JOLIET — The parade of witnesses before the grand jury investigating the murder of Drew Peterson's third wife and the disappearance of his fourth resumed Thursday with his former divorce lawyer and an old in-law summoned to testify.
The grand jury, which convened more than a year ago, last met since before Thanksgiving. On its first day back in action, Alexander Beck, who represented Peterson in his unresolved divorce from slain third wife Kathleen Savio, was called. So was Charlie Doman, Savio's nephew and a former employee of Peterson.
 
Estate case of Peterson's ex-wife argued

Attorneys for former Bolingbrook police Sgt. Drew Peterson made oral arguments before an appellate court Tuesday that the estate of his third wife, Kathleen Savio, never should have been re-opened despite a new autopsy that indicated her 2004 death was a homicide.

The appellate court said that it would have a ruling "soon."

Afterward, Peterson's legal team said that they are optimistic that the court would rule in their favor. If it does not, and Savio's family files a wrongful death lawsuit, Peterson's lawyers would be given subpoena powers to interview witnesses who have been called before the grand jury investigating the cases.

"We're going to be very aggressive," said attorney Andrew Abood.

Peterson spoke briefly outside the courthouse, making a joke about Fox News' Geraldo Rivera and commenting about embattled Gov. Rod Blagojevich hiring the same public relations firm he's retained.

"Probably a wise decision," Peterson said. "They've done very well for me."

Then he signed autographs for two men in a pickup truck.

Drew Peterson Arrested in Connection With Death of Third Wife

Illinois police and prosecutors are scheduled to hold a news conference at 8:30 p.m. CDT Thursday about the murder indictment. Peterson is accused of killing Kathleen Savio, who was found dead in a bathtub in her home on March 1, 2004.

MyFOXChicago.com reported that Peterson was arrested at 5:35 p.m. Thursday after state police surrounded his car at an intersection. Peterson was alone in his car at the time.

State police later searched Peterson's home, MyFOXChicago.com reported.

Peterson's attorney told FOX News that he was unaware of the arrest.

The documents were stolen from an Illinois State Police car then photocopied and dropped off for anchor Jeff Goldblatt. Inside is information never before seen by the public including a timeline of what happened to Stacy, a list of 59 leads, and the police report from the night of Kathleen Savio's murder.

"I was shocked by what was in there, I was really, really shocked," said Charlie Doman, Kathleen nephew. Doman received a copy of the documents after the Post Office found the papers, saw the Savio name, and delivered them to his mom.

Doman eventually returned his copy. But you can see why police wanted them. The timeline alone lays out in great detail what investigators think happened to Stacy Peterson and what Drew did with her body. According to the documents, they note Stacy was dead by 10:59 am on October 28th. That night, they describe Drew removing the body with his step brother Tom Morphey in a "large blue round plastic container weighing approximately 150 pounds with screw on top with clear plastic protruding from outside."

The Will County state's attorney's office says the indictment was issued Thursday in the death of Kathleen Savio. It did not immediately give details but scheduled a news conference for later Thursday.

Bolingbrook police say Illinois State Police arrested Peterson on Thursday. A state police spokesman did not immediately return phone messages from The Associated Press.

Peterson's attorney, Joel Brodsky, says in an e-mail that he's on his way to New York and referred messages to Peterson's publicist, Glenn Selig. Selig says he can't confirm Peterson's arrest.

Years ago, when officials determined her sister Kathleen Savio's death was an accident, Anna Marie Doman never thought she'd see Drew Peterson held responsible.

But that day came Thursday.
"I screamed," Doman said. "My brother just called me and said the state police called him so I know it's for real."

Doman said she had heard rumors of Peterson's imminent arrest before, but did not get her hopes up.
"When Henry (Savio) called, I'm like, say it again. Say it again," Doman said. "I wish I could call Kitty (Kathleen Savio) up. Anytime something big happened, that's who I'd be calling."

Peterson wasn't named a suspect in Savio's death, but state police determined the disappearance of his fourth wife, Stacy Peterson, is a "potential homicide" and say he is a suspect in the case.

Reached by phone shortly after Peterson's arrest was reported, Pamela Bosco, a spokeswoman for Stacy Peterson's family, said they had dreamed about Peterson's arrest.

"We anticipated the day, we had been patient waiting for it for what seemed like forever," Bosco said. "We're in full support of the Savio family. We'll patiently wait again as this unfolds."

Bosco said the new development gives them hope they will get answers about what happened to Stacy.

Charles B. Pelkie, spokesman for the state's attorney in Will County, Illinois, said a grand jury indicted Peterson in the murder of his third wife, Kathleen Savio, whose death had been ruled an accidental drowning.
He said the grand jury continues to meet and is studying the possibility of charges in Stacy Peterson's disappearance.

The news was also bittersweet for Stacy Peterson's family, who continue to wait for news about her disappearance.
"We have anticipated this coming. We have dreamed about it. We have been patient over it," Pam Bosco, spokesperson for Stacy Peterson's family told WLS-TV. "Now that it's here, it's almost a little bit calm. We're waiting for the storm to calm now. The calm before the storm."

Ernie Raines is also relieved about the arrest. His daughter, Christina Raines, is dating Peterson and was living with him before his arrest. Ernie Raines told CNN's Anderson Cooper he was with his daughter and Peterson as recently as last week, when they talked about going to Las Vegas, Nevada, and getting married.

Thursday night he spoke with his daughter after the arrest.
"My daughter was terrified, very emotional, upset," Ernie Raines said. "And I tried to tell her from the beginning that this was going to happen, be prepared."

Ernie Raines said more than anything, when he heard about the arrest, he was relieved.
"I'm glad justice finally came -- before he hurt my daughter," he said.

Drew Peterson Indicted on Murder Charge

Savio's 73-year-old father, Henry, said Thursday that an arrest should have been made long ago.

"I always wondered," about her death, he said. "I was never pleased with the (coroner's finding of suicide) from the beginning."

In more than a year and a half since Stacy Peterson's disappearance, Drew Peterson has been under a media microscope, and at times he has seemed to relish the attention.

This week Selig said Peterson was interested in a job offer from a Nevada brothel that is the setting for the HBO reality show "Cathouse." An HBO spokeswoman said the network would sooner cancel the show than allow Peterson to appear on it.
