8/25/25 Update: Lawyers for Walshe are seeking to appeal a judge’s decision not to suppress a number of grisly Google searches prosecutors say he made shortly after the killing in early 2023. But Walshe’s lawyers argued in court papers, and at a hearing in June, that the State Police investigators who uncovered the searches overstepped the bounds of an agreement reached with his former lawyer. The lawyer, Tracy Miner, testified at the hearing that she reached an agreement with prosecutors to allow police to search the devices only for communications, not to download their entire contents. Judge Diane Freniere ultimately discounted Miner’s recollection of the agreement, finding she likely understood police intended to download & search the entirety of the devices. Walshe’s lawyers are now petitioning a single justice of the Supreme Judicial Court to intervene & reverse Freniere’s decision. Walshe’s lawyers argue that Freniere erred in finding State Police Sgt. Yuriy Bukhenik, one of the investigators on Walshe’s case, more credible than Miner. “The trial court does not discuss the inherent inconsistency of Bukhenik’s own report & testimony,” the filing reads. Walshe’s trial is set for Oct. 20. He has pleaded not guilty to first-degree murder. An appeal to the SJC could substantially delay the October trial date. A single justice of the SJC could decide to hear the appeal themselves, or send it to the full court or the Appeals Court for a determination. There is no requirement the justice allow Walshe’s lawyers to actually appeal the order. Next discovery motions hearing on 8/28/25 @ 2pm.
8/28/25 Update: During a brief 10-minute status hearing in Norfolk County Superior Court, Brian & his attorneys appeared via Zoom but did not speak. Assistant District Attorney Lisa Beatty provided updates on ongoing discussions between state & federal prosecutors regarding the controversial “Proctor files.” Judge highlighted a key concern raised by defense attorneys: how can they challenge the withholding of records if they don’t know what those records contain? The Commonwealth was asked to address this procedural dilemma before the next hearing. The next status hearing is scheduled for 9/15/25. The court will expect further clarification on the document review process & the Commonwealth’s response to defense concerns regarding the challenge of withheld evidence.
9/11/25 Update: Norfolk County prosecutors are urging a justice of the state’s highest court not to pause or delay Walshe’s October trial to review his claims that police illegally obtained Google searches he made on his son’s iPad. Not long after prosecutors say Walshe killed his wife, Ana, he searched, “how long before a body starts to smell,” “how long for someone to be missing to inheritance?” & “dismemberment and best ways to dispose of a body,” among other terms. Walshe is charged with murder in connection with his wife’s death. Her body has never been found. Walshe’s lawyers filed motions to suppress the evidence pulled from his phone & his son’s iPad, as well as evidence prosecutors obtained after several search warrants. They claim police investigating Walshe went beyond the scope of an agreement with his lawyer about searching the devices. But the judge presiding over his trial, Diane Freniere, denied those motions, a setback for Walshe’s defense. In the wake of the denial, Walshe’s lawyers petitioned a single justice of the Supreme Judicial Court to review the lower court judge’s decision — a process that would likely delay the start of his Oct. 20 trial. Prosecutors urged Justice Scott Kafker to deny the appeal without reviewing it on its merits. Kafker could decide to hear the appeal himself, or send it to the full court or the Appeals Court for a determination. Or, Kafker could decide to deny the request to appeal entirely.
9/11/25 Update: See post #882, page 45, thread #4 for motions & appeals filed from 8/22/25 thru 9/11/25. 9/12/25 Update: Walshe was stabbed last night according to his attorney at the Norfolk County House of Corrections in Dedham. He was taken to the BI, treated & has since been returned to the Dedham jail.

"Supreme Judicial Court Justice Elizabeth Dewar denied an appeal made by Walshe’s attorneys to suppress key Google searches found on his phone and two tablets belonging to his children. The searches include, “How long before a body starts to smell,” “How long for someone to be missing to inheritance?” and “Dismemberment and best ways to dispose of a body.”

Walshe’s attorneys claim police went beyond the terms of a consent agreement when searching the phone and tablet, but the justice said allowing the appeal would not facilitate the administration of justice.

Walshe’s lawyers can appeal this decision to the full Supreme Judicial Court."

9/15/25

The hearing was focused on efforts by Walshe and multiple other defendants in Norfolk County murders to prevent the scheduled destruction of key evidence linked to former Massachusetts State Police Trooper Michael Proctor.

The lawyers have been waiting months for the Norfolk District Attorney's Office to release critical evidence, including between 3,000 to 5,000 pieces of communication stored in Proctor's cloud account. Similar evidence led to Proctor being fired for misconduct in the high-profile murder case of Karen Read, who was found not guilty in June.

But before that information can be released, the district attorney's office said it must receive permission from the U.S. Attorney's Office, and they requested additional time to get that clearance at Monday's hearing.

[..]

But he scheduled a follow up hearing on Sept. 25 at noon to get an update.

9/15/25

In Norfolk Superior Court on Monday, state prosecutors said officials reviewed materials found on former Massachusetts State Police Trooper Michael Proctor’s phone. There’s a federal order connected to the Karen Read trial saying the materials should be destroyed by mid-October.

"We have completed our review and we are continuing our conversation with the U.S. Attorney’s Office and recognize that’s not a lot of information that we have for the court but that’s the extent of the information we have for the court today," prosecutor Lisa Beatty said.

Prosecutors did not disclose exactly what was found. It's believed the information could affect several cases, including Walshe’s murder trial.

"Have you come to the conclusion that certain information supplied to you is confidential information should be turned over in these cases?" the judge asked.

"All I can say is that we are in conversation with the U.S. Attorney’s Office as a result of our review," Beatty said.

Also on Monday, Supreme Judicial Court Justice Elizabeth Dewar denied an appeal made by Walshe’s attorneys to suppress key Google searches found on his phone and two tablets belonging to his children.

He probably “stabbed” himself to buy time. He is such a liar.

I believe this is a new article.

Sept. 18, 2025

Brian Walshe, the Cohasset father accused of murdering and dismembering his wife, Ana Walshe, may seek to have his upcoming jury trial moved out of the Norfolk County Courthouse in Dedham. Court records reveal his lawyers are researching media coverage of his case and that research could be used to request a change of venue.

Walshe, who is considered “indigent” and is being represented by taxpayer-funded public defenders, was recently granted a court-approved initial payment of $6,000 to hire a “media expert” according to his public docket sheet.
[.....]
The paperwork filed by Walshe’s lawyers regarding the funding request has been sealed, preventing public access to the documents. Walshe’s legal team did not respond to a request for comment, and Scott Farmelant declined to comment.

Next hearing date 9/25/25 @ noon & then I have final pretrial hearing on 10/7/25 @ 9am.
