys have not yet received a final report.

Prosecutors will select some samples to be tested at the state lab.

Walshe's attorney said they expected to have "everything" by the end of the year ...

Here's the latest in case against Brian Walshe, who is charged with murder in wife's death

The state's crime lab has finished analyzing evidence in the death of Cohasset's Ana Walshe, lawyers said during a hearing in Superior Court, where Walshe's husband, Brian, is scheduled to be tried on murder charges.

Lawyers at Thursday's pretrial hearing discussed issues related to discovery, the process by which both parties share evidence they plan to present at trial.

Brian Walshe's defense attorney Tracy Miner said she expected discovery to be complete by the end of the year.

In April, Walshe pleaded not guilty to charges of murder, misleading a police officer and improper conveyance of a human body.

The next hearing in the high-profile case is scheduled for Jan. 23. Walshe, who did not appear in court Thursday, also waived his right to be present at the January hearing.

Brian Walshe's lawyer plans to withdraw from Cohasset murder case. What happens next?

It's unclear why his lawyer, Tracy Miner, wants to withdraw from the case. A message left with her office Wednesday morning was not immediately returned.

According to the DA's office, once the motion to withdraw is filed, it will be up to the court to decide whether to accept it, and, if so, to then appoint a new public defender.

WCVB reports that Walshe will now be represented by Larry Tipton, but the DA's office said it has not been notified of that yet.
