Nagel: The brake lights were on. It moved up about another car length in front of us. Did not see any damage on the SUV. Didn't see anybody get out of SUV.

As Ricky pulled out to go around SUV, Ryan Nagel says he noticed dome light was on inside the parked SUV, woman with long hair in driver's seat. "Seemed like she was looking straight, hands on the steering wheel, 10 and 2," he says. Didn't see anyone in the SUV.

Ryan Nagel just said he may have talked to the "feds" in May 2023. That is the first time the federal investigation has been directly referenced and it comes from a commonwealth witness.

So, where was JO if he wasn't in the car? The dome light was on and there was no sign of him according to this witness.

Nagel testified that she had initially texted her brother, Ryan, to ask for a ride home from Albert’s birthday celebration. She said she looked out the window and noticed an SUV outside 34 Fairview Road before her brother arrived but denied seeing anyone get out of the SUV. Nagel said her brother pulled up to the house with a couple friends sometime after midnight, and she went outside to talk to them. When they declined to come inside and indicated they wanted to head home, she said she’d find another ride.

That didn't work well for Lally. Ryan just refuted his sister's testimony on KR's car being present or not when she came out of the house. Just another example of how unreliable her testimony is. Why is Lally calling witnesses that just seem to bolster the defense?
He's calling them because if he doesn't, he knows the defense will. So may as well get your first shot in and make it seem to the jury that such testimony isn't so very damning to the CW's case.
But it is. Very much so.

I'd argue it's not just his tactics. He really doesn't have much to work with. Hence the general Eeyore demeanor and frequent sighs.

I almost felt a little sorry for Lally this am. The fact that he had to call in a witness completely out of order. The Vet DNA expert was another dud. Possibly due to the fact that he wasn't able to set up the foundation of PROPER EVIDENCE COLLECTION, the information obtained was just decimated by the defense.
By the time they get to the magical fairy dust sprinkled tailight on JOK's clothes, the jury is gonna loose it.

She’s a nanny.
She is Ryan Nagel’s ex girlfriend.
She was with Ryan in the vehicle that went to Fairview.
Re-hashing Ryan’s testimony of the night.
They went to CF McCarthy’s, then Hillside.
Maxon doesn’t recall as much detail as Ryan did, but she doesn’t seem evasive to me.

The female was driving.
Ricky parked the truck by the mailbox.
The truck was parked right behind the SUV.
It stayed still, she says, the entire time they were there.
