Police arrest husband of Chula Vista mother who disappeared in January; body still missing

CHULA VISTA —

Maya “May” Millete wanted a divorce. Her husband did not.

Authorities say Larry Millete sought help from spellcasters — he wanted magic to make his wife want to stay.

Then, according to San Diego County District Attorney Summer Stephan, his wishes grew darker. He asked that she be incapacitated, that she have an accident, broken bones to keep her at home.

In January, 39-year-old May Millete vanished.


On Tuesday, nine months after his wife disappeared, Larry Millete was arrested on suspicion of murder. He was jailed without bail in a case that has drawn wide media attention from national talk shows to People magazine.

Millete, 40, is scheduled to be arraigned Thursday afternoon in Chula Vista Superior Court.

No body has been found, but prosecutors said they have enough to charge him with murder.

“As the evidence unfolded in this case, it pointed in one direction — that May was murdered,” Stephan said at an afternoon news conference announcing the development in the case.


Millete’s attorney, Bonita Martinez, said before the news conference that she was “very, very surprised” after learning of the arrest because neither May Millete, nor her remains, have been found.

“We have speculation right now,” Martinez said. “Without a body, it’s just mere speculation. They have to have some proof that she is dead.”

California law allows prosecutors to charge a person with murder even when the victim is presumed dead and no body has been recovered, Stephan said during the news conference.

“The law is so crystal clear that we cannot let someone murder someone and gain a benefit by hiding the body in a way that we cannot discover it,” she said.

Stephan said the fact that a person is missing and there is no proof of life is circumstantial evidence of foul play and murder.

Aside from murder, Larry Millete is charged with illegal possession of an assault weapon, a felony. His attorney said Millete “is a good man.”

“There is no evidence of any proof of any violence of any sort,” Martinez said.

According to the documents, a friend told investigators Maya confided that “at one time in the past, Larry had choked May until she passed out.”…..
During the investigation, detectives located surveillance footage and observed May park her Jeep Rubicon on the street in front of her residence on January 7 at 1642 hours. Investigators have obtained multiple sources of video surveillance from the neighborhood and there is no surveillance footage capturing May leaving her residence after she arrived on January 7, 2021 at 1642 hours. She is last seen at that time walking towards her residence.”

His arraignment is scheduled for Thursday afternoon.

They say they found evidence he also googled things like "plant you take to never wake up" and drugs such as Rohypnol, the so-called date rape drug.

According to the warrant, family members described Larry's behavior as "controlling" and "stalker-like."

Investigators say Larry emailed spellcasters daily to try to get May to fall back in love with him, but eventually, those emails turned violent. One from December 31 states "Can you hex to have her hurt enough that she will have to depend on me and need my help. She's only nice to me when she needs me or sick. Thanks again. Maybe an accident or broken bone."

The warrant also revealed May had confided in a friend about her marital issues, revealing one time in the past Larry had choked her until she passed out.

January 6, investigators say May stated to a friend via text "I told him I'm filing for divorce whether he likes it or not. I'm done trying to make it amicable for the sake of the kids."

10/19/21 Update: Millete has been arrested on suspicion of murder in the disappearance of his wife Maya “May” Millete, a Chula Vista mother of three who was reported missing nine months ago, police said Tuesday. The Chula Vista Police Dept. SWAT team arrested Larry at 11:42am Tuesday at his home, police Chief Roxana Kennedy said in an afternoon news conference. He was alone at the time of his arrest. He was booked into jail, where he was being held without bail, District Attorney Summer Stephan said. The investigation included more than 67 search warrants, 87 interviews & review & investigation of more than 130 tips, Kennedy said. Stephan said her office filed a criminal case in San Diego County Superior Court on Monday charging Millete with murder. Larry has also been charged with one count of possession of an illegal weapon. She said the case was filed based on evidence that was developed during an extensive nine-month investigation. He had been withdrawing large sums of money from the bank in the days leading up to his arrest, making it look like he was going to flee, according to Little, an attorney working with Maya's family. Murder: Millete is scheduled to be arraigned Thursday, 10/21/21 at 1:30pm at the South Bay courthouse.

“The Children are in an extremely fragile emotional state. Larry is preying upon their young minds and utilizing his parents to directly violate Court orders. Enough is enough. Larry’s actions must be stopped,” the petition said.

The bail review hearing was held on Thursday for Larry Millete who is accused in the killing of his wife, May “Maya'' Millete.

Judge Maryann D'Addezio said the court must operate under the belief the allegations against Millete are true when setting bail. She said Millete is accused of murdering his wife while the children were at home and taking the 4-year-old with him to dump her body. She denied Millete's request for bail.

Deputy District Attorney Christy Bowles told the judge Millete is not only a danger to the public, he also is a danger to the couple's three children.

"They were at home when this incident occurred. We have information there had been property damage in the home when the defendant had been angry on prior occasions. There have been manipulation tactics by the defendant to control and manipulate May, and I think it's reasonable to believe he would transfer those to his children as well," she said.

Thursday’s court appearance comes after prosecutors filed a court motion aimed at keeping him in jail.

Outside the courtroom, Martinez told News 8 there's no evidence May is dead.

"You cannot rule out the theories that she disappeared on her own volition or her own will. We believe she's still alive. The problem here is the investigation of the authorities is focused on her death," said Martinez.

In a November 2 response entitled "Defendant Request to Set Bail" Martinez alleged, "May had wanted a divorce, and was having an affair with a married man, whose wife was pregnant at the time. May Millete had an abortion prior to her disappearance on or about January 8, 2021. May had expressed interest in leaving the family. She had been intoxicated more frequently, out drinking with friends and her relatives, and other men. May had been acting erratically and locking herself inside her bedroom and would not allow the children to see her at times and she would not join the children for breakfast, lunch or dinner."

Judge Denies Request By Maya Millete's Sister for Custody of Kids; Permits Visitation

In a court petition, Maricris Drouaillet sought temporary custody of the Millete children – ages 5, 10 and 11 – and planned to request permanent custody at some point in the future. Instead, the children will remain under the care of their paternal grandparents as their father, Larry Millete, remains in jail without bail.

The judge did, however, grant visitation rights to the children's relatives starting Nov. 14, when Maricris and her family will meet with the kids from 12-3 p.m. The petition stated that the maternal relatives had only one telephonic meeting with the kids, which was supervised by Larry, since Maya went missing in January 2021.

In other developments on Wednesday, the judge ordered Larry's parents to find mental-health care providers for the children.

The next hearing on the children's custody has been scheduled for Jan. 14.

Do you - anyone that is - believe these are TWO different dates for guardianship hearings? Or one of them is incorrect?
