A Massachusetts state judge said he's ordering that sealed evidence from the federal probe of the Karen Read investigation be preserved — it was scheduled to be destroyed by Friday, but a lawyer for Brian Walshe had asked for it not to be.

The latest twist in the ongoing legal battle involving several Norfolk County defendants' push to access evidence from Michael Proctor's cellphone from the Read case came at the end of the second of two hearings Thursday in Norfolk Superior Court.

Some of that grand jury material involving Proctor, the former Massachusetts State Police trooper who led the Karen Read investigation, was allowed to be turned over to defendants, and they reviewed it — the Norfolk County District Attorney's Office had asked in federal court for permission to share evidence they determined could be exculpatory for the defendants.

A Norfolk County judge has set the dates to begin Brian Walshe’s murder trial weeks after ordering the defendant to undergo a mental health evaluation at Bridgewater State Hospital.

Judge Diane Freniere at a conference review hearing on Friday set his next competency hearing for Nov.14, with the final pre-trial conference on Nov. 17. Jury selection is set to begin Nov. 18 and last about two weeks.

Freniere said she hopes to wrap this trial up by Christmas.

Of course, Freniere said, “Hope is not a plan,” while setting the hearing dates to choose 16 jurors for the case.

Freniere also explained how the jury selection process will work and asked that the prosecutors and defense submit their final motions by next Friday.

9/18/25 Update: Walshe may seek to have his upcoming jury trial moved out of the Norfolk County Courthouse in Dedham. Court records reveal his lawyers are researching media coverage of his case and that research could be used to request a change of venue. Walshe, who is considered “indigent” & is being represented by taxpayer-funded public defenders, was recently granted a court-approved initial payment of $6,000 to hire a “media expert” according to his public docket sheet. Next pretrial hearing on 10/7/25 @ 9am.
9/25/25 Update: Prosecutors told a judge Thursday that they believe they have a potential way of providing the materials, but still need at least a couple more weeks to finalize the plan with the U.S. Attorney's office. Lawyers for Walshe & other murder defendants have been waiting months for the Norfolk District Attorney's Office to release critical evidence, including between 3,000 to 5,000 pieces of communication stored in Proctor's cloud account. Similar evidence led to Proctor being fired for misconduct in the high-profile murder case of Read, who was found not guilty in June. Thursday's hearing was very brief, with the judge continuing it until 10/7/25. He said it's possible that hearing might not even be necessary, as the information might be able to be shared via letter. If the hearing is necessary, he said they'll determine next steps at that time.

10/6/25 Update: Walshe's murder trial delayed. He has been hospitalized by court order for a competency evaluation. On Monday, a judge ordered Walshe be hospitalized for 20 days at Bridgewater State Hospital to determine if he is competent to stand trial. It is not clear what prompted the evaluation. Later in the day in a separate court filing, the court rescheduled the start of Walshe's trial. It is not known when the trial would get underway. Walshe is due back in court 10/27/25 for a competency hearing. Defense attorney Larry Tipton said in court that Walshe's mental & physical health has declined since he was attacked in jail last month & is not well enough to participate in the preparation for his trial. Prosecutors opposed the delay. Part of the request stemmed from a stabbing in jail last month, they said, but prosecutors noted that Walshe was back in his cell shortly after & there were no medical records to back up a competency concerns.
10/22/25 Update: Prosecutors will hand over materials related to former state police investigator Michael Proctor collected as part of a federal investigation to defense counsel in five criminal cases, including the high-profile murder case against Brian Walshe. At a brief hearing Monday, Oct. 20, First Assistant DA Lisa Beatty said her office reviewed all the materials provided by federal authorities investigating Proctor's conduct in the Karen Read case. Of the materials from the federal investigation, a subset was determined to contain potentially exculpatory evidence which the Norfolk DA will hand over to defendants in five cases Proctor investigated, including Walshe's. Beatty told Judge Peter Krupp that an index was produced of all the materials received by the Norfolk District Attorney's office, not just those materials designated as potentially exculpatory. That index will be handed over to the defendants as well. "The defense will know all of the stuff that you reviewed?" Krupp asked. "That's the intention, so there's no big mystery about what the other materials were," Beatty replied. Krupp set an 10/30/25 hearing to give defense lawyers in the five cases an opportunity to request other materials after reviewing the index. Walshe is currently at Bridgewater State Hospital undergoing a competency evaluation. A hearing to determine his competency is scheduled for 10/27/25. If Walshe is determined to be competent, his trial will start on 11/17/25, according to the case docket.
10/23/25 Update: According to court records, Walshe’s next hearing, which was set to start Monday, 10/27/25 is now delayed or cancelled. Walshe is undergoing a mental health evaluation at Bridgewater State Hospital ahead of his trial. The hospital requested an extension on his evaluation Thursday & a judge granted that request. His murder trial was expected to begin in November, but this could push it back. Walshe’s trial has been delayed before — it was initially set to start this month, but a judge ruled he must first undergo a 20 day evaluation. It’s unclear if his trial will start on time.
10/24/25 Update: A new order requires the defendant to present Walshe at a pretrial conference on 11/17/25. The order means that the murder trial will be continued until the judge determines that Brian is competent to proceed. The motion to continue also alleged that prosecutors conducted additional DNA testing — the results of which are still not available — without notifying the defense. It also accuses the prosecution of withholding evidence “favorable to” the defendant, but does not specify what that evidence could be.

Venue change request denied. Presumptive prejudice has not been shown. Judge said she reviewed media coverage and found it to be factual.

If jury selection goes according to schedule, the rest of the trial will begin December 1st.

Freniere explains denial of venue change motion​

Walshe's team argued that publicity has encouraged a bias against him in Norfolk County.

Freniere concluded that the media coverage did not rise to the level of creating a "presumptive prejudice" among potential jurors in Norfolk County.

She added the defense has not proved "sensationalistic coverage" to justify a change of venue, nor shown there exists a prejudice specifically among people in Norfolk County.

As for the motion to have jurors brought in from another county, Freniere used similar reasoning to explain her denial.

Next final pretrial hearing on 11/17/25 @ 9am & Tuesday, 11/18/25 starts jury selection & trial will begin 12/1/25 after Thanksgiving.

11/17/25 Update: A number of procedural issues were discussed during the hearing — including new Google searches discovered on devices in the Walshe home. Attorneys requested that Mr. Walshe be allowed to remove handcuffs during the proceeding. Judge Diane Freniere said she did not have an objection but asked they check with the court officers. She said he would not be cuffed during the trial. The court went through several motions pertaining to some housekeeping matters in the upcoming trial. Judge Freniere discussed the jury questionnaire & the technicalities of the selection process. Freniere said she wants to have the potential jurors agree not to be on social media or watch the news at all. "I think it's a necessary ask," she said. There were no objections to this. The Commonwealth wishes to show a video of Ana Walshe during the trial because of a rug featured that was allegedly later found in a dumpster. The defense objected to the showing of the video, saying a screenshot would suffice. Judge Freniere reviewed the video. She agreed with the defense. The Commonwealth & defense are arguing about which conversations can be presented to the jurors. The state wants to include the conversations, particularly with Ana's close friend Alyssa Kirby, to illustrate both Ana's & Brian's state of mind. The defense says the Commonwealth is cherry picking what they want to include & overstating their relevance. Judge Freniere says she will allow conversations with Alyssa Kirby 7 encouraged the defense to bring in other parts of the conversation they feel prosecutors leave out. The court moved on to discussion surrounding inclusion of text messages between Ana & William Fastow, who she was apparently having an affair with. The defense argues that there is no proof Brian Walshe saw the messages, so they shouldn't be allowed. Freniere said they would discuss the messages at a later point. The Commonwealth says additional Google searches have been found since the initial indictment. The defense argued their applicability to the case. Some issues remain outstanding, including complexities like whether statements by Walshe's former attorney, Tracy Miner, can be included. She represented him during his prior federal case & was present when Walshe spoke with investigators about his wife's disappearance in 2023. Next Jury selection to begin on 11/18/25.

I don't like that he can plead guilty without at least having to explain where he disposed of AW. Court TV is unclear on what he is actually pleading guilty to and seems to be suggesting that it's toward the lessor charge or indictment. I guess we have to wait a bit for clarity.
