CLAIRMONT: Even when absent, a Bosma presence
By Susan Clairmont Jan 19 2016

The differences are subtle but significant.

The rat-tail braid in Dellen Millard's hair is gone and there's a new ring on his wedding finger.

Mark Smich has abandoned his straight-ahead stare to lock eyes with prospective jurors.

Tim Bosma's family is, for the first time, not in the courtroom.

In its very first day, this murder trial has changed from the case's earlier appearances in the courtroom. It is also unlike any murder trial ever seen in the Hamilton courthouse.

Some of those differences are almost certainly because the case has now entered a new phase.

CLAIRMONT: Jury duty is not for the faint of heart
By Susan Clairmont Jan 20 2016

For some members of the public, just being called for jury duty is a stressful experience, let alone actually being chosen to sit in judgment on a high profile homicide case.

"I have anxiety around this trial," a man summoned for jury duty on the Tim Bosma murder trial told the judge Tuesday. "I just get uncomfortable."

He was quickly excused.

Over two days now, about 350 potential jurors have gone before Justice Andrew Goodman to state whether or not they are willing and able to sit on the four-month Bosma trial.

At least half have been excused or deferred to another trial, mostly based on economic hardships and medical issues stemming from such a long court process.

But for a number of other candidates, the possibility of jury duty led to emotional reactions that prompted the judge to dismiss them from this trial's panel or, in some cases, from any trial panel.

Jury selection day 3
January 20, 2016

The accused, Dellen Millard and Mark Smich watch each potential juror go by, occasionally smiling. Many people have been excused for knowing the victim, and one of those Tim Bosma family friends today muttered at Millard and Smich as he was leaving.

Tomorrow the second phase of jury selection will start, the potential jurors who agreed to serve will now be tested by the lawyers and accepted or dismissed as jurors.

Bosma case: man curses at Millard, Smich during jury selection
By Adam Carter, CBC News Jan 20, 2016

One man couldn't keep his composure during jury selection Wednesday for the case of two men who have been charged with first-degree murder in connection with the death of Ancaster, Ont.'s Tim Bosma.

For the third straight day, prospective jurors were called in front of Justice Andrew Goodman to explain whether or not they could serve for the trial in the Bosma case.

The eight were chosen through a legal proceeding called the "challenge for cause process" where each potential juror is screened.

The details of that process are sealed under a court-ordered publication ban.

For the first time, members of Bosma's family were in the courtroom to watch. They sat in the back, far away from the two accused, sitting in the prisoner's box.

Thirteen jurors picked for Bosma case
By Molly Hayes Jan 22, 2016

They are just three people short of securing a jury for the Tim Bosma murder trial.

Thirteen jurors were sworn in by end of day Friday: seven men and six women.

Of this bunch, six were picked Friday and eight were picked Thursday — one of whom was excused after the fact.

In total, the jury will be composed of 14 people, plus two alternates. This is larger than the standard 12-person jury, due to the expected length of the trial, which could take four months.

Friends and family of Bosma were in court again Monday, along with Hamilton Police Det. Sgt. Matt Kavanagh, who led the investigation.

Millard and Smich were present, as they were for each day of the jury selection.

The questions that were put to prospective jurors — to assess their view of the case and any bias they might have — are still covered under a publication ban. That will be lifted, Justice Andrew Goodman reiterated Monday, only when the trial begins and they are certain no more jurors need to be chosen.
